FLORIDA, HELD DECE4BER 7, 1964.
The City Commission of the City of Dania, Florida, met in
Regular Session in the Commission Room at the City Hall.

The meeting was called to order at 8:00 P.M. by Mayor Salvino.
1. Minutes of meetings held November 16, 19 and 23, 1964 to
be approved.
A motion was made by Commissioner Zenobia to approve the minutes
. as read. The motion was seconded by Commissioner Grammer, and
the roll being called, the Commissioners voted as follows:

2. Consider Water Agreement with Dania Marine & Ship Repair,
Inc. , to furnish water. to Port Laudania.
• Attorney Walden: At the last meeting, Mr. Mayor, this came up
and was referred to me to determine one or two things., (1) The
City does have the..necessary easement to get the water to the
South bank of the Canal. So, I would like a resolution passed
and adopted authorizing an agreement with Dania Marine & Ship
Repair, Inc. , which would provide, among other things , the City
at its own expense would furnish the line terminating at the
South bank of thb canal. And the Dania Marine &Ship Repair,
Inc. , wouldppay the. regular rate, plus a premium of 25% of the
rate for any water service furnished to it. (2) That it (Dania
Marine & Ship Repair) would have the obligation of getting the
water line across the canal, that would go under the canal as I
understand ,it. Also, it has been requested by the Telephone
Company that it would be. allowed to use the easement. So if that.
is what the Commission wants, if you will pass the resolution,. I
will then have the agreement executed.
A motion was made by Commissioner Young to adopt and pass a
resolution allowing the city to run water lines to the South
side of the Dania Cut off canal, for the purpose of providing
water to Dania Marine & Ship Repair, Inc. , .Port Laudania. The
motion was seconded by Commissioner Hill, and .the roll being
called, the Commissioners voted as follows:

0 3. Award Contract for paving S. W. Second Terrace an&i S. W.
Seventh Terrace.
Acting City Manager Thornhill: Mr. Mayor, I have a recommendation
from Broome and Farina, the Engineers. It says. . . .
• "We are recommending that the contract for the paving
of S. W. Second Terrace from Phippen Road to the FEC
railroad right-of-way and S. W. Seventh Terrace from
Phippen Road to the FEC railroad right-of-way be
awarded to DdMar Paving Company for their bid in the
amount of $2.15 per square yard.

A motion was made by Commissioner Zenobia- to accept the Engineer's
recommendation. The motion was seconded by Commissioner Grammer,
and the roll being called, the Commissioners voted as follows:

• Commissioner Young: I don't feel that the radius is sufficient
at the end of the street.
Commissioner Grammer: I don't either, Commissioner Young, but
that is all the property that the City owns for the right-of-
0 ways.
4. Robert Hunt: Request permit to take and sell telescopic
pictures at Dania Beach.
Robert Hunt: Last week you told me I wabld have to get permis-
sion from the two gentlemen who already have the rights on the
beach. Mr. Rhodes gave me permission. And my Attorney called
Mr. Weston, who represents the Marinarium tenant, and Mr. Weston
called Mr. Walden. He has no objections.
Commissioner Grammer: You won't take anybody's picture unless
• you ask permission first?
Robert Hunt: That's right.
Attorney Walden: Since neither of the tenants out there care,
actually it is up to the city to present his license to him now.
• I don't know what category you want to put him in.
Mary Thornhill: I think photographers calls for a $15.00 license.
A motion was made by Commissioner Grammer to permit Mr. Hunt to
operate with the stipulations that Mr. Rhodes will submit a letter
stating that he is in favor of it, that Mr. Hunt will take no pic-
tures without permission, and that the. City may revoke the license
in the event their should be any ,trouble or difficulty. The motion
was seconded by Commissioner Hill, and the roll being called, the
Commissioners voted as follows:

5. Transfer of 4 COP License from Charles A. & Elizabeth P.
Lehew to Nicholas Belle, and from 12 North Federal Highway
to 706-710 N. W. First Street. (Second Reading)
A motion was made by Commissioner Zenobia to approve the transfer. '
The motion was seconded by Commissioner Grammer, and the roll being
called, the Commissioners voted.. aa follows:

• 6. Transfer of 4 COP License from Dorothy C. Ihle to Georgia
L. Weber, Patio Pit, 242 East Dania Beach Boulevard.

A motion was made by Commissioner Young to pass on first read
• ing. The motion was seconded by Commissioner Grammer, and the
roll being called, the Commissioners.voted as follows:

7. Robert LaCroix, representing the Dania Optimist Club.
Robert LaCroix: The Dania Optimist Club has asked me to request
permission of the Commission to hold a Dania Optimist Fun Week
sometime in the latter part of January or early part of February.
There will be no amusements on Sunday. Ittwould run ten days.
We would like to have it on the City of Dania property behind the
Chamber of Commerce. And we would like the Commission to waive-
the license fee. We would not sign a contract with anyone unless
• the Commission approves it first. It would be childrens rides,
adult rides, and concessions, approved by the Commission. Each
ride and each booth will be outlined in detail so* that the Commis-
sion could rule on what they would allow and what they would not
allow.
• Commissioner Young: You are not contemplating anything likc
pitching pennies or anything like that are you?
Robert LaCroix: No, there will be no gambling. . Only food con-
cessions , hot dogs, soft drinks,, and rides.. We wouldn't sign any
contract until the Commission has approved it, read it, and stricken
from it anything that would be undesirable. We will have each booth
outlined in detail as to what it is, prices to be charged, eto.
Commissioner Hill: Do you have insurance?
Robert LaCroix: We will demand a bond. We have two or three proq
positions in mind, but we haven't signed any contracts. We would
like to look them all over and investigate each one thoroughly,.
and then present all three of them, or the one that we thought was
best to the Commission for their approval.
Commissioner Young: That will be for approximately ten days?
• Robert LaCroix: Two Fridays, two Saturdays, no Sundays, and it would
run during the week if that is alright with the Commission. We want
to do what is right. We want to get a nice proposition, doing some-
thing that we could be proud of and something that we could do each
year. The Optimist Club certainly doesn't want to bring in anything
to Dania and lend their name to anything that would bring disrepute
on the City.
Commissioner Young: Do you hhve any contracts or offers available?
Robert LaCroix: No we don't, but we can make them available to you
next Monday.
A motion was made by Commissioner Zenobia to hand this over to the
Police Committee to work it out with the Optimist Club. The motion
was seconded by Commissioner Hill, and the roll being called, the
Commissioners voted as follows:

8. Attorney Walden: Resolutions regarding validation of Sewer
Revenue Bonds.
Attorney Walden: I understand that the delivery of the bonds is
scheduled for Wednesday in Chicago. The bonds will be signed there
and transported to Dania. It is necessary that you name a bank as
a trustee or depository as you call them. And without any formal
authorization, I assumed you wanted the Dania Bank, but you can
name any bank.
RESOLUTION NO. 1624
RESOLUTION No. 1624, with respect to $2,250,000, City of
Dania, Broward County, Florida, Sewer Revenue Bonds , pro-
viding for the appointment of a trustee bank as trustee
and depository of any money received by the City; ,persuant
to Resolution No. 1613, particularly Sec. 8 and Paragraph
2, for approval and execution of appropriate trust agree-
ment or agreements between the City and Trustee Bank, bet-
ting. forth among other things the dues, responsibility and
compensation of trustee, all in accordance with and persu-
ant to the provisions of said Resolution No. 1613.
Attorney Walden: If you adopt the resolution you will authorize
the execution of the trust agreement with the Dania Bank.
Commissioner Young: Who has the right to invest these monies in
government securities?
Attorney Walden: The trustee has the right if it is within the
limits of the limited type of governmental obligations you will
have.
Commissioner Young: Do we have the right to counsel or recommend?
Attorney Walden: I think you have that right. I don't know if
you have the right to absolutely direct the trustee as to what to
do, but you certainly have the right to make recommendations.
A motion was made .by Commissioner Grammer to adopt the resolution
and trust agreement. The motion was seconded by Commissioner
Zenobia.
At this point a discussion arose .between Mr. Virgil Tarpley, Mr.
Joseph Thornton, and Mr. Harvey Henann of Barcus, Kindred & Co. ,
as to whether the City Commission was going to validate the entire
$2,250,000 Sewer Revenue Bonds when the cost of the sewers was not
going to be that much. Mr. Tarpley stated that there would be a
carry-over of roughly $1,300,000. Mr. Henann explained that there
was going to be no surplus because the money in excess of the cost
of the sewers would go toward the Engineering Fee, the Attorney
Fee, the Rights-of-way fee and other expenses not included in the
actual cost of the sewer construction.

® Referring back to the motion to pass the resolution and trust
agreement, the roll being called the Commissioners voted as

Attorney Walden: It .will be necessary, prior to the delivery
of these bonds, to sign a closing statement so that the fee of
• the City Attorney be determined as paid. I have a suggested
figure and a suggested resolution that I will read.
Section 1: That the payment of the Attorney Fee of
$129500 to Clarke Walden be, and the same is hereby
authorized for all legal services rendered previously
• and to be rendered by said Attorney Walden, City of
Dania, Florida, in connection with the Sanitary Sewer
Program, which is being financed by the issuance of
$2,250,000 Sewer Revenue Bonds. Said fee shall include
payment of all previous payments rendered by the City
of Dania, Florida, concerning the Sewer Program, in-
cluding services rendered in various governmental
application services.
A motion was made by Commissioner Young to adopt and pass the
resolution to pay the Attorney fee of $12,500 to Clarke Walden.
The motion was seconded by Commissioner Grammer, and the roll

9. Acting City Manager's Report.
Acting City Manager Thornhill: Mr. Mayor, at the last meeting
it was discussed extending this Christmas lighting another two
• blocks in the City of Dania,and you authorized Chief Lassiter
and I to go ahead with it. I hope all of you haven seen the
lights up and down the highway. I drove through Sunday night
and it looks very pretty. I would like to commend Chief Las-
siter and his men for the wonderful job that they did on them.
Also, you authorized a safety.device for the water tower to be
�< ordered, and that was done this past week with the help of
Chief Lassiter. That is all I have.
Chief Lassiter: In past years we have had a rule of thumb
limiting Service Stations to 12,000 gallon maximum storage, and
maximum single tank of 4,000 gallons. We don't have an ordinance
on that, but it'has ,been a rule .of thumb that we have been going
by. Some companies have incleased"' that. We have two coming up
now who want to increase their gallonage to a little hihor limit.
I would like to suggest that we pass an ordinance limiting Service
stations in Dania to a maximum of 15,000 gallons gasoline storage,
and a maximum of 4,000 gallons tanks. With the exception that
6,000 gallons will be allowed with permission from the proper
authorities.
Mayor Salvino: We will refer this to the City Attorney and the
Fire Chief to work it out.

• Commissioner Hill: I would like at this time to make a motion
to vacate the office of the Chief of Police of the City of Dania.
Attorney Walden: Mr. Mayor, so that you can proceed, I believe
that you ought to call for a second to the motion.
• Mayor Salvino: Is there a second to the motion?
Attorney Walden: You are going to have to then declare the motion
dead for lack of a second.
• Mayor Salvino: I will declare the motion dead for lack of a second.
There being no further business on the agenda, the meeting adjourned.
