HELD FEBRUARY 5, 1964.
The City Commission of the , City of Dania, Florida met in special
session in the Commission Room at the City Hall.,
PRESENT WERE: MAYOR COMMISSIONER VERA L. HILL

Meeting called to order at 12:00 o'clock Noon by Mayor Hill.
• A motion was made by Commissioner Thornton that Commissioner Tarpley
be excused, he had to be out of town today on business. The motion .
was seconded by Commissioner Young, and the roll being called, the
Commissioners voted:

Young Yes
Hill Yes
• Mayor Hill: The purpose of the meeting is to take action on the
contract submitted by the B. J. Van Ingen Co. , Inc.
Attorney Walden: I have examined the form of agreement submitted and
it is in order and legal. It is the same type form used in an agree-
ment with them earlier for another bond issue.
A motion was made by Commissioner Thornton that the contract be accept-
ed. The motion was seconded by Commissioner Young, and the roll being
called, the Commissioners voted as follows:

• City Manager Tubbs recommended that the bid for painting the city hall
submitted by Norman A. McDuffie, low bidder, be accepted. There has
been some discussion on the bid bond.
Attorney Walden: The Notice to Bidders did require a 5% bid bond.
If any one was to sue you over aivarding .this bid, I think I could
win the suit for the city. I don't deny it does require one and you
should not set a precedent by waiving, it. The easiest thing to do
is to re-advertise.
• Mayor Hill: I feel we should re bid it as I am of the opinion we
might run into difficulty. To do it right, I':feel we should re-bid
the job.

® Commissioner Thornton: Do you .think it will effect the bidding if
we re-advertise?
Commissioner Grammer: It is an open bid now, every one knows what
was bid.

Attorney Walden: Let me say this -- I would defend it on some other
grounds, but I think you should be consistent on all these bids,
either you never waive the bid bond, or waive it when you want to.
on some bids we took on the fishing pier, there was a time when there
• was no bid bond and we were very strict on..it, so I think you should
be consistent in whatever you do. I am not worried about any one
suing you because I think the City would prevail on two or three
other grounds if we did have a suit. But I would suggest you be
careful in setting precedents on these things. If it will not cause
• a ny hardship on any one, I would like to see you re-bid the item
and re-advertise it.
' Mr. McDuffie: It would be a hardship on my part, it is an open bid
$ now every one knows what I bid.
• Attorney Walden: It is a hardship, but by the same token Mr. McDuffie,
I assume you are bound by the Notice to Bidders.
Mayor Hill: It does not have to be awarded to the lowest bidder,
don't we have the say as to who gets it.?

Attorney Walden: Yes. If you can justify your reason for the next
one being the best one.
Commissioner Young: It is hard to get around it. I hate to put
• it off any longer, the work needs to be done.
Commissioner Thornton: I hate to put it off too, but at the same
time I hate to see it get entangled.
City Manager Tubbs: If you wish to give -it to Mr. McDuffie, you can
break it down to inside painting and outside painting, if you do not
want to re-advertise it. This is just a suggestion.
Commissioner Young: I would like to see Mr. McDuffie get the con-
tract as it seems like a fair price. If we put it off a couple of
months we will be into the rainy season.
Commissioner Thornton: Mr. Walden can this be worked out on a pur
chase order?
• Attorney Walden: You can reject all bids, then separately and later
just do whatever you think is good.
A motion was made by Commissioner Thornton to reject all bids for
painting city hall, labor only, as advertised. The motion was second
ed by Commissioner Young, and the roll being called, the Commissioners
voted as follows:

Commissioner Grammer: I would like to know why the specifications
were changed for S. W. First Street. The sidewalk on the north side
of the street is about 4 inches above the street and on the south
side it is 6 inches above the street. The dirt will wash out in a
heavy rain if something is not done about the elevation on the south
side.
City Manager Tubbs: I will check on it to see. The specifications
have not been changed.
Commissioner Thornton: Assuming that the annexation passes, have
any of you thought about who you are going to hire as engineer for
the work to be done in the area. The reason I bring it up is the
fact if the annexation does pass, these people are going to be push-
ing us for water. Who did the County engineering for the Playland
Isles Water Plant?

City Manager Tubbs: Garretson Engineering from Miami.

• Commissioner Young: I talked with the City Manager about the same
thing two or three weeks ago. I had asked him to call and see if
they could revamp some of their engineering and give us a faster
job than we would get from some one .else.
Commissioner Thornton: Some ons should contact them and find out
if they can do this and approximately what it would cost us, and
how long before they could give us the information if we need it.
City Manager Tubbs: I talked with Mr. Garretson after discussing
it with Mr. Young. The engineering will have to be completely re-
designed because they have the water going in the opposite direction
to what we would have it. They have the field work done, which is
mainly plats, layouts and such on the streets. We would have to
have a lot more water lines going in that the county will have.
Commissioner Young: They might be able. to convert some of their work
and get it done quicker.
City Manager Tubbs: Pete Broome asked me about this also, and if
I thought there was a chance of him getting the engineering for
the water if the annexation passes. I told him. the Commission had
not hired any one, and that as:-far as I knew you did not have any
one in mind for the job.
Commissioner Thornton: We should find out how long it would take
them because if the annexation goes through; the people out there
are going to want water last week.
Commissioner Young: If you want to ask some one to do a little
work at their own risk, that would be worth thinking about too.
City Manager Tubbs: They are working for the County on the Playland
Isles plant, I don't know how that would effect them working for 'us'
too.

Commissioner ThoQrnton: The thing I am thinking about is the fact
they could do it quicker than some one having to start from scratch.
They have already checked all the streets to see where you have
right-of-way. They have elevations and a lot of other information
• that you are going to need. They can make an overlay of the prints
they have and resize the mains and change the flow of the water.
Three fourths of the work on the drafting board is done. They might
give us a better deal than we could get from some one else. The
time element is going to mean a lot to us. It should cut down at
least a month.
Commissioner Young: Mr. Broome has some good ideas on water works.
I do not believe he could do this for us at 'his own risk.
Our fiscal agent has given us a time on the bonds and the auditor
• has been called in to do preliminary work on an audit. Most every
thing seems to be shaping up.
A letter was read from the Disabled American Veterans requesting
permission to sell Forget-Me-Not on February 28 and 29, 1964 in
• Dania.
A motion was made by Commissioner Young this request be granted.
The motion was seconded by Commissioner Grammer, and the roll being
called, the Commissioners voted as follows:
