The City Commission of the City of Dania , Florida, met in Regular. Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER VERA L. Minutes of meeting held July 20, 1964, to be approved. A motion was made by Commissioner Young that the minutes be adopt- ed as read. The motion was seconded by. Ordinance: Accepting the plat of Florian Isles 3rd Addition. (Second Reading) AN ORDINANCE accepting and approving for record the plat of FLORIAN ISLE THIRD ADDMON, covering lands situate in Dania, . Broward County, Florida, including all alleys and streets shown on said plat of FLORIAN ISLE THIRD ADDITION; and abandoning and voiding all streets and alleys as to said land existing prior to the acceptance and approval of said plat; and providing that all ordinances or parts • of ordinances in conflict herewith be repealed to the extent of such conflict; and providing that this ordinance shall become effective as of its passage and adoption on third reading. (First Reading) Attorney Walden: Chief Smith asked me about a ,possible conflict between the State law and our City Ordinances. I. suggest you goat, ahead and pass it on first reading, and .let me write to the Attorney General for an advisory opinion. Whether our ordinance is superceded or not--I don't know. A motion was made by Commissioner. Tarpley to pass this applica; tion on first reading. A motion was made by Commissioner Young to pas' this ordinance on second reading with one change---that they will allow no City Official to be a member of the 'Fblice Reserve, for example, the City Manager, City Commissioner, or the Judge. You don't know how proud we are to present this to you, George. _<You are • really an inspiration to all the young people, and all us older people, too. Ever since the Fourth of July,;:.Dania has been just bursting with pride over you, and it is my honor to present you., with this plaque. We are real proud of you. We congratulate you. A motion was made by Commissioner Young to adopt the resolution and to authorize the City Manager to advertise for a public hearing for August 17, 1964, at 8:00 P.M. Gentlemen: It is requested that permission be granted for a permanent license to hold an Auction throughout the year by paying the initial $25.00 fee and $10.00 for each additional day. The dates to be determined at a later date and the $10.00 per day to be paid for the dates to be determined. Mr. Linwood Cabot here represents the majority of them. Mr. Cabot called me and asked if he might appear before the Commission tonight. Mr. Cabot: I represent a large portion of those owners of the land north of Dania, and east of Federal Highway. The owners of the property which you seek to annex by an ordinance that you recently adopted;inra race with Hollywood to see who could annex it first. My only purpose in being here tonight is simply to advise to you our view on your purported move, and to "suggest an avenue of approachment that I think might be of some value to all of us. As you are no doubt aware, the City of Hollywood adopted a .similar ordinance on the same day, or perhaps the day before the date of the adoption of your ordinance. They passed it on two readings, which I think is a pre-requisite of the City of Hollywood; and I understand that you adopted the ordinance on three readings, which is the requirement of your charter. So that we have, as owners of the property, the cities contending for the annexation of our prop- erty within their corporate limits. It is somewhat of a mystery to us as to what municipal benefits either of you can furnish us. My real purpose in being here tonight is simply that, prior to the thirty days that expires before we are required to file some court action (which I am authorized to file as ,6f this moment) , I suggest to you that it would perhaps be of some benefit if the City of Dania and the City of Hollywood met in some informal or formal session (which we would Like to attend if we are invited) to die-i,_. cuss the contemplated annexation. I am certain that you don't ' look to me for your legal advice, you certainly have a good com- petent lawyer, Mr. Walden. But I would say to you that the basis -4- • ® upon which we would contend the adoption is a rather simple one, and one which I think is well founded, and this is that you can furnish us no municipal benefits, and there are none available to us in the reasonably foreseeable future. If you are familiar with the land, it is a swamp land with Mangrove swamps at six or eight feet below the elevation of Federal. Highway. It is A not inhabited, .we don't need police protection, we don't need fire protection any more now than we did twenty-five years ago. And we feel that our chances of being successful in opposing this in court are, we think, ninety=nine to one. You may dis- agree, but, if you feel that there is some merit to what I am saying, then we feel that it might be advantageous to all of us to at least sit down with Hollywood and see if some course of action can be taken that at least won't put you in the position of Hollywood having usurped an area which you feel rightly, in the proper term, might belong to Dania. I 'm not coming here in an attitude of threatening court suit, because I could have gone to the County Court House without coming here tonight. Bdt I i am simply saying that.,. .in my opinion (which you certainly don't have to rely upon), neither Dania nor Hollywood can successfully withstand a suit objecting to this attempt of annexation. If I am accurate '.in that assumption, then it might be to the advantage of all of us if some course of action were taken which would not put you in the position of having Hollywood contending to an area which you feel is rightfully Dania's at the appropriate time. And it is in the spirit of genuine co-operation that I am suggesting tonight that this commission authorize the City Manager or an appropriate committee to meet with Hollywood if they are so inclined. Commissioner Thornton: Madam Mayor, before we go on with that, I think we had better call for the closing of those bids. Mayor Hill: We would like to interrupt you Mr. Cabot, for just a minute. Are there any more bids from the audience? Any more street paving bids? 7. Bids: Street Paving - 8:30 P.M. A motion was made by Commissioner Tarpley that the bids be closed. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners .'voted as follows: Grammer Yes Tarpley Yes Thornton .Yes' Young Yes Hill Yes Mayor Hill: You may continue now, Mr. Cabot. Mr. Cabot: I have no other comments, other than to say that I think it would be a healthy thing on your part if you would appoint a committee for that purpose. It might lead to some good. If you don't, I would appreciate an expression; from you that, you don't agree. In which case I won't bother to contact Hollywood. And I might say without a veil of a threat, I am going to' go to the court house and see what will happen. City Manager Culverson: Mr. Walden, is this the 3ist of what Mr. Freeland had to say the other day? Attorney Walden: Yes. Mr. Cabot represents the property owners in the northern area of this part,that' we have under consideration. Mr. Freeland, who asked me to name the City Manager. to ask about the law in this thing, is the Lau-Dania man. I think what the owners feel is that if they file suit against either city, and they have the right under the annexation statutes to do it, that the city will be stuck until the court can rule on it. I think what they are -5- • suggesting is that both towns back off, and that the towns agree with each other to do this. Mr. Cabot: Of course, I would welcome that sort of a move, but that is entirely up to you. I feel personally that, had not Hollywood jumped the gun, maybe I am wrong in making this assump- tion, but perhaps Dania would not have. And I think the chances . of Hollywood being successful in annexing this land are about the same as Fort Lauderdale trying to annex part of Okeechobee, I don't think they can do it. But I will tell'_.you one thing, if they do it, they better ask the Supreme Court if it is alright. I don't ask that you interrupt your proceedings at all, because I don't want you to have a disadvantage over Hollywood, I am dust saying that now before the thirty days expires , I would think that it would be a healthy thing if you would get together with Hollywood and see what their attitude is. ' Perhaps they won't back off. But I think it is safe for you to assume that, if within thirty days something like that hasn't happened, I am + going to file a suit and object to both attempts to annex. Maybe I am going to lose, but I am not going to lose with both of you. I will only lose with one of you. Both of you can't annex. Or perhaps you can reach a compromise. There is one area down .there that I don't believe they object to the annex. But not annexed to Hollywood. 0 Mayor Hills Well, it won't do any harm in meeting with them. Commissioner Marpley: Well, we don't want to leave ourselves open. The way it sounds now, I think we have an equal chance with Hollywood, if not more. That's .the way I feel about it. 0 Mr. Cabot: I'll go a little bit further and say that in my per- sonal opinion, you have certainly a better chance than Hollywood does. But to me, when both of you are contending for our annex- ation, it doesnft require too great ari analysis to say that one of yoyris .noirgoing to be sucdessful. And I will go a little j farther and say that. 1 don't think either one of you should be. But you can make that decision on your own. Commissioner Tarpley: Personally, I don't either. Mr. Cabot: I don't see any municipal benefit that Dania can give down there or either. They weren't needed or available 15 years • ago, And it is the same Mangrove swamp. . There are a few more nurseries, but you are not furnishing anything to them now, and I don't think they need anything. And to tax them for it, I think the courts will say that you are going to .have to 'gve them some municipal benefits. If there are some available in the reasonably foreseeable future, I don't see it. So if that is true, then I think that the logical minds in the City of Dania ought to come to the conclusion that you should back off of this, so that you are not stepping on their toes, nor they on yours. And we will get what we want, which is to be left alonLq., Commissioner Grammer: I would like to ask our Attorney now, if we did back off from this and Hollywood backed off, is there anything to stop us from changing our ordinance taking in certain portions of that land? Will we have to wait a certain length of time before we can file another ordinance? Commissioner Young: You mean an amendment. Attorney Walden: You will have to start over again with a new ordinance. Commissioner Grammer: We 'could do that right away? • is • c„ -6- • Attorney Walden: I think so---Yes. This contemplates tn�a ordin- andes. One is the one that you adopted a week or so ago, which merely expresses your intention; and which provides that the pro- perty owners have got thirty days to sue the city if they don't a ee. And after the thirty days have passed, if no suit has been filed, we draw up the second ordinance which would actually annex O them. Commissioner Grammer: I suggest that our City Manager and our City Attorney get together with Hollywood!s City Manager and City Attorney. I think they would get more satisfaction that if all the Commission would meet. 1 Commissioner Thornton: Well, they would still have to meet sooner or later. Attorney Walden: I think there should be a meeting. It can be an informal one, between the two commissions. I suggest you ask Mr. O Culverson to approach the Hollywood City Manager, so' that he can set up an informal meeting between the two commissions. City Manager Culverson: He is on vacation until the 17th, Mr. Walden. • Mr. Cabot: By the 14th of August we must file a suit. . .and I am going to be out of town. I must file suit the first part of next week, unless we have some information that some different course is going to be persued. You are not bound by 'my. schedule, but I am. City Manager Culverson: I will request tomorrow for them to have • a meeting with the Hollywood City ,Commisaion and the Dania City Commission. Mayor Hill: What if it• isn't agreeable to, them? Mr. Cabot: Let me say this, Mrs. Hill, I'm going to file the suit, O and that will give you Some time to settle your differences. I can't take the chance of going beyond the thirty days. So if some sort of an agreement isn't reached by the first part of next week, I must file suit. Commissioner Thornton: Set it up for the earliest possible date. 7. Bids: Street Paving A motion was•made by Commissioner Thornton that the bids for street paving be opendd. Henry Ransburgh, representing the owners of Lots 1, 2, 3, • Block 3, St. James Park North, request for variance. Mr. Ransburgh: We have come to ask you if we can have a waiver for the Public Hearing before the`Zoning Board on this request for a variance permit. If you will recall, it has been passed • that the NE corner of 15th and North Federal Highway has been rezoned to C1, so that we can erect a ,service station on that corner. This has been heard by the Zoning Board and the City Commission, and has been passed. The citizens of Dania have had a chance to • oppose this and to be informed of what purpose we are going to pee the land. My own opinion is that I doubt if there would be very much to be gained by having two more public hearings to waive the 30 foot set-back on 15th Street. As you:,know, the C-1 ordin- ance provides that there shall be a front yard set-back of 30 feet, and a similar set-back,zif on the corner, from the street • at right angles to the street in front of the establishment. This could be interpreted two ways. One way would be that we have 30 foot set-back on three sides, another way, that we have 30 foot-*, set-back on two sides, sixteenth street and Federal Highway. If the Commission interprets this to be only a 30 foot set-back on two sides , then we would not need a variance. However, if we .• decide to interpret the 30 feet on each side, as required, then we are requesting that a variance be granted the owners of the property so that they will not have to live up to the 30 foot set-back on 15th Street, for the reason that we had 112 feet there, and if- we were held to the 30 foot set-back on 15th street, we would not have enough left, to, put the station on3it. If we could be given this variance, it would help us out very much. And if we could get a waiver of the hearing before the zoning board, for the reason that the extentioas on this property run out on August 25th, Commissioner Young: As I understand it, what you want is a vari- ance to include 14 feet of .the set-back on the North side, which would abut 15th street. And that is the only item you have in the variance. Mr. Ransburgh: Yes sir. Commissioner Young: If the Council says it would be legal, and in good taste, I think we ought to give him a public hearing for the request of variance as soon as we can. Attorney Walden: I think it is good taste , but we. will let Mr. Ransburgh worry about the legality of it. • Commissioner Grammer: Doesn't it aay in our ordinances that all variances should come before the Zoning Board? Commissioner Thornton: Let 's have a joint meeting with them. -8- t, ;• • ® A motion was made by Commissioner Young to have the City Manager write a letter to the Zoning Board requesting a joint meeting for August 24, 1964, at 8:00 P.M. , and to advertise for a Public Hearing. The motion was seconded by Commissioner Thornton, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes 11. Mr. Clarke Walden, report on request of Michael DePadro to purchase a parcel of land owned by the City of Dania. Attorney Walden: Mr. Michael DePadro has called me once or twice wanting to know the possibility of purchasing some land the City of Dania has in thirty-acre park. I believe he may have talked 0 to one or two of the Commissioners informally, so I suggested he should appear here and let you know formally what he wants to do. The parcel is immediately East of and adjacent to his yacht basin. Under our charter, before we can sell any city property, we must declare it surplus and advertise for public bids, sealed bids, on it. We must have a legal description. :^There is quite an amount of work involved, so what I suggest is that you might indicate to Mr. DePadro, without committing yourselves, that you might be willing to go through this process; and then you can get descrip- tions made up on it. A motion was made by Commissioner Thornton to table this request before taking any action at the next regular meeting of the City Commission, which will be August 17. The motion was seconded by Commissioner Young. 13. City Manager's Report: 0 City Manager Culverson read as follows: "CONDITIONAL SERVICE CONTRACT between the City of Dania, I Florida, and Callahan Motors. 1. The Callahan,Motor Company agrees for the sum of $400.00 per month, plus parts (parts price at our cost plus 10%), to service and maintain all rolling stock; such as cars, trucks, tractors, mowers, etc. Maintainance to include welding, greasing, painting, and general mechanical repairs. 2. Contract will exclude radion.work, tire work, and wreck S repairs in excess of $50.00 and manufacture. 3. Preventive maintenance will be instituted at times equipment is not in use, thus avoiding delays when equipment is needed. 4. Road service will be included to be performed during reasonable working hours. 5. Contract is subject to adjustment in the event the City of Dania expands their inventory of afore mentioned equipment to any great extent. Normal replacement or addition of equip- ment will not be termed expansion. 6. Payments will be made to Callahan Motor Company each month upon receipt of parts statement and contract bill. 7. This contract can be voided by the City of Dania at any time the city can show (beyond reasonable doubt) that the holder of this contract, Callahan Motor Company, is not per- forming the afore mentioned service according to conditions of contract. 8. Contract holder will be given two weeks notice in the event of cancellation. ,r i .`, -9- 0 A motion was made by Commissioner 'TThornton to advertise for bids for contracts on labor and parts for equipment maintenance for September 8, 1964, at 8:15 P.M. Gentlemen; In accordance with our letter to you .of July 16th, 0 we deem it our pleasure to submit the following figures for your consideration pertaining to the renewal of insurance coverage on the Dania Municipal fishing pier. Carrier: Upon receiving a firm order for Coverage the line will be placed in Lloyds of London. Coverage: All risk of physical loss or damage. 0 Face amount: $155,00Oi00 coverage, the policy contains a $10,000.00 deductible per loss. Premium: $7,500.06 for period of one year, August 7, 1964 to August 7, 1965. Should the City Commission favor our Agency with a firm order for this insurance, we will be happy to deliver 0 a binder until the policy is delivered. /s/ Ruel A. Galbreath, Jr. " " The Dania City Insurance Committee Gentlemen: 0 We, the Dania City Insurance Committee, have been ' asked by the City Manager to make a -recommendation to the el City Commission of Dania concerning the Fire, Wind and VMM insurance on the Fishing Pier. Based on the facts presented, and the substantial savings to the City of.':DAftia, we find that we must recom- mend the Walker Insurance Agency to write the policy for ". ' the Dania Fishing Pier. We were informed that the total premium for three years is $17,050.00, payable as follows: 40% or $6,820.00 the first year; 30% or $5,11.5.0O the sec- end and third year consecutively. Our insurance group feels that this is approximately • $2,000.00 cheaper than any proposal submitted, plus the fact that it. is $450.00 reduction over last year. The Walker Insurance Agency has insured the Dania Fishing Pier since the opening day with reduction in pre- mium each year, and we feel a continuation of this policy with the Walker Insurance Agency is to the beat interest to the City of Dania. /s/ Raymond Chapman, Harry Loury, Will LaBres, and Myron Wall tt:. • 0 A A motion was made by Commissioner Young- to accept the Insurance Committee's report and to award the insurance contract to Walker Insurance Agency on a three year term to be paid annually. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: • Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes • City Manager Culverson read a letter, from George Wilby as follows: "Dear Mr. Culverson: We fully realize that we are going to have to put in some hard work building up the business at the fishing pier in order to give the City a decent return on their invest- ment. Since we have been dealing with the public all our lives, we feel that with the proper promotion and publicity,,: we can pay the City more for the pier than anyone else. It is our understanding that we do not have any control or part of the restaurant and vending concessions, that we are bidding on such things connected with fishing. Under • these conditions, we would be willing to pay the City of Dania either ten per cent of our entire gross business, less sales tax or excise tax, or forty per cent of the admission receipts, less tax. If the City could consider extending the pier which would make it the greatest fishing pier on the East Coast, we would be prepared to increase our bid to • twelve and one half per cent of the gross, or fourty per cent of the admission receipts. Our lease at Pompano is based on 40% of the admission receipts and we expect to pay thirty thousand dollars provided the water clears. In our opinion, we would pay the City a great deal more in the admission scale than we would on the entire gross • basis and would be easier for the City to check, however we will be glad to work with the City either way. We would also like it to be understood that we might have free fishing days, free bait days and other exploitation methods upon advance consent of the City Manager or City Commishion. We would also like the City to consider changing the "entrance • so that the entrance to_ the pier would be through the tackle shop. O The proposition consists of a lease of City property for the installation of a Boat Launching device called the "Procter Sky Launch". The "Procter Sky Launch" will elevate passengers and boats. a given number of feet .above the beach and deposit same in a "wet slip" to be constructed 150 feet more-or- 0 less , or to the satisfaction of the City of Dania, in the Atlantic Ocean just North of the Pier. The "Procter Sky Launch" will assume all cost of Con- struption, Maintenance, Operation, and Insurance. It will also operate and maintain a suitable craft on a twenty-four hour a day basis that shall be used as the City of Dania O Coast Patrol. This Civic Service shall be compliments of the operators to the City of Dania. We firmly believe - following a survey of .approximately 20,000 small boat owners in this area - that the operation of the "Procter Sky Launch" will benefit the City of Dania in a dual sense. First, this operation will bring into the City • of Dania an estimated $25,000.00 per year revenue. Second, the City of Dania will be reknowned - through our National and International News and Advertising coverage and promo- tional experience as a Boater's Paradise. A scale model of the "Procter Sky Launch" will be pre- sent, and managing operators will demonstrate and answer O questions on the proposed Boat Launching device. /a/ Capt. Burgess V. Procter. " The Commission expressed the wish to see the scale model of the Procter Sky Launch, and asked the demonstrator to go and get the model. In the meantime, the City Commission is going on with the agenda. City Manager Culverson read as follows: We are enclosing two copies of the Preliminary Engineer report on the incinerator proposal for the City of Dania. O Your reports will be submitted to the Florida State Board of Health for the review on Monday August 3, 1964. It will be necessary to send information to the Board of Health on the incinerator site and the after disposal site when these areas are determined. Additional copies of the report are available to you if O you may request them.
