Chief Smith: This man through, I guess you would call. it ignorance on his part , he wasn't advised by his attornev that he had to trans- fer that Ti.cense through the City when he boup-!ht ghat place. And he has iust been informed by the State that he only has 15 days to get his city l.irense cleared away. And we have printed him and processed him, and I think by next mceti.ng time that will oxnire. lie has been cleared with the State , and I would just for his convenience., he has spent an awful lot of: money over there, request that This be nassed on the second reading i.f possible, for the man's nrotec+-ion. Commissioner Young: If that is the case why didn' t he. anply hnforn? Chief Smith: He should have. It was ignorance on his hart , Commissi.oner Young: That' s no excuse for the law and you know that. , pity Attorney Walden: Let me say this . Sul- I don't know if vou. . . • Chief Smith: I have checked +1i.m out thoroughly to exnedite this matter, for his own sake. It's no fault of the Cities . It 's no fault of mine. It is just that he has neglected through ignor- ance on his part. Iie wasn't advised nronerly by his attorney. And he has gotten himself into this mess. • Commissioner Young: Have you approved the nppl.i.cati_or yet? It ` already has your approval on it? Chief Smith: I haven't signed it yet, but I have approved it. • Commissioner Young: That 's what I mean. Chief Smith: I spent some time calling and I was busy with another matter, but Mrs. Thornhill and I know about it. Commissioner Zenobia: I have never seen them gold 10" back before Ellis, once the job was inspected and approved . i Commissioner Young: Well this ian't, from what it- says here, re- commendation from the Engineer that he is approving and recommend- ing payment. in full, which is what we usually have. That's the only reason for my questions . • Commissioner Grammer: It is recommended by the Building Insnec- for and he is the one that measures it. The Engineer don't measure - it up. He always measures don't you Charlie? Building Inspector Lindeman: You can get Philpott down to look at it: if you want. Commissioner Zenobia: No , it's Broome & Farina. Mayor, City Commissioners , Miss Thornhill I believe there wns another hill_ on the insur- ance. That should be presented for payment. City Clerk Mary Thornhill : The Insurance bill.? That 's a bill. from the Myron Wall Insurance Agency for insurance on the Snni - tary Sewers and Pumping Stnti.on in the amount of: $1,273,OBB.20 and on the Sewage Disposal. Plant in the amount of: $ 454, 579. 00 and the premium on the policy is: S 2,090.00 Commissioner Young: That's for fire and extended coverage, is that correct? City Clerk Mary Thornhill: Fire and Extended Coverage and Vandal- • ism and Malicious Mischief. A motion was made by Commissioner Young for the payment of the bill. The motion was seconded by Commissioner Hill.. City Manager Neff: Mr. Mayor and Commissioners , I originally gave you the figure of �2,692.00 on this however the difference , the reduction, is that Mr. Wall. had originally taken the figure 2-1/4 million dollars . This was the total of the bond issue, and this is not the total of the construction. So we got the exact, figures on the construction which reduced it some six-hundred and some odd dollars. Commissioner 7.enobia: Was this checked out with any other comeany to see if it is a fair price? City Manager Neff: No this was brought to the attention of the Commission at the last meeting. They were asked what their plea- sure was. It. was brought to the Commission's attention and was told to proceed with the local board. Attorney Walden: If this is going to be paid by the trust fund money that is the sewer money, I believe we should also have a resolution authorizing the acquisition. Commissioner Young: Let me amend my motion to add that this will be paid by authorization of a resolution allocating the funds from the sewer project fund. Mayor Salvino: Do I hear a second? City Manager Neff: That 's correct. Commissioner Young: And then you mentioned a little later on a trade-in allowance of t62r,.00. Now that i.s just a trifle confusing., City Manager Neff: Well this is a trifle confusing in the way that • the hid was made out. Act-ually they dial nor. show a gross nri.ce. They showed the net- nr. ice but showed what- the allowance was. So from the tenure of this letter I would say that t-he price to the city was �I ,9C6.r.5. Before he can come back to have another hearing he will. have to have nn adver= tisement to come before the Zoning Board , won't he? ♦ City Attorney Walden: As I understand these minutes the 7oni.ng Board in effect took no action and did nothing and just continued over to this next meeting. Commissioner Grammer: I see in the first place he said he is asking for a Public Hearing for a Variance Permit. Building Inspector Lindeman: He ,had the Public Hearing. Commissioner Grammer: Well. you can't give a Variance Permit to change the zoning, you got to give something zoned right before • you can give him a variance or a set-back.. City Attorney Walden: Let me say this , I think the Commi.ssion is entitled to the benefit of the Zoning Board recommendation, whatever it is , be it favorable or unfavorable. The ' Commi.ssion does not yet have it. �Y t; • • A Commi.ssi.oner Zenobia: Let me nsk this Clarke, when he comes tin for this hearing again with t-he Zoning. Board does he have to advertise for that: again, or would i.t just continue' without an- other advertisement? City Attorney Walden: Let me say this quite frankly, in recent • months I have noticed, through I think clerical errors more than anything, some times the minutes are typed un and refer to a variance when it is really re-zoning. But if he nsked for any kind of relief from the Zoning Board he must have a henring on it .hefore the Zoning Board . The minutes do not refer to any formal. clearing. Now the zoning board, if that is what he has • properly applied for is a variance, can frankly make a recommen- dation to you,and you may feel that there .are insufficient grounds for a variance, which is basically an undue hardship, more nronerly I think it should be applied for re-zoning. Commissioner Zenobia: I was at that Zoning Board meeting and these • minutes don't show the same as the meeting was as far as I nm con- cerned. The fellow was talking about re-zoning to 71_1. at the meet- ing, and there is nothing here at all about it in the minutes. Building Inspector Lindeman: The advertisement said a vnriarce. • Commissioner Zenobia : Yes, the advertisement said a variance, but al.] through the meeting they kept, stating re-zoning to M-1 . And there is nothing in these minutes at all stating that. I think half of the meeting was left out of the minutes , because it was quite a long meeting. City Attorney Walden: I suggest that you frankly do nothing to- night other than wait until the Zoning Board makes some recommen- dation to you, because there would he no action that you could take. Commissioner Zonobia: I still. didn't get an answer to my question, • does he have to advertise again? City Attorney Walden: No . ., 8. Correspondence: City Clerk- Mary Thornhill : We have a telegram Mrs. Thornhill read the telegram as follows : "llonorab.le Mayor Salvino, City of Dania: Will you join in protest to our Broward County Legislature of the high-handed arbitrary and discriminatory methods being used to force our cities to use a County incinerator unnecessary at this time and at great cost to the tax-havers of your community. .Sincerely, Harold S . A motion was made by Commissioner Young to set a public hearinl* for March 15, at 8:15 P.M. The motion was seconded by Commi.ssi.oner O 7.enobia. Commissioner Grammer: With that change? Report- from City Attorney: City Attorney Walden: Gentlemen, and Mrs. 11i.11, the only thinst I want to report is that I appeared before the Legislative Del.e- g5ti6n on February 4th to indicate these proposed Charter Changes. The most important one is the one in which we would extend the term of the Commission to four years and adopt what I call the "HoJ.lyWood Plan" giving the separate plan to the Mayor who would have a two year germ. Evidently many other r ities are asking for similar changes in their charters , and the delegation asked that the Commission basically have some kind of a Public Hearing. And I i.ncli-cated to the delegation that I would make that suggestion to vou. You have ample time and I suggest that you simply devote some time on the March 15th meeting to a hearing on the oronosed changes so that any one who objects could appear before you to present his objections. While you don' t have to ad'vert-i.se in, any formal lea�sl fashion, I suggest that you try to give a l.iatle publicity to it-. In other words in that: meeting maybe at 9:00 you could try to set aside some time so that the proposed changes could be expininecl and if anyone had any formal objections you could note it, and of course we would want to relay that to the delegation. I think a motion that the hearing be had and that you give it as much publicity as possible.. P,enort from the City Manager: City Manager Neff: re: Complaint from Mr. Penta, S.W. 1.0th St. and S. 1•7. 2nd Ave. - Trailer Park. I checked with the Engineer and found that parking on the Trailer r Park property as such cannot be prohibited. It is Legal. . And it is just one of those situations in the city where we have a real narrow street and a sidewalk on the South side of it and nothing but the trailer part: on the North side of it, and the recommenda- tion at this time from the Engineer, would be that we acquire an additional right-of-way from the trailer park. This might be a � ; hard thing to do , but this is the `recommendati.on. 2. Water lines to Sheridan Street Islands : City Manager Neff': I am glad to renort that they are rompleted . They are installed , grounded then rerompactert , and except for +-he hook-up to our own mains the job is comnlete. 3. Heating for the Senior Citizens Building: City Manager Neff : I have checkers it out and this is the results that I find. These are all. approximations because there have been no actual, survey done , but these are approximations by the Peoples S Gas Company and also by the people who make the air condi.ti_oners that are now in there. There can be a reverse-cycle addition added to the existing air conditioner in the Senior Citizens Building_ that would be adequate, that would run approximately 5240. 00. There. can be a gas hanger heater unit that hangs from the ceiling. This can be put in for approximately $275.00. Now going into new business, before I do I would like to make one statement here, I suppose most folks know that we had our first fatal_ acci.dent in the City of Dania today. There was a man struck by a hit-and-run driver and -he was killed instantly. I 'm very sorry that I have report that . That's our first fatal accident , however there is a brighter side to it. I want to go on record as congratulating the entire Police Department , 30 hours after this hit-ard-run happened the Police Department. in Dania had apprehended the man who was driving the car and he is now in custody. There is one other thing, I discussed wi.th most of the commissioners and and also with County Commissioner Adler, in regards to a proposal to pass a resolution of intent to enter into an agreement with the County Commission to extend a water line down Taylor Road in order to have the County pave the road . The County is willing to pave the road if the City of Dania puts the water line down the road for a portion of 26 hundred feet. It is a four-wav agreement entered into by the Florida Power & Light Co. , the County, the oronerty owners , and the City of Dania; and after discussing it with County Commissioner Adler, he recommended that the City pass a resolution of intent 1:0 enter into this agreement. City Attorney Malden: It would seem though that you would never make a change order unless you first got- hi.s advice on it. Commissioner Zenobia: Well I had his advice on this. What Bob is getting at is that we should send some kind of written notice to him that we dial pass this change order. City Attorney Walden: Oh yes , that should be done. And I would in wording it effect that Mr. Philnott have the nrimary Liability and responsibility and say on his recommendation.you have done all. these things , because he is the consulting engineer. One of them is 30 acre park and the other is West Side Park, due to the condition of the parks . Thirty-Acre Park has at least half of the trees have dead limbs hanging off them, and there are a few piles of fill laying around , all. the grass needs to be cut, and there is an old piano sitting under the grand- stand , a couple of balls laying around , the sink torn off the ladies room. In other words it is qui.te a mess, and it is a park. I would like to see something done about it. City Manager Neff: Mr. Zenobia, may I answer. . .are you through? Commissioner 7,enobia: I 'm not through, no. I know the City Man- ager is supposed to take care of it , but I have been here for 3 months and it has been that way a long time Mr. Mayor.. and I did want to get on record that it should be taken care of. . Alow I know the City Manager is sunposed to he taking care .of it. and I think it should be taken care of right away. And getting over to West Side ?arl, we have a condition in the pool. The pool is emntv, . but in the bottom of the pool you have about a foot of. water. ® That foot of water has been seen by all of us , and we said we would take care of it. It has old shoes and tires and every- thing in there , and i.t 's still in the same condition. So is the lealty faucet on the building. That is the .same way since I have been here , there hasn't been anything done with it. The fill is tone out from underneath the si.dewnik there. There are • no swings on the swings . The bars are there, but no scaings. The fence when I first tool: office cans half.-way down, now it is all. the way down. That's the same place where thnt lady fell. the other night. So I believe thnt there should he. something clone with both of these park- and that 's why I nni hri.nginp it- up now. Commissioner Hill: Please, if you don' t mind . . .our Acting City Manager has certainly had her hands full, and our now City Manager • has his hands full. with the sewer program which is very i.mnortant. And I agree . I think these parl.s do need care because I have seen them myself, but I H i.nl: we should be fair and gi.l'e our City Man- ager a chance +•o do something about them. We have ordered some clay to put on the hall diamond down there, I have instructed that there will. be some labor sent down there, • some of the prisoners will be sent down there to rut the weeds that couldn' t be cut: by the mowing machine, and this situation is being taken rare of as quickly as possi.bl.e. The same is hei.ng done at Nest Park. Mr. Thomas has been instructed to fix flat faucet , the windows have been repaired by Wi.nther Glass Comnany, and I asked him for a list of equipment that he needed at the park to put the park in good shape and I have that list on my desk now, and as far as the budget will allow we are going to replace the swings and the fence and so forth.
