The City Commission of the City of Dania, Florida, met in Special Session in the Commission Room at the City Hall. • Present were: MAYOR-COMMISSIONER VERA L. HILL OOMMI9SIONERS R. L. GRAMMER VIRGIL L. TARPLEY S. ELLIS YOUNG CITY ATTORNEY CLARICE WALDEN CITY MANAGER LESTER E. CULVERSON O BUILDING INSPECTOR CHARLES LINDEMAN CHIEF OF POLICE MONTY SMITH CITY CLERK MARY THORNHILL The meeting was called to order at 7:30 P.M. by Mayor Hill. • NOTICE OF HEARINGS: (1) 8:00 P.M. - Application of E. Heisler for a variance permit or exceptional permit which, if granted, would permit the construction of an additional dwelling building on the East 18 feet of Lot 3 and Lot 4, less the East 22 feet, O Block 21, NORTH HOLLYWOOD'. Such application was previously considered by the Planning and Zoning Board of City of Dania, Florida,-: at its meeting on May 12, 1964, and the Planning and Zoning Board recommended denial of the request. • All ,persons objecting to the granting or approval of the subject matter of said application are requested to appear before the City Commission of the City of Danii. No objections. • A motion was made by Commissioner Tarpley that the variance . be granted. The motion was seconded by Commissioner Gram- mer, and the roll being called, the Commissioners voted as follows: • Grammer Yes Tarpley Yes Young Yes Hill Yes . (5) 8:30 P.M. Sherwood Spencer, Attorney for Mrs. Lloyd • L. Dilworth, owner of Block 1, LIBERTY HEIGHTS. Request to vacate an L-shaped alley in the above mentioned block. . A motion was made by Commissioner Tarpley to refer this request to the Zoning Board. The motion was seconded by Commissioner Grammer, and the roll being called, the Com- missioners voted -as follows: Grammer Yes Tarpley Yes Young Yes Hill Yes • (2) 8:14 P.M. - Application of Elmer Nitzsche and Mack Auto and .'ruck Service for a. variance permit concerning the use of Lots 13, 14, Block 39 VICTORY HEIGHTS. • �, _1_ The City Planning and Zoning Board, at its meeting on May 12, 1964, recommended that the application be granted. All persons objecting to the::granting or approval of A the subject matter of said .application are requested to appear before the City Commission of the City of Dania. Mayor Hill called for objections: Estelle Cunningham, 417 S. W. 2nd Terrace Z objects to fence. Willie Cunningham, 417 S. W. 2nd Terrace - objects to fence. Rosa Belle Lewis, 301!Phippen Road - objects to warehouses and fences. Geraldine Lewis, 301 Phippan Road - objects to warehouses. Robert H. Lewis, 301 Phippen Road - objects to warehouses. A motion was made by Commissioner Young to table this re- quest until June 22, 1964, to give the Commission an oppor- tunity to look over the area in question. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners noted as follows: Grammer Yes Tarpley Yes Young Yes Hill Yes (3) 8:20 P.M. - Application of Idoma James for a vari- ance permit to allow the construction of improvements on Lot..2, Block 31, TOWN OF DANIA. The City Planning and Zoning Board, at its meeting of May 12, 1964, recommended that the application be granted. 0 All persons objecting to the granting or approval of the subject matter of said application are requested to appear before the City Commission, of the City of Dania. No objections. 0 A motion was made by Commissioner Young that the request for variance be granted. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Young Yes Hill Yes (4) 8:30 P.M. - Application of Raymond A. Ross, concern- ing rezoning of a portion of land described as a portion of the NEJ of the NE+ of the SWJ of Section 3-51-42, from B-2 Classification to C-1 Classification. The application if granted, will require the adoption of an ordinance by the City Commission of the City of A Dania changing the various zoning classifications of the property as described. All persons objecting. to the granting or approval of the subject matter of said application are requested to appear before the City Commission of the City of Dania. + No objections. �+ -2- • 0 A motion was made by Commissioner Tarpley that an- ordin-. ance. be drawn and passed on first reading granting this request, contingent upon the right-of-way deed. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: • Grammer Yes Tarpley Yes Young Yes Hill Yes CITY MANAGERS REPORT: Bills: Invoice for Asphalt Paving and Patching of S. W. let Avenue (sidewalk) a $305.00 • City Manager Culverson recommended that the bill be paid. A motion was made by Commissioner Young to accept the City Managers recommendation and approve the payment. The motion was seconded by Commissioner Grammer, and the roll • being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Young Yes Hill Yes • Bill, tabled over from last meeting: Rogers and Price (auditing) - 50% of lst year General Fund $19000.00 Water Fund 800.00 • Total _3T 9070 A motion was made by Commissioner Young that the bill be paid. Young Yes Hill Yes • City Manager Culverson requested Mr. Peter Broome to inform the Commission as to whether 'tha present. site. of the dump provides enough right-of-way for the proposed incinerator. Pete Broome, representing Broome & Farina: There will be enough room, on the present site to construct the incinerator. We have enough access to the site after the right-of-way for the Flood Control District is deducted. The State Board of Health requires a preliminary Engineering Report to be sub- mitted to them before any construction plans are prepared. A preliminary Cost Estimate is in the process of being pre- pared. The next step is for the Commission to authorize a preliminary Engineering Report. REPORT ON DANIA PIER: Inventory has been taken. , Inventory amounts to approximately $680.00. City Manager Culverson requested to be authorized to negotiate with persons concerned. 1 �., -3- • Commissioner Young authorized Mr. Culverson to negotiate with everyone concerned and report to the Commission at next meeting. City Manager Culverson grought up the subject of the Fire • Truck "taking up a lot of room at the Water Plant." Commissioner Grammer suggested that it be given to the Volunteer Fire Department, no strings attached. Robert LaCroix: "I would like to see the City vacate a • 40 foot right-of-way between N. W. 2nd Street and N. W. 3rd Street." A motion was, made by Commissioner Grammer to out this in the form of a written request, and refer it to the Zoning Board at their next meeting, tomorrow night. The motion • was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Young Yes • Hill Yes William Rhodes: "Some time,:ago the Dania Beach Grill, Bill Rhodes, and the City was being sued. I understand that they have lost that suit. I wonder if the papers have been notified as to what happened. Itd like to see • it recharged until we are.'clear " Attorney Walden: "In that suit, the court ruled in favor of the City and you, as a party tothat, suit. The decree did, in fact, validate the lease, between the city and you. The suit was appealed. We 'asked for a motion"from"the . Appellate Court for that suit to be dismissed, and the court granted that motion. So the suit is over. There will be no further appeal." -4- • • • Commissioner Tarpley: Regarding the intersection of Dixie Highway and 4th Avenue, have the City Manager look at it and see if there is any way of getting the water out. There is a bad hole there filled with water. • City Manager Culverson: Will check in the morning, make arrangements to drain the water, gat some fill, and patch the hole. PROCLAIMATION: • Multiple Sclerosis Association: . Asking for permission to solicit funds in the City of Dania for the period of November 1, 1964 to November 14, 1964: A motion was made by Commissioner Tarpley to give them permission to solicit funds.
