The City Commission of the City of Dania, Florida, met in Special Session in the Commission Room at the City Hall. • Present were:. MAYOR-COMMISSIONER VERA L. HILL COMMISSIONERS ROBERT L. GRAMMER VIRGIL L. TARPLEY JOSEPH D. THORNTON S. ELLIS YOUNG . CITY ATTORNEY CLARKE WALDEN • CITY MANAGER LESTER CULVERSON BUILDING INSPECTOR CHARLES LINDEMAN CHIEF OF POLICE MONTIE SMITH CITY CLERK MARY THORNHILL • The meeting was called to order at 8:00 P.M. by Mayor Hill. (1) Public Hearing: NOTICE IS HEREBY GIVEN that the City Commission, City of Dania, Florida, shall conducts, public hearing at a special meeting to be held at City • Hall, City of Dania, Florida, at 8:00 P.M. , Mon- day, June 22, 1964, for the purpose of consider- ing objections of the public to the adoption of an ordinance which if adopted, will provide for the rezoning of the following described property to wit, Lots 9 and 10, Block 43, NORTH HOLLYWOOD, according to the plat thereof recorded in Plat Book 4, page 1, of the Public Records of Broward County, Florida, said lands sit- uate, lying and being in Broward County, Florida. 0 from B-2 Classification to C-1 Classification. All persons objecting to the adoption of said ordinance should appear at the aforeesid hear- ing to present their objections. 0 City Attorney Walden: "There is an adjacent lot which fronts on Sheridan Street to the west, Lot 8, Block 43. This lot is included in the application, although we did not publish it. Mr. Favarato's property .should now read: Lots 8, 9, and 10, less the south 15 feet, Block 43, NORTH HOLLYWOOD. Mayor Hill called for objections. No objections. A motion was made by Commissioner Tarpley that an ordinance 71 be drawn and passed on first reading to rezone from B-2 to s" C-1 Classification, on the condition that Mr. Favatato give a right-of-Opy deed to the City of Dania to the east 6 feet of Lot 10. Further condition that he donate whatever land is required so that the S.E. corner of Lot 10, less the south 15 feet shall have a 25 foot radius. Mon- day, June 22, 1964, for the purpose of considering objections of the public to the adoption of an ordin- ance which, if adopted will provide for the rezoning - of the following described property, to wit: Lots l 2, and 31 Block 3, ST. JAMES PARK NORTH, according to the plat thereof recorded in Plat Book 3, page 339 of the public records of Bro- ward County, Florida, said lands situate, lying and being in Broward County, Florida. from B-2 Classification to C-1 Classification. An earlier hearing scheduled for April 20, was cancel- led. All persons objecting to the adoption of said ordin- ance should appear at the aforesaid hearing to present their objections. • A motion was made by Commissioner Thornton that an ordinance be drawn and passed on first reading rezoning the ST. JAMES PARK property, so defined, from B=2 to 0-1, on the condition that the owners dedicate the west 6 feet of the property to the City of Dania for right-of-way purposes. Further condi- tion that the owners agree to donate whatever property is required so that the radius of Lot 3, the south 28 feet at the S.W. corner, shall be 25 feet. The motion was seconded by Commissioner Young, and the roll being called, the Commis- sioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes Vacation of an alley in rear of Lots 1, 2, and 3, Block 3, ST. JAMES PARK NORTH. . A motion was made by Commissioner Thornton to get a recom- mendation from the Planing and zoning Board on July 14, and to advertise for a Public Hearing before the City Commission for July 20 at 8:15 P.M. The motion was seconded by Commis- sioner Young, and the roll being called, the Commissioners , voted as follows: Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes Variance request from Mac's Auto Repair and Service to use some property for an .auto.' scrap yard. Objections from Mrs. Cunningham and..from Alonzo Williams from the audience. They don't .want a junk yard near their homes. A motion was made by Commissioner Young that the request for variance be denied. The motion was'- seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer " Yes Tarpley Yea Thornton Yes Young Yes Hill Yes rn' -2- (2) City Manager's Report: City Manager Culverson read a letter as follows: "Dear Mrs. Hill; In order to meet certain requirements of the Federal Aviation Agency it is necessary for the Board of County Commissioners of Broward County, Florida, to obtain zoned right-of-way included on the easements over certain designated proper- ties lying within the said zone in the vicinity of Fort Lauderdale-Hollywood International Air- port Records of .Broward County indicate the City of Dania is owner of Parcel 7-S S.E. , .as fully des- cribed in tax easement. This property lies with- in the Southeastern clear zone approach area of the Southeast-Northwest runway identified on Eu- hibit A. } Will you please submit this to your honorable body, the City Commission of Dania, for approval, and then return same to this office. A carbon copy may be obtained for your records. • /s/ Broward County Commission" Mr. Culverson: "I am not familiar with this , so I would like to turn this. over to the City Attorney to report on it at the next meeting." Commissioner Thornton: "I'm very familiar with that. A year or two ago they requested that they were trying to form a Board there for Zoning. They wanted one member from Dania, two from Hollywood, .two from Fort Lauderdale, and two from Broward County, if I remember correctly. Dania would have one vote. If we went along with that deal, anything that ruled on the majority, would be binding under the City. We very flatly refused to join that deal, and submit a name for that zoning board, simply because we would be giving up our rights to zone land in the City of Dania, if we joined. I'd like to recommend right now that we turn them down flat." A motion was made by Commissioner Thornton that their re- quest be denied. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes Notice of Application for Approval of Bridge Planning: Corp of Engineers, District of Jacksonville: Application was made to the Department of the Army by the Florida State Road Department, Tallahassee, Florida, for approval to construct a fixed bridge ;� over Dania Sound at Dania Beach, Broward County, Florida. Mr. Culverson: "This is a Public Notice, .for your objections." ;. A motion was made by Commissioner Thornton to table this until the Commission has time to investigate. Part payment for construction of concrete sidewalks in the City of Dania: Y Balance Due - $1,035.02 City Manager Culversont Recommend you approve the payment of this bill. A motion was made by Commissioner Young to accept the Cit Man- ager's recommendation. The motion was seconded by Commissioner 0 Tarpley, and the roll being called, the Commissioner voted as follows: Grammer Yes Tarpley Yes Thornton Yes • Young Yea Hill Yes City Manager Culverson read a letter as follows: "Dear Mr. Culverson: Last Monday, June 17, Mr. George Lowmeyer, Sanitary Engineer for the Broward County Health Department, and I made a inspection of the vicinity which ia' proposed to construct the Dania Municipal Incinerator. Mr. Lowmeyer requested that a separate plan be sub- mitted along with a complete preliminary engineering report on the sites, capacity, and desiih of the propo-. sed incinerator. Complete evaluation of the proposed site will be a part of the report made by the Florida State Board of Health. We suggest . the members of the City Commission consid- er. authorizing a preliminary engineering-report be pre- pared for review by the Florida State Board of Health. /a/ Peter Broome it A motion was made by Commissioner Young to authorize Mr. Broome , to proceed with the preliminary engineering report. The motion' was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes . Young Yes Hill Yes A motion was made by Mayor Hill that the City Attorney be instr- ucted to prepare an ordinance rescinding the Night Club Ordinan- ce, and have it ready for first reading at the next meeting. The portion to be rescinded is Sec. 18-13. The hours for closing will be 2:00 A.M. instead of 4100 A.M. , to become effective October 1. The motion died for lack of a second.
