The City Commission of the City of Dania, Florida, met in Regular Session in the CommissioniRoom at the City Hall. • Present were: MAYOR-COMMISSIONER VERA L. HILL COtWISSIONERS ROBERT L. GRAMMER VIRGIL L. TARPLEY JOSEPH D. THORNTON S. ELLIS YOUNG • CITY ATTORNEY CLARKE WALDEN CITY MANAGER LESTER E. CULVERSON CHIEF OF POLICE MONTIE F. SMITH BUILDING INSPECTOR CHARLES LINDEMAN CITY CLERK MARY THORNHILL The meeting was called to order at '8:00 P.M. by Mayor Hill, after which Pledge of Allegiance to the flag and invocation was held. 1. Minutes of meetings held September 8 and September 14, . 1964. • A motion was made by Commissioner Tarpley that the minutes be adopted. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: : Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes 2. Ordinance: Concerning the width of driveways in C-1 Zoning. (Third Reading) AN ORDINANCE amending a part of Section 28,590 Code of Ordinances, City of Dania, Florida, by amending the fifth un-numbered paragraph, second page, so that the same after the amendment shall read as follows: • Such Gas stations must not be greater in, size than fifteen percent of the over-all lot area, 'and must have access and egress from public street or streets and travelways not greater 'than thirty-two feet width >; and such travelways must be separated from each other by not less than twenty-five feet. A motion was made by Commissioner Tarpley that the ordinance be passed on third and final reading. The motion was seconded by Commissioner Young, and the roll being called the Commissioners s. voted as follows: Grammer Yes Tarpley Yes t, Thornton Yes Young Yes Hill Yes 3. Ordinance: Concerning a Pension Plan for City Employees. -t" (Second Reading) hi _1_ ® AN ORDINANCE establishing and adopting an actuarially sound Retirement and Pension Plan for all employees of the City of Dania, Florida; and repealing all or- dinances or parts of ordinances in conflict herewith; and providing that this ordinance shall be in force and effect immediately upon its final passage and • adoption. A motion was made by Commissioner Tarpley to pass the ordinance on Second Reading. The motion was seconded by Commissioner Young. City Manager Culverson: Before this ordinance goes np for final • reading I would like to get together with Mr. Wall and go over the fine points of this plan. The roll being called, the Commissioners 'voted as follows: Grammer Yes • Tarpley Yes Thornton Yes Young Yes Hill Yes 4. Hearing for Objections to the Assessment List covering the • following Local Improvements. Improvement No. 3-63, being the construction of sidewalks on SW First Avenue; from SW, First Street to SW Second Street. • Improvement No. 4-63, being the paving of an `alley between SE Park Street and SE First Street from SE Second Avenue to SE Third Avenue. Improvement No. 5063, being the construction of sidewalks on SW Fourth Street, :from Federal High- • way way to SW Second Avenue, . also paving street from existing paving .to curb'. Mayor Hill called for objections. NO OBJECTIONS. 5. Resolution approving and confirming the Assessment List • covering Local Improvements No. 3-63, 4-63, and �5-63. A motion was made by Commissioner: Young to adopt the resolution. The motion was seconded by Commissioner. Tarpley. Commissioner Thornton: How did they handle that tree that was • removed from private property on SW First Avenue? Was that assessed to all the property owners? Commissioner Grammer: It wasn't assessed to anyone, was it? r: City Manager Culverson: No, the City paid for it. r. City Clerk Mary Thornhill: It has been paid for out of the assessment fund, but it was not assessed to the property owner. I don't know that there was a dedision made on assessment to the property owner. This is just for the actual cost of the construc- . tion of the sidewalk plus 10% engineering. • Commissioner Thornton: There should be some adjustment on that tree being taken off of private property. That should be charged to the property owners concerned.— L:... . . -2- Commissioner Grammar: It will be hard to assess someone for taking out their own tree. It was for the benefit of the City to take the tree out to protect the sidewalk. Application for beer and wine license for Fruto David Perez and Jose Maldonado, 317 NW 5th Avenue. (First Reading) A motion was made by Commissioner Young to approve the application on first reading. The motion was seconded by Commissioner Tarpley, • and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes. Young Yes • Hill Yes Attorney Walden: This is in regards to the Marinearium at the beach. Under the charter you have to approve such leases by an ordinance which must be adopted in three regular and successive meetings. You adopted the ordinance on first reading, I believe, • on September 21st. Tonight will be the second regular successive meeting where you can approve it. I noticed it is not..on the agenda, and Mr. Weston asked me about it. There is some possibility that the Public Right-of-way runs across a part of this area. I asked Mr. Berry, the surveyor, about a • week ago to prepare a sketch of' that survey letting us know whether there was any encroachment on the proposed site. You also have a 1952 agreement with Hollywood, Inc. , that pertains to this right-of-way. We don't have the report now, but so as not to delay Mr. Weston's client, I suggestvyou pass this ordinance on • second reading tonight. Then between now and the third reading, which will come up on October 19, we ought to have the benefit of Mr. Berry's report that shows where the right-of-way is. He is checking on, both sites. A motion was made by Commissioner Young to pass the ordinance on • second reading. Correspondence: None. • 8. City Manager's Report: (1) You asked me to report back to you about the water condition on Dixie Highway. The Building Inspector, the Engineer and I made a number of trips there. In front of that one motel, the only answer that we can come to is to put in a catch basin. We are going to put a 3 inch pipe across the road to our 10 foot right. of-way and drain the water over there. s We know that this is only temporary because eventually Dixie Cross-over is going to be fixed. But this is the only possible way that we can see to alleviate some of this water condition. I have already instructed Mr. Peters to prepart for it this week and get the pipe laid this week. The estimated cost will O run approximately $330.00. Commissioner Thornton: Before you cut a hole across the road and put a pipe under the road I would like to see some eleva- tions run on it. I can't see spending all that money when you don't even know whether it will drain or not. O Commissioner Grammer: Itll go along with your idea to see if it will drain, but I don't think that we%should hold it up until next meeting. A motion was made by Commissioner Thornton to put in the catch • basin and the drain pipe provided the elevations show that it will drain. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes • Thornton Yes Young Yes Hill Yes (2) City Manager Culverson: I would like to ask the City Com- mission to pass a resolution requesting the State fix the road O near the Hollywood-Fort Lauderdale Airport. That road is in very bad shape and we are getting complaints. I have-written to them and asked them to fix it up; and they have done nothing' about it. A motion was made by Commissioner Thornton that a resolution be • drawn and passed and sent to the State Road Department to repair Old Dixie Highway. The motion was seconded by Commissioner Young, and the roll being called,. the Commissioners voted as follows: Grammer Yes Tarpley Yes O Thornton Yes Young Yes Hill Yes Carl Scillia, 40 SW 4th Street: During our cleaning up after • Hurricane Cleo, cettain equipment owned by one of our Commission- ers had been rented to the City, which is in violation of our City Charter, Section 6, Page 29. Which distinctly states "It shall be unlawful for any Commissioner to directly or indirectly contract with any association, partnership, firm or corporation in which he is financially interested, or the doing of any work or furnishing of any material to or for the City of Dania." City Manager Culverson: This pertains to me, not the Commission. It is not their fault, it is the City Manager's fault. During the hurricane clean up you couldn't get any equipment. I • went to Johnny Sessa and begged him to take some of his equipment out of Fort Lauderdale, which he was kind enough to do. I also went to one of the Commissioners and asked him if he had a front end loader to get in the alleys that the big ones couldn't get in. He said yes. So I hired him at the prevailing rate. All of the cities around here had all their equipment contracted for. I wanted to get the city cleaned up, and 'I think I have done it. So I bent the Charter a little bit, and I bent it knowingly. r -4- ® QW1 Scillia: Why wasn't I called? I have an equipment yard. The Commissioners know I am in the business. I've got front end loaders , dozers, drag lines , any piece you want I've got it. I wasn't called. 0 City Manager Culverson: Don't blame them. Blame me. Carl Scillia: But you are still in violation. You as City Man- ager should know the Charter. City Manager Culverson: I know it well. I also know,' incidently, that same mower was rented by Bob Houston and some of the Commis- sioners sitting right here, only they put it down in a different name. At least I put it down in the right name. They rented it and put it in his brothers name. I'm not trying to pall any sub- terfuge. I put it in the right name. Commissioner Grammer: Yes, we have violated the Charter, and every Commissioner who has ever sat up here has violated the Charter in some way, shape or form. You say why didn't we hire you? You never even came to a Commission meeting until you quali- fied downstairs. So now you are trying to get up and get a little publicity for yourself. Let's face facts, you never thought of the City whether we rented this or rented that until you qualified. You are trying to make a political football out of this, and we are not running a political football game. Carl Scillia: I am not trying to make a political football out of this. What happened before is none of my business. I am speaking of now. I am a tax payer of the City of Dania, and I want to know where this money goes. City Manager Culverson: You get full value received, the same as anyone else. I was lucky to get the equipment, and I will say this , under the same circumstances if there was another hurricane and I couldn't get any other piece of equipment I think I would go back to him and ask him the same thing again. Mr. Scillia: My theory is this. . .we have a-Charter, let's live up to it. Commissioner Young: Let me ask you a question, Mr. Scillia. Are you acquainted with the emergency provision that the Commission and the City Manager has? There is an emergency provision in the Charter. And during the case of an emergency the City is deligated to protect the citizens. In the first place we .had a health hazard. In the second place we had a fire hazard. We had .statements from the Fire Chief stating that he was fearful that there would. be a bad fire starting up from the rubble piles. Our City, incidently, was the first city around here that had the hurricane trash picked up and disposed of. A motion was made by Commissioner Grammer that the City Manager acted on his best judgement and the Commissioner should be congra- tulatad for bringing the equipment to the City to help out, and just forget about the matter. The motion was seconded by Commis- sioner Young/ Commissioner Thornton: I want to say one thing. This gentleman in the back said that this happened two months ' ago.. It was not two months ago, it wasn't even a month ago. It was last week. And it wasn't Johnny Sessa's equipment. Commissioner Grammer: Well we know it wasti;!t Johnny Sessa's equipment because he said a Commissioner, • and Johnny Sessa is not a Commissioner. t Commissioner Tarpley: I want to say something. . .I am the Commis- sioner they are talking about. And I want to say this. . .they have rented this piece of equipment off me for the past four years. And there hasn't been a word said about it wittl now. Just because Mr. Scillia is running for City Commission this year and he found out about it, he is making a political football out of it. • Mayor Hill: I want to say something. After the hurricane the City Manager also asked me if I knew anyone or any place where he could get equipment to help clean up this town. At that time the only equipment I knew anything about belonged to my brother- in-law, but I knew it was busy. So I told the City Manager to do • the best he could to get the City cleaned up on account of accident hazards and fire hazards. I think he did an excellent job, and I will stand behind him all the way for what he has done in trying to get this town cleaned up. Now I will have no more discussion on this question,::and I will call for the vote. • The roll being called, the Commissioners voted as follows: y Grammer Yes Tarpley Pass Thornton Pass Young Yes • Hill Yes Mayor Hill: 'jIf I am not mistaken, we have a few vacancies or are anticipating a few vacancies in the North Precinct. I would like to present the following names to go in as alternates on the Elec- tion Board to fill in the vacancies that might occur in. the North • Precinct: Mrs. Virginia Ingold, 813 N.W. 6th Avenue Mrs. Nancy Phillips , 826 N.W. 6th Avenue Mrs. Harry Hillard, 335 N.E.. 3rd Avenue • A motion was made by Commissioner Thornton to have these names placed on the list. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes • Thornton Yes Young Yes Hill Yes Mayor Hill read two letters as follows: • �� Mayor, City of Dania, Dania, Florida: I am a businessman,: located at; 17 N. Federal Highway. I have been in the antique business in the City for 12 , months. During this hurricane,' Cleo, I was really sca- red the windows would be blown in; and thought of noth- ing else than that I would be looted and robbed. I now wish to commend Chief Montia Smith and his men for the way he and his men were out here at the peak of the hurricane watching for looting and protecting the stores. It certainly makes one feel good to know he is • operating in a City with an excellent bunch of men watch- ing out for people and property. Your policing of the City, especially the shopping center and the parking area, should not go un-noticed.
