FLORIDA, HELD MAY 10, 1965.
The City Commission of the City of Dania, Florida, met in
Special Session in the Commission Room at the City Hall.

The meeting was called to order at 7:00 P.M. by Mayor Salvino.
The meeting was called by Mayor Salvino, on a complaint made by
Mr. Brook.
Mayor Salvino: He called Mr. Grammer and myself over there to
see some muck, and we inspected and found chunks of muck. Mr.'
Brook, do you want to take over?
Mr. Brook stated that he first went to see the City Attorney to
see if there was some way this job could be stopped. He stated
that the contractors were not living up to specifications, they
are putting pipe in the ground without tamping under it, they
are dumping gravel over the pipe with a payloader. He said that
on this particular occasion it is in front of his property. He
has surveyed this thing and seen it happen. They cut about a 9
foot cut, with about 3 foot of marl on top, under an 8 foot peat
rock, then below that is vegetated muck. He showed Mr. Grammer
and Mr. Salvino. He stated that he made tests and took pictures,
which he would show at the proper time. "I asked the City Attorney
about it, and he suggest that I go about it in the proper manner
without accusing anybody of anything." He stated that if some-
body doesntt do something about it, he is going to get an injunc-
tion to stop the job. He said they have no regard for personal
property, they block any and all streets they want to .block.
Mr. Barry asked Mr. Brook if he would suggest that they dig up,
the whole area.
Mr. Brook: No, I don't think that is necessary, I think there
should be some test borings made.
Mr. Barry: I just want to tell you one thing before we get into
� . this too deeply. My position here is to inspect this job. To see
that this job is put in as closely as possible to specifications.
We are not the constructors. Should you, as a citizen, find some-
thing that is wrong, I personally, and I am sure that our firm,
would appreciate you pinpoint any place that has been definitely.
been done wrong, and we would be very happy to insist that it be
done over. However, I would •like to state this, that should you
pinpoint a place that is wrong in your opinion, that turns out not
to be wrong, there could be some expense involved. To whom, I am
not concerned.
Mr. Brook: Do you know who the inspector was on the job at that
p particular place Friday?
Mr. Barry: Yes sir, I do.
Mr. Brook: Well that particular ,spot' is the one that I want, on
N.E. Second Avenue from Second Street to Third Street.
Mr. Barry: I am here tonight to, try to resolve this thing if at
all possible. If I had known wliat this was about I would have had .

® him here. I was not the inspector.
Bill Brooks: Well I told you what I saw with my own eyes. Now
the only other thing I dan do is get me a camera with a telescopic
lens.
• Mr. Mears, of M. B. Construction Company, stated that if Mr. Brooks
wanted to put up a $1,273,000 bond they would stop the job. He then
asked if they had the teports on all the tests.
City Manager Culverson answered that he had the density reports and
compaction reports on the whole job so far, and the only one that
• they had any trouble with was on the Treatment Plant, which is being
corrected at the present time. And that Mr. Mears work reports have
been 100% or better through the Florida Testing 6 Engineering Company.
Angelo DiMauro stated they (the citizens of Dania) have no gripes with
Mr. Mears; their gripes were with the Engineers because that is who
they are paying.
Gene Pellicia asked when they were going to pave the streets to re-
lieve the citizens of the dust.
Mr. Mears answered that they wanted to make sure they were right be-
fore they paved the streets, then they were going to let them set
until we get some rain. He stated that they were capping the streets
with oil trying to keep down.the dust, but that they were wishing for
rain. He said they were not going to pave anything until they have
some rain.
Mr. Bernard OTConnor stated that he felt they should find out who the
inspector is who was on the job at the time.
Commissioner Zenobia asked .Mr. Barry who was the inspector on N.E.
3rd Street this morning.
Mr. Barry answered that .it was a-.man by the name of Kramer.
Commissioner Zenobia asked if this man (Mr. Kramer) knew the diff-
erence between muck and fill.
Mr. Barry answered that in that case there was muck. He stated
that they definitely found muck, but that he corrected it while
Mr. Zenobia was there.
Commissioner Zenobia: Yes you did, Mr. Barry. But I feel that Mr.
Brook does- in a way, I am not in agreement with him 100%, but I know
he knows dirt, and I know dirt, I am in the same type of business.
And there definitely was muck in that particular spot for about 50
feet.
Mr. Barry: Now let's not go that far. We took it out- after you left
and it was exactly 20 feet.
Commissioner Zenobia stated that he felt there should be a closer
inspection, and that he didn't feel that Mr. Mears was trying to get
away with anything. He suggested that, no fill should be dumped back .
in the holes in the evenings, unless there is an inspector around.
"Going back a couple months ago, I made a motion to pass a resolution
to hire an inspector for the City, and it passed by 5 votes, and I
would still like to see us go ahead and hire that inspector, one
that doesntt tell Mr. Mears what- to do, but he can make notes for
us so that we know what is going on." Commissioner Zenobia stated
that some of the complaints he has received are that there are no
lights on barricades, too much dust, and crossing over private pro-
perty. Commissioner Zenobia asked Mr. Barry if, when they make
these tests, do they take .borings to see if there is any muck there,
or unsuitable soil.

Mr. Mears answered that as long as the test meets the 100% compac-
tion, it is suitable material.
Commissioner Zenobia: It says here "free from organic material" .
Mr. Mears: Or it won't pass the test.
Commissioner Zenobia: Well I don't think muck will pass the test.
Mr. Mears: Well they have so far. I have been in this business
since 1946, and I never have failed a test yet. I will dig them
up, but if they are proved out wrong, somebody is going to pay for
it.
Mayor Salvino asked Mr. Barry what time the inspectors leave the job.
Mr. Barry answered that the inspectors leave the job whenever it is
feasible, whenever there is no construction work going on. He stated
that he happened to be on Second Avenue on Saturday and he saw the
material that was dumped into .the particular ditch that is in ques-
tion. "And while I cannot say on top of that ditch there is no muck,
I can definitely say that beyond the paving area there is no muck.
And I will pay for it personally if I have to to prove.it."
Mayor Salvino asked if there isn't a certain for the inspectors to
start work and a certain time to quit.
Mr. Barry stated that he, himself, is usually around at 7:00 in the
mornings, or perhaps a little earlier. He said that he generally
leaves around 2:00 or 2:30 because he has further obligations. His
men are instructed) to stay here until such, time as .construction work
stops. "Now, what goes on after they leave, when work has stopped,
I don't know".
Commissioner Grammer stated that Mr. Brooks came to his house and
asked him to go with him. Mr. Grammer stated that he thought he knew
r muck when he saw it, and it was a muck and marl mixture in the trench.
He also felt that they should hire a man to check on this.
Mr. Mears stated that they had a guarantee bond, and if anything goes
wrong they will dig it up and fix it.
Mayor Salvino asked Mr. Mears if it was possible to stop the job at
a certain time each day.
Mr. Mears stated that they were supposed to stop at 5:30 or 6:00.
But if they get a manhole that is unsafe to leave, that is the only
'. place they can work.
• Commissioner Grammer stated that at the time the contract was awarded
to Mr. Mears, the engineer said that a work schedule would be presented
to the Commission so that they would know where the sewers were going
in. But to his knowledge, there never has been a schedule submitted
to the City.

Fire Chief Lassiter stated that they have never received any notice
of where the construction is going on. The only way they know what
streets are being blocked is to go out and scout around. They never
4' received a notification of a street .block since the job started He
said that he wasn't complaining, but since he was asked, that was the
A facts.
Commissioner Grammer asked if the contractor could go on private pro-
perty without the owner's consent.
Mr. Mears answered no.
Commissioner Grammer stated that he and the Mayor received a complaint
from a woman who said that she asked them not to use her property, and

® that he told her, the same as he told Mr. Grammer and the Mayor,
it didn't make any difference, that he would wash. it off when he
left anyway.
Mr. Mears stated that she should have gotten the manes name and
reported him to his office.

Commissioner Hill: 2 would like the Commission to authorize the
City Manager to give the Womants Club the money that is set up in
the budget for them, as they need it desperately to operate the
Community Library with. This is not connected with the sewers
in any way, but they need their money, and the City Manager is
• hesitant to give it to them without.our approval. ($2,000)
A motion was made by Commissioner Hill to .authorize the City Man-
ager to give the money to the Womants Club, so that they can con-
tinue operations. The motion was seconded by Commissioner Zenobia,
and the roll being called, the Commissioners voted as follows:

Young Yes
Zenobia Yes

Commissioner Young asked if, getting back to the sewer issue, the
actual basis, the final determination as to whether or not it is
satisfactory, dependant and contingent upon the test borings, com-
paction and density?
• Mr. Barry answered that tona point it is, however in his opinion,
muck as fill is not good. He stated that the amount of muck .that
goes into the job is a minute amount.
Commissioner Zenobia told Mr. Mears that on 3rd Place there is
quite a bit of pea rock lying on the road, he asked if Mr. Mears
• dould get someone down there to sweep it up.
Mr. Mears stated that he would be glad to.
There being no further business on the agenda, the meeting adjourned..
