HELD SEPTE4BER 28, 1964.
The City Commission of the City of Dania, Florida, met in Special
Session in the Commission Room at the City Hall.

The meeting was called to order at 8:00 P.M. by Mayor Hill.
1. Ordinance: Amending Utility Tax Ordinance No. 187.
(Third Reading)
AN ORDINANCE AMENDING SECTION 8 OF ORDINANCE NO. 187, OF
CITY OF DANIA, FLORIDA, WHICH SAID ORDINANCE NO. 187 CON-
CERNS GENERALLY THE LEVYING OF A TAX ON PURCHASE OF ELECT
TRICITY, METERED AND BOTTLED GAS, (NATURAL, LIQUIFIED PEA
TROLEUM GAS OR MANUFACTURED), WATER SERVICE, LOCAL TELE-
PHONE SERVICE AND TELEGRAPH SERVICE WITHIN THE CORPORATE
LIMITS OF THE CITY OF DANIA FLORIDA BY REPEALING THE
EXISTING SECTION 8 IN SAID ORDINANCE, WHICH SAID NEW' SEC-
TION 8,AUTHORIZES THE CITY TO APPROPRIATE THE TAXES WHICH
ARE THE SUBJECT OF SUCH ORDINANCE ROR THE PURPOSE OF DE-
FRAYING THE GENERAL OPERATING EXPENSES OF THE CITY OF DANIA
FLORIDA; AND PROVIDING THAT ALL OTHER PROVISIONS OF SAID
ORDINANCE NO. 187 SHALL REMAIN IN FULL FORCE AND EFFECT;
AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN
OONFLICT .HEREWITH ARE REPEALED TO THE EXTENT OF SUCH CON-
FLICT; AND PROVIDING FOR AN EFFECTIVE DATE
A motion was made by Commissioner Tarpley that the Ordinance be
passed on third and final reading. The motion was seconded by
Commissioner Young, and the roll being called, the Commissioners
voted as follows:

A motion was made by Commissioner Tarpley that a resolution .be
drawn and passed accepting the list of Election Officials. The
motion was seconded by Commissioner Grammer, and the roll being
called, the Commissioners voted as follows:

A motion was made by Commissioner Tarpley to authorize the City
Clerk to have the ballot printed up as is, subject to the opinion
of the City Attorney as to what to do about Mr. John H. Frost.
The motion was seconded by Commissioner Thornton, and the roll

3. Resolution rescinding an Agreement with the B . J. Van Ingen
Company dated June 10, 1958.
A RESOLUTION RESCINDING AN AGREEMENT DATED JUNE 10, 1958,
BETWEEN B. J. VAN INGEN & COMPANY, INC. , AND CITY OF DANIA
FLORIDA: AND REPEALING ALL RESOLUTIONS OR PARTS OF RESOLU-
TIONS IN CONFLICT HEREWITH; AND PROVIDING THAT THIS RESO-
LUTION SHALL BECOME EFFECTIVE UPON THE DATE OF ITS PASSAGE
AND ADOPTION.
A motion was made by Commissioner Young to adopt and pass the re-
solution. The motion was seconded by Commissioner Grammer, and
the roll being called, the Commissioners voted as follows:

• 4. PUBLIC HEARING: Concerning the construction of a sanitary
sewer system and the proposed schedule of rates, fees and
other charges.
PUBLIC NOTICE is hereby given of the proposal of the
City of Dania, Broward County, Florida, to construct,
• maintain, equip, repair and operate a municipal sani-
tary sewer system, including a sewage disposal plant,
and pursuant to section 184.09 of Florida Statutes ,
in rates , fees and other charges for the use of and the
sorvices and facilities furnished or toxbW.ifurnished
by said system.•
The owners, tenants or occupants of property served or
to be served by said system and all others interested
shall have an opportunity to appear„ before the City
Commission of said City at 8:00 o'clock P.M. on Monday,
the 28th day of September, 1964, at the City Hall in
said City to be heard concerning said proposed schedule
• of rates, fees and charges.
Mayor Hill called for objections .
John Justice, 943 S. Federal Highway: The $3.50,for Mobile Homes ,
• does that include those Mobile Homes that don't have baths?
Mr. Philpott: When we proposed this rate schedule it was on the
presumption that any Mobile Home which contained sanitary facili-
ties would be charged, but no Mobile Home completely with sanitary
facilities would be charged. They will be charged on the basis of
• each unit of whatever sanitary facilities they use.
Carl Scillia, 40 S. W. 4th Street: I keep hearing about sewers,
but I don't hear about what it is- going to cost. Is there some-
thing that shows what the sewer system will cost?
• Commissioner Grammer: We had an open meeting about three weeks ago.
At that time it was decided that the cheapest way to go would be the
square foot basis. The engineers decided on 4-172 cents per square
foot.
John Boehm, 251 South Federal Highway: . How much, is the overall
• figure for the sewers?
Commissioner Thornton: For example, if you have a 135 foot lot by
55 feet wide, if they assess you at 4-1 cents it will cost you
$348.75 for that line to go in front of your house, based on the
anticipated cost for the sewers and the sewage treatment plant.
• Mr. Tanner, Sunshine Villas: I have never gotten anything for nothing
and I don't think any of the ras.ttof you have either. I believe then
Commission will handle this as economically as possible. I also
believe that you are making. a mountain out of a molehill in talking
about your current expense. Did you realize that immediately upon
the sewers becoming available that the valuation of your property
will be enhanced? That will counter-balance that expense.
Mr. Sinclair: I would like to know what is the cost of the Engineering
Fee?
Mr. Philpott: The total engineering, except for land surveying, is
5%, of the actual cost of construction.
Mr. Henann, representing Barcus , Kindred & Co. : . These points of
issue are all very well taken as generalppoints , but they are not
relevant to the point of issue now, which is that this is actually
a public hearing on rates and the rate schedule which was set forth. .

® The rate schedule which was read, and which was published, is a
typical rate for Broward County Municipalities. Actually, there
are two municipalities which have lower charges , and there are
two or three that have higher charges, and the balance of the
municipalities have rates that are approximately the same.
• Mr. Houston: Non-residential is going to be charged 100% of their
water bill. What about vacant stores?
Mr. Philpott: My recommendation, in a case of this kind, would be
if the water meter is disconnected and there is no water service
to the property, since the sewer bill and the water bill are com-
bined in one bill, that there would be neither a sewer nor a water
bill. Of course, when they get re-connected, they will be connec-
ted to the water meter and the sewer system. .
Mr. Davis: I want to know if this covers colored town and Male-
llucca Gardens.

Mayor Hill: No air.
William McAllister, Hotel Poincianna: I want to know on what
basis did Mr. Philpott arrive at these figures for a hotel?
• Mr. Philpott: These figures for apartments, hotels, and motels
merely represent our recommendation as a fair distribution of the
total requirement, as a basic rate.
Mr. O'Connor, 221 S.E. 2nd Terrace: There is one .thing I don't
understand. Now the time has come when we are going to have to
• have sewage. I am all for it. If you don't want to use the sewers
you don't have to hook up to it, you can still have your cesspools
and your septic tanks if you want to. But I am for sewers. I don't
care what it costs. The sooner you get them in, the better ft is
going to be for Dania. We are here to establish rates in order to
get 'the ball rolling. All this other stuff can be ironed out some
• other time.
William McAllister: Should hotels and motels be classified as
businesses, or should they come under the residential rate?
City Manager Culverson: I think the gentleman has a very good
• point. If the Commission would go for it. I consulted with the
Engineer and Mr. Henann, and they assure me that we could still
meet our requirements as far as principal, interest and maintenance
if we class motels and hotels as businesses and charge them 100% of
their water bill. So this is my recommendation.
• Commissioner Grammer: We can net here all night and go over this
and we're not going to please everyone. I haven't heard anyone
complain about gas stations. About 90 percent of their water goes
out on the ground. But I haven't heard them complain at all. If
you want to get right down to everything that is fair, it certainly
is not fair to them if they are going to have to pay double their
water bill. We have to get this sewer going, or we will be talking
about it another 10 years.
City Attorney Walden read a revised resolution entitled:
A RESOLUTION finally adopting and fixing after Public
• Hearing a schedule of ratestand charges for services
of municipal sewer system, City of Dania, Florida.
BE IT RESOLVED by the City Commission, City of Dania,
Florida, that after a Public Hearing held in accordance
with Chapter 184.09, Florida Statutes, for sanitary sewer
• services in the City of Dania,' Florida. The schedule or
monthly rates, fees and charges shall be as follows:

Single family residences: $3.50 per month for
2 bathrooms or 2 water closets, plus $ .50 per
month for each additional bathroom or water closet.
Each unit or duplex: $3.50 per month
Each apartment unit: $3.50 per monthh
Each mobile home: $3.50 per month
Hotels, Motels, Boarding and Rooming Houses:
100% of water bill.
Non-residential: 100% of water bill.
A motion was made by Commissioner 1toung to adopt and pass the
resolution as read. The motion was seconded by Commissioner

5. Resolution authorizing Application for Federal Financial
Assistance under the Federal Disaster Act.

A RESOLUTION of the City Commission of the City of
Dania, Florida, authorizing Vera L. Hill as Mayor-
Commissioner of City of Dania, Florida, to execute
for and on behalf of City of Dania, Florida, an
application for the purpose of obtaining certain
Federal Financial Assistance under the Federal Dis-
aster Act (Public Law 875, 81st Congress; 42 U.S.C.
1855-1855g); and repealing all resolutions or parts
of resolutions in conflict herewith; and providing
that this resolution shall become effective upon the
date of its passage and adoption.
A motion was made by Commissioner Young to adopt and pass the
resolution. The motion was seconded by Commissioner Grammer,
and the roll being called, the Commissioners voted as follows:

6. Resolution authorizing the issuance of $2,250,000 Sewer
Revenue Bonds.
A RESOLUTION ordering construction of a. sanitary sewer
system in and for the City of Dania, Broward County,
Florida, providing for the issuance of $2,250,000 sewer
revenue bonds of said City 'f6r the purpose of paying the
cost thereof, providing for the sale, seourity 'and pay-
ment thereof from sewer revenues, . special assessments,
utilities service and cigarette taxes, making certain
govenants and agreements in that connection and fixing
an initial schedule of sewer rates, fees and charges.

A Commissioner Grammer: I have 2 petitions for streets. One SW 2nd
Terrace, and one SW 7th Terrace. You already have plans for SW
2nd Terrace, and we will have the engineers draw up plans for SW
7th Terrace.
A motion was made by Commissioner Grammer to advertise for a public
• hearing on SW 7th Terrace and SW 2nd Terrace for October 19, 1964,
at 8:15 P.M. The motion was seconded by Commissioner Young, and
the roll being called, the commissioners voted as follows:

Commissioner Tarpley: We have to either approve these alcoholic
• beverage licenses tonight or call a special meeting.

A motion was made by Commissioner Tarpley to approve the beverage
license renewals. The motion was seconded by Commissioner Young,
and the roll being called, the Commissioners voted as follows:

Commissioner Young: As the Commissioners know, we received $25,000
cashiers check which was posted as security by Barcus, Kindred & Co. ,
As chairman of the finance committee, I thought it would be a good
idea to have the City Attorney put it on a time deposit at the bank
for a period of 90 days. That way we could be collecting interest.
Mr. Henann: I dontt think you can do that. It is supposed to be
held uncashed. But I will check with our attorney. .
Commissioner Young: We also have a bond, number 7285, which expired
last May. I would like to recomm0dd that we cash this bond and re-
invest it.
A motion was made by Commissioner Young to cash bond number 7285 and
re-invest it. The motion was seconded by Commissioner Tarpley, and
the roll being called, the commissioners voted asfollows:

• Commissioner Young: .I have one more thing to bring up. A reporter
stopped me at City Hall the other day and showed me a newspaper item
that said that the City of Dania is broke. They have no money at
all. I would like the good citizens of Dania to know that at closing
time September 25, the unencumbered General ,Fund cash balance was
$569742.97. I don't know how or why these false statements get

around. But I want the people to know that it is not true.
City Manager Culverson read a letter as follows:
" Gentlemen:
• Re: Tag Days - National Children's Cardiac Hospital
January 22nd, 23rd, and 24th, 1964
We are planning our annual fund-raising campaign on the
above days. It would be appreciated if you would issue
• a permit to the Hospital to ,solicit in your area during
that period of time.
As you know, our Hospital is a non-profit organization
dedicated to the care of children suffering from heart
disease. We are on the verge� of expanding our services-
and the needs for those who cannot afford to pay are
• many. We are sure that those in your community will
benefit from our institution and that they will want to
be a part of our annual Tag Days.
