Vice Mayor Grammer: This meeting was called for the purpose of
hearing Attorney Walden's ruling as to the legality of the Sewer
Proposal agreement from Mr. Harvey Henann of Barcus, Kindred & Co.
I'
is Attorney Walden: I think it is legal. Mr. Culverson has a letter
to read.
City Manager Culverson:
" Gentlemen:
At a Special Meeting of the City Commission held on August
26, 1964, a motion was made that a resolution be drawn and
passed accepting the proposal of Barcus , Kindred & Company,
concerning financing of Sanitary Sewers , subject only to
my approval as to its legality. The motion was seconded "and
passed.
I have met with Mr. Henann of Barcus , Kindred & Co. and with
Mr. Culverson today and I have briefly discussed the proposal
with them.
In my opinion, it is a legal act for the City of Dania to
accept!-the proposal. I suggest that you authorize a formal
and written resolution at your meeting of August 31, 1964,
to authorize the proper officials of the City to sign what-
ever documents are necessary incidental to the proposal.
/s/ Clarke Walden. It
A motion was made by Commissioner Tarpley that a resolution be
drawn and passed accepting the proposal of Barcus, Kindred & Co. ,
and to authorize the proper officials of the City to sign whatever
documents are necessary incidental to the proposal. The motion
was seconded by Commissioner Young, and the roll being called, the
Commissioners voted -as follows:
Tarpley Yes
Thornton Yes
i' - Young Yes
Grammer Yes
Commissioner Tarpley: There is one other thing. Mr. Freeman of
Port Laudania requests that the City of Dania send him a letter
ss stating that they are ready to supply them water.
k`
Commissioner Grammes Mr. Culverson, didn't you say that he is
willing to run the lines?
City Manager Culverson: We will run the line to this side of the
canal, then he will pick up the line and take it under the canal
and over to the other side. They will supply their own meters and
_ lay the line free of charge. They will be outside of the City Limits,
so they will be subject to a 25 percent surcharge.
s«
City Manager Culversons I will request that Mr. Freeman present
his plans to the Commission before we supply him with water.
Commissioner Grammars It is agreeable with the four Commissioners
here that we will supply them with the water, so you can go ahead
and write the letter.
There being 'no further business on the agenda, the meeting adjourned.
