' The City Commission of the City of Dania, Florida, met in Regular Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER FRANK SALVINO COMMISSIONERS ROBERT GRAMMER VERA HILL S. ELLIS YOUNG CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN CITY MANAGER LESTER CULVERSON BUILDING INSPECTOR CHARLES LINDEMAN CHIEF OF POLICE MONTIE SMITH CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. by Mayor Salvino 1. Minutes of meeting held April 5, 1965 to be approved. A motion was made by Commissioner Zenobia that the minutes be approved as read. Award contract for hospitalization insurance for employees. A motion was made by Commissioner Hill to award the insurance contract to Aetna Insurance Company. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young , Yes, Zenobia Yes' Salvino Yes 3. Ralph U. Lombardi & M. D. Risdon: Application for taxi and y' limousine license. 340 South Federal Highway, Dania, Florida. City Clerk Thornhill: Mr.. Mayor, I.. found out today that Mr. Risdon is asking for a transfer of Nick Pollanari's license, and this is an application for a new one. One is a transfer of Mr. Pollanari's license; and the other is a new one. City Clerk Thornhill read assfollows: " Subject to the approval of the Dania City Commission, I have made arrangements with Mr. Nicholas P. Pollanari of 228 S.W. 3rd Place, to purchase the Dania Taxi Service owned by him, including operating permit. Request that this be favorably considered by the Commission at their regular meeting on 19th of April, 1965. ; Respectfully submitted, M. D. Risdon, 1505 N.W. 1st Ave. Ft. Laud. Fla. City Attorney Walden: Let me say this, several years ago the City of Dania passed a very lengthy Taxi-Cab Ordinance, I believe it was, and after the City passed this ordinance setting forth a number of detailed regulations that operators must comply with, I think it was found that Dania wasn't big enough for tnat kind of ordinance. So in recent years, to my knowledge, the city has simply informally issued these permits. Their main concern, being the insurance cover- L.,:. age. So I just tell you that we have not followed this ordinance -1- , which was passed 7 or 8 years ago. We have simply given permits if you are satisfied with the insurance companies. A motion was made by Commissioner Young to refer both items above to Chief of Police for finger printing and report. The motion was seconded by Comnissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young:; Yes Zenobia Yes Salvino Yes 4. Discussion of specifications for garbage contract. The specifications for garbage contracts was read by City Manager Culverson. Commissioner Young voiced his disapproval of this matter, giving as an example the fact that during the last seven months, from September 1st through March, that the total paid for, which in- cludes labor, repairs, and various other expenses, the sum of $22,885.18. If this was broken down per year on a unit basis, using 2500 water meters as the unit basis, it comes to $15.69 per unit. In view of that, he stated that he did not feel that there was anything useful to be obtained for the taxpayers to continue the matter any further. i A motion was made by Commissioner Young that the matter be dropped. y The motion was seconded by Commissioner Hill.; , Commissioner Grammer stated that since they went to all the trouble to have specs drawn up that he would still like to get a price on ` it, and maybe go to the County Incinerator to see how much it would cost to go to the incinerator, since we already know how much it costs to go to Curcie's dump. So that the city would at least have some figures to go on. Commissioner Zenobia agreed with Commissioner Grammer, that they had investigated it quite a long time, and that the budget this year contained $48,600 and there is $25,000 left. He felt that the city may possibly 'get the`4arbage hauled away that cheap, but they will never know. He also felt that they should try the County Incinerator.r., The roll being called, 'the Commissioners voted as follows: Grammer No. Hill Yes Young Yes Zenobia No .', Salvino Yes 5. Resolution: Accepting the offer of Jordan Furniture Co. , Inc. to purchase the South 7" of Lot 11, Block 22, Town of Dania, and authorizing the proper officials to execute a special warranty deed. City Attorney Walden read the title of the,ordinance as follows: RESOLUTION accepting the offer of Jordan Furniture Company to purchase the South 7" of Lot 11, Block 22, Town of Modello, now Dania, Plat Book "B", page 49, public records of Dade County, Florida, for a purchase price of $75.00, and autho- . rizing and directing the Mayor-Commissioner, City Manager, and City Clerk to execute and deliver a special Warranty Deed to Jordan Furniture Company, Inc. , upon receipt of payment of $75.00. ri. -2- ® A motion was made by Commissioner Young to pass the resolution as read with the stipulation that any and all additional costs shall be borne by Jordan's Furniture Company, Inc. Bills for the month of March to be approved for payment. A motion was made by Commissioner Zenobia that the bills be paid. The motion was seconded by Commissioner Youhg, and the roll being called, the Commissioners voted as follows: • Grammer Yes Hill Yes Young Yes Zenobid Yes Salvino Yes • Bills to be approved for payment from the Sewer Miscellaneous Contingency Fund. A list for the bills for the month of March and a list of the bills from the Sewer Miscellaneous Contingency Fund, are attached to and made a part of these minutes. A motion was made by Commissioner Grammer that the bills be paid. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes 7. Recommendations from the April 13 meeting of the Planning and Zoning Board. (1) Netherton Corporation - request change of zoning from R 1AA to R-3 by Mr. Fred Flipse, president of Exotic Gardens Mr. Flipse was represented by Attorney Lawbence Meyer, who passed plans of the proposed type of structures to the JP board members. The property is located at N.E. Second St. and Gulfstream Road. Mr. Meyer presented letters of appro- val from Dania Marina and DePadro Yacht Basin in the vicin- ity. Mr. Meyer stated that the value of the property would be approximately one-half million dollars and would add greatly to the tax rolls of the City and would promote the • value of the entire surrounding area involved. Mrs. Panella made a motion to recommend that public hearing be granted for the change of zoning requested by Netherton Corp- oration, to be held on May 14th at 7:45. Seconded by Mr. DiMauro and unanimously passed. A motion was made by Commissioner Hill to accept the recommendation, of the Zoning Board and to authorize the hearing. (3) Public Hearing for Change of Zoning for that portion of ® COLLEGE TRACT now zoned R-3 be changed to R-1. Published notice was read by Secretary, Mrs. Panella. Mr. DiMauro made motion to recommend to City Commission that the request be granted as presented. Seconded by Mrs. Panella and carried by unanimous vote. ® A motion was made by Commissioner Zenobia to accept the recommendation and to authorize_AoPublic Hearing for May 17,1965, at 8:15 P.M. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes (4) Public Hearing - Request to change lots 1 through 7 in- clusive, Block 1, NORTH DANIA HEIGHTS, from R-3 Classi- fication to B-1 Classification between S.W. Second Ave. and S.W. third Aven. on South side of Sterling Rd. Mr. DiMauro made a motion recommending to the City Commission that Mr. Geiselts request be denied for change of zoning with recommendation to the Commission that he be granted a variance to use a 32 sq. ft. illuminated sign with a set-back of five feet from his property. Seconded by Mrs. Panella, and car- ried by unanimous vote. A motion was made by Commissioner Young to grant Mr. Giesel a Public Hearing on both items, request for variance and request for re-zoning, to be held on May 17, 1965, at 8: 20 P.M. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes (2) Thomas Callahan - Request for permit to build a new garage building located at 1221 S.W. Sterling Rd. Mr. Callahan was not present, but Mr. Lindeman presented his plan for approval. Mrs. Panella made motion to recommend that Mr. Callahan's plan be approved as submitted: Seconded by Mr. DiMauro and carried by unanimous vote. A motion was made by Commissioner Zenobia that the permit be granted. The motion was seconded by Commissioner Hill, and the roll being ? . called, the Commissioners voted as follows: 0 Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes Mr. Sparkman stated that he felt the zoning of the entire East side should be reviewed in view of. the fact that they are con- tinually having requests for changes. The zoning was padded about 10 years ago, and the cost of developing property has changed. In order to make it feasible to develop property,, :0 the whole picture should be studied, according to Mr. Sparkman. ' Mr. Kennedy made motion that.recommendation be made to the City Commission that they give authorization for study of possible ;, -4- • ® re-zoning of property East of Gulf stream Road and East of S.E. 5th Avenue, from R-AA to R-3 for multiple or high rise dwellings. Seconded by Mrs. Panell.a and carried by unani- mous vote. No action. O B. Correspondence. City Attorney Walden read a letter from the Florida East Coast Railroad, registering a protest and objection on Improvement 5-64 being the improvement of the following street: S.W. 4th Street from Phippen Road to S.W. 4th Court, S.W. 4th Court from S.W. 4th Street to S.W. 3rd Street, S.W. 3rd Street from Phippen Road to RR r/w S.W. 2nd Place from Phippen Road .to RR*r/w, S.W. 2nd Terrace from Phippen Road to RR r/w, For the following reasons: 1. That such improvement does not add anything of Value to the property of FEC Railway Company, 2. That the contemplated benefit appears solely to the benefit of the Victory Heights Subdivision, 3. That no positive benefits accrued to the FEC Railway Company, 4. That the market value of the FEC Railway Company pro- perty is not enhanced by such improvement, that such proposed assessment against FEC Railway Company is arbitrary and so devoid of any reasonable benefit as to be essentially arbitrary and enduced power that the . basis or rule upon which such action has been taken is apparently unjust and inequitable when applying to Railroad properties. I am convinced that after you and the City Attorney have acquainted yourself with the judicial precedence. heretofore established in this state in respect to similar matters, you will see fit to take the proper action which will relieve the FEC Railway Company from this obligation. Thanking you in advance, General Attorney " City Attorney Walden: I .would like to suggest that you refer it to me for some report back. 9. Report from City Attorney: City Attorney Walden stated that he had a telephone call this morning from Mr. William Richardson of Washington, DC, about the apartment building he"and Mr. Harry Hillard constructed across the track. They are interested in hooking up to the Sewers.. .Mr. Richardson indicates that he is willing to pay for the complete cost of hooking up to the City Sewer System, and he is willing to donate the right-of-way and whatever else he obtains,. and is willing to pay a service charge. The only request he made.;was that the City not make any special asses- sment against his property. Mr. Styerts 'letter is similar except that he asked that no charge be made for hooking up to the system, and that no assessment be made until such later date as west side may be sewered. ; . There is a legal problem on this, the Engineer has given written reports saying that neither of these projects will over-load .the system, but the whole bond validation suit, bond sale, and two or three .ordinances that we adopted contemplated that everybody would be assessed. We did not cover any unusual situation such as this. So rather than suggest that you run any risk of having your assessment set aside, I think you have to make your agreement as being assessed on it. Mr. Richard- son states that he is willing to so agree. I dontt know about Mr. .4 Styer. City Manager Culverson: Then they will put the improvements in, and 0 it becomes City property, and then we also assess their property at the ; . regular rate that we are assessing each of the others east of the FEC tracks? ® City Attorney Walden: That is right, and charge the regular service charge. City Manager Culverson: If they agree in writing to the City Commis- sion that they will do these things, then we will let them hook into the Dania Sewer Sybtem, is that correct? • City Attorney Walden: Right, subject to the agreement being ratified by you and approved by me. I think you might make a motion just to go on record. A motion was made by Commissioner Young that the parties in question • be allowed the right to connect into the sewer program, providing they do it by the time the sewer program is ready for operation, and pro- viding they agree to donate to the City the improvements; and provid- ing that they will agree to an assessment in compliance with the assessment ordinance. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: • Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino - Yes City Attorney Walden: Some time ago L.S. Inc., was called upon, or did agree to give an easement across the E. 5' of it's property. Mr. Sparkman, of L.S. Inc., asked that I prepare the easement and present it to you tonight. So if you wish to acceptit, you need a resolu- tion for an easement across the East 5? of.Lot_l,.Block 4, Lot 12, Block 4, and Lot 12, Block 1, Royal Palm Vista, according to the plat thereof, :according to Plat Book 41, page 12, Records Broward County Florida. ;L A motion was made by Commissioner Young that the request be tabled. Commissioner Young: In the first place if any intent of purpose is to put the sewer main in that area, I don't think the drag line could operate in 5 feet. As far as the lateral is concerned, that is some- thing completely different. The motion was declared dead for lack of a second. A motion was made by Commissioner Zenobia to accept the 5 foot easement, and all other agreements on that property be null and void. Report from City Manager: City Manager Culverson read a letter as follows: " Re: Sanitary Sewer System: Dear Sir: With reference to pumping station "M" on N.E. Second Street near Gulfstream Boulevard, we would like to have your advice as to the location of your proposed pumping station on the j ; property which the City of Dania is purchasing on the North side of N.E. Second Street, just east of N.E. 6th Court. We understand that this parcel is.100 feet wide along the frontage of N.E. 2nd Street. It appears that only 25 feet of N.E. 6th Court along the West. boundary of the subject property was dedicated by the Royal Palm Vista Plat. Will you please advise as to whether the City intends to reserve r •. the West 25 feet of the subject property to make N.E. 6th • Court 50 feet wide? It City Manager Culverson: Right there I would like to make a comment. Where was nothing ever dedicated there, and if they dedicate it there they would have to go through .that house at the rear of the lot. • "We have suggested that possibly the best position for the pumping station would be centered in the 75 or 100 feet, as the case may be, on the South boundary of the property. This could provide sufficient room on both sides of the pump- ing station for a circular driveway to serve the property. The pumping station would then be accessable for maintenance • from N.E. 2nd Street.,without entering upon the property. After construction is complete; the City could landscape the pumping station, apertenances, in such manner as to completely screen it from the surrounding property. As soon as we receive your advise to both questions, we will prepare the necessary change order. " • A motion was made by Commissioner Grammer that Pumping Station "M" be. placed in the S.W. corner of this lot, that a change order be drawn up, as per the City Manager's recommendation. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: • Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes • City Manager Culverson read a letter as follows: " Alltservices;in successfully aerving the interests of'-the City of Dania for the above cause, concerning the 20 year lease of the . Marinarium at Dania Beach, through the obtaining of a summary final degree in favor of the City on April 6, 1965, upholding and sustaining the position of the City in dismissing the cause against the plaintiff, with such services generally including the following: 1. Examination and investigation of the separete Title Change which the City required the property involved in the lease, • 2. Investigation from a surveying standpoint to determine the approximate parttof the total City Beach was involved in the lease, and to determine what part of the land acquired from the state in 141, which was the,subject of the plain- tiff's complaint, comprised the are included intthe lease. 3. Analysis and research concerning the 1941 special legisla- tive act authorizing the conveyance of the state land to the city subject to public park restrictive covenant. 4. Legal research of questioned as to whether Marinarium use violated public park restriction of the 1941 act. 5. Research analysis of plaintiff's complaint or declaratory decree which sought to have the lease declared illegal which further sought an injunction against the city from releasing the land. 6. Preparation of claims filed on behalf of the City of Dania including motion to dismiss, dated January 12, 1965, motion for summary, final decree, dated February 18, 1965• Order which was entered concerning motion to dismiss and various incidental pleas, such as notice certificate, etc. 7. Research and preparation-of!,a memorandum being submitted to the court in support of the position of the City, with arguments being set forth by the court as a basis for ending the final decree in favor. df the City. 8. I have a letter as follows: O Dear Mr. Culverson: The cost of our services in connection with the assessment roll t for the current Sanitary Sewer Program are as follows: 1. Professional services of registered engineer or Registered Surveyor $ 12.50 per hr. 2. Clerical and Drafting services as necessary. $ 7700 per hr. If there is any further information we may furnish you regarding r; the above, please do not hesitate to call us. Y! /s/ Broome S Farina " A motion was made by Commissioner Hill to accept the recommendation of the City,Manager and appoint Broome 6 Farina, and to keep Mr. Philpott as advisor. " Commissioner Young: The only discussion I have right now is to be sure that in the charter changes that the portion. that states that it shall be illegal for a:candidate to-meet voters except as a body, i ` etc. , is being changed. Is that being changed, that is the provision for absentee ballots? City Attorney Walden: No. , In one of the letters I wrote, the general law of the state permits .the City to adopt absentee voting without any charter change. That, and another thing was the use of County Regis- tration System. You can use that without any charter change. You have to adopt an ordinance, however. `- Commissioner Young: We have a provision in the charter now that states there shall be no absentee voting. - City Attorney Walden: We have a general law though that allows absen tee voting. Chief Smith: I would like to respectfully request the City Commission to instruct the City Manager to advertise for bids on Police cars. I would also like to ask the City Manager to draw up an ordinance, for the CityCommission to pass and adopt it, allowing all. City Employees. to be fingerprinted and photographed, and for these prints and photo- graphs to be kept in the Police Department in the regular fingerprint files, also to be included, and City Commission candidates, if that is agreeable with the City Commission. -8- A motion was made by Commissioner Zenobia to authorize the City Man- ager to advertise for bids-'for three new police cars, bids to be re- ceived until 8:30, May 17, 1965. The motion was seconded by Commis- sioner Hill, and the roll being called, the Commissioners voted as follows: Grammer Yes • Hill Yes Young Yes Zenobia Yes Salvino Yes A motion was made by Commissioner Hill to instruct the City Attorney • to draw up an ordinance and pass it on first reading, that all City Employees and City Commission gandidates be fingerprinted and photo- graphed. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes • Hill Yes Young Yes Zenobia Yes Salvino Yes Bernard O?Connor, 221 S.E. 2nd ,Terrace; asked if the Charter Changes • will be advertised once a week, locally, or in other papers? . City Attorney Walden answered that they,will be advertised in the Dania Press, Erline Gifford, 202 S.W. 15th Street,asked if the assessment was 4-1/2 • cents a square foot, approximately.; She asked if her sewer connection could b.e made between Lot 16 & 17, they would be willing to pay the assessment. Mr. Barry answered that the 'design of the sewer is such that we can't serve where the lady speaks of. We have to serve this property the • best way we could with the existing design of the sewer. This is just a proposed street, ,and has not been included presently in the assessed area. There is no way.that this,.could be done unless there is 400 feet or somewhere near that run down what will be eventually a street. It is not a street right now. The property is served the best way that it could be served with the present design of the sewer. Should the • sewer be included, should there be an extention to the present design, that would carry the sewer ',easterly from Second Avenue, along what might -be 15th Street, then .that property can be sewered. Erline Gifford: Would we the property owners be responsible for paying for the extention down 15th Street? And why? Commissioner Zenobia answered that they would, because it costs more than what the assessment is to put a sewer in. Right now, the only ones that are included are the streets already built up. Anyone who would come in later in acreage would have to pay for their own sewers. Clyde Grampat 22 S.E. 15th Street, stated that he understood that someone was supposed to come around to inquire which 'side of the house to put the hook-up, but no one came to his house, and it is on the wrong side. He asked if he could get it changed. t; Mr. Barry stated that they do try to contact the people, but sometimes ;• they cannot. So they then try to determine by observation where the -• septic tank was. Angelo DiMauro, 25 S.E. 15th Street, stated that he had the same prob lem, but his was changed. He wanted ,to know who was paying for all these changes, the City' r -9' y �dL Mr. Barry stated that, in most instances, the responsibility of 0 location was the contractor's. Mr. DiMauro's situation, the cost has been borne by the contractor. There has been no pay for it. Mr. Barry stated that he*would be happy to check Mr. Grampa's line. Bob Houston stated that he heard Mr. Grammer say that the streets 0 are ready to be paved, is this true' Mr. Barry answered that 15 and 14 Streets, 13th Terrace, and 12th Street have been bonded and sealed. They are ready for asphalting, which will not be done for at least 60 days. The crew will continue 0 to work North between 2nd Avenue and Federal Highway. Mr. Houston also asked how much muck is allowed to go into the trenches. Mr. Barry stated that there will be a certain amount of muck, but it is minute in comparison. 0 Commissioner Grammer: We recommended that a letter be sent to Mr. Tarpley and Mr. Thornton for appreciation that they served on this Commission, they haven't received them. And I would like for the letter to be sent out to them. And I also would like to bring up again about the comfort station at the beach, which we at one time 0 recommended that they get plans for. I would like some action taken on it tonight. A motion was made by Commissioner Grammer to have the City Manager either find the plans for the building at the beach now, or have Broome E Farina draw up some plans for the same style that is at 0 the beach now. The motion was seconded by Commissioner Young, -and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes 0 Salvino Yes Commissioner Hill: I, know that the City Manager has started a beautification program over in the colored cemetery. I am very happy to see this, and I would like to recommend that he carry this 0 program on a little further and plant a few shade .trees in there, such as Melalucca type, or whatever you see fit, and also a few benches in the area that is mostly used. A motion was made by Commissioner Hill that the City Manager set up a meeting with County Commissioner Frank Adler, and the City Commis- sioners, to get together and try to work out some program on Old Dixie Highway. The motion was seconded by Commissioner Young, and the roll being called, The Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes , Salvino Yes Commissioner Zenobia stated that hewould- like a special test made of the fill put back in before they pave this part of the street .Mr. Houston 0 was talking about on S.E. 2nd Avenue, between S.E. 3rd Place and 4th St. Also he had a letter handed to him before.the meeting,addressed to the City Commission. He read the letter as follows: " Dania City Commission, Dania City Hall, Re: Civil Service Feasibility.Report Dear Commissioners, - . , We, the below named members' of the Civil Service Feasibility Study Board, wish to make our feelings known-at this time.
