HomeMy WebLinkAbout86165 - MINUTES - City Commission - MINUTES OF SPECIAL MEETING, CITY COMMISSION, CITY OF DANIA, FIMIDA, HELD OCTOBER 28, 1964. The City Commission of the City of Dania, Florida, met in Special Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER VEfRA L. HILL COMMISSIONERS ROBERT L. GRAMMER VIRGIL L. TARPLEY S. ELLIS YOUNG CITY ATTORNEY CLARKE WALDEN CITY MANAGER LESTER E. CULVERSON CHIEF OF POLICE MONTIE F. SMITH CITY CLERK MARY THORNHILL The meeting was called to order at 7:00 P.M. by Mayor Hill. Mayor Hill: The meeting was called for basic instructions from our City Attorney and our City Clerk pertaining to our election laws for the City election. City Manager Culverson: May I interrupt for just a minute? I would like to have permission from the Council to have Broome and Farina approved as surveyors for our Sewer Program in conjunction with our studies. Also, I would like to have y authority from the Council to hire a right-of-way agent for ,'. our sewer program. A motion was made by Commissioner Young that the City Manager be authorized to hire Broome and Farina as surveyors; and also to give the City Manager authorization to hire a right-of-way } agent. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpleyw Yes Young Yes Hill Yes City Manager. Culverson read a letter as follows: " City Manager Culverson: We respectfully request partial payment of.$2,000 for planting trees and shrubs on S. W. Fourth Ave. Dania. /s/ Wildwood Tropical Nursery " City Manager Culverson: I recommend that this bill be paid. A motion was made by Commissioner Tarpley that the bill be paid. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Young Yes Hill Yes City Attorney Walden: I have analyzed the problems that might confront an election official. I think one thing that will coma up is . . . .do you let a person vote if their name is not on the registration list or roll? I imagine that you will have people show up who have a little card that Mary gave them some years ago showing that they were registered, but you can't find their _ name on the registration list. ;7`: City Attorney Walden: Miss Thornhill sent out a questionaire to every voter in this City the first part of the year, in com- pliance with the state law. And , having done that, I must now tell you that if a person's name is not on the registration rolls do not let them vote under any circumstances. The other problem that I would anticipath is the question of challenging. What happens if a vote is challenged? You will be furnished with forms that an elector must sign if he is challenged. It is an oath that states that if he is challenged he must meet all qualifications. The law states that if he is challenged and he signs the oath he is entitled to vote. Then the City has the duty of finding out whether he voted legally or illegally. Commissioner Tarpley: What about those people who are regis- tered but they live outside of the City? City Attorney Walden: If he is registered to vote then you must let him vote, but the election officials have a right to challenge him, because that is one of the grounds of his qualifications, that he must be a Dania resident. If, after he is challenged, the voter signs the oath and says that he is a resident of Dania and fully qualified, then you have to let him vote. From the audience: Some of these people on the West Side have been registered for years but they tell me they did not receive } their letter, and that they were dropped from the rolls. City Attorney Walden: If you will bring me a list of names of those people who say they were dropped from the rolls we will check into it. 1; Commissioner Grammer: Can a person,register to vote in Dania and give a business address as his residence? City Attorney Walden: No, if he does not live in Dania he cannot vote in Dania. Mayor Hill: It says that at 7:00 the doors to the polls shall be closed. Does that mean the actual doors shall be closed? What if there is a line of people out in front waiting to vote? How do you determine where you cut that line off? City Attorney Walden: The deputk should stand at the end of the line at 7:00. From the audience: Isn't there a law that says that no one shall go into the voting booth and help a person vote.unless that person :`. voting is blind or disabled in some way? City Attorney Walden: Any elector in any election may request assistance of two inspectors of his choice, or some other person of his own choice, to assist him in operating the voting machine. Mary Thornhill, City Clerk: I had a call from Helen LaBree. She can't work on the board Tuesday.. We have three alternates in the . South Precinct. I would like to know which one you would like me to call. Mayor Hill: The first name on the list. Mary Thornhill: That would be Wilma Gudzowski.
