{ MINUTES OF REGULAR MEETING, CITY COMMISSION, CITY OF DANIA, FLORIDA HELD DECEMBER 16, 1963. O The City Commission of the City of Dania, Florida met in Regular Session in the Commission Room at the City Hall. PRESENT WERE: MAYOR COMMISSIONER VERA L. HILL COMMISSIONERS R. L. GRAMMER VIRGIL L. TARPLEY JOSEPH D. THORNTON S. ELLIS YOUNG CITY MANAGER E. S. TUBBS, JR. CITY ATTORNEY CLARKE WALDEN CHIEF OF POLICE MONTIE SMITH BUILDING INSPECTOR CHARLES LINDEMAN CITY CLERK MARY THORNHILL Meeting called to order at 8:00 o'clock P. M. by Mayor Hill. Pledge of Allegiance to the flag and invocation was held at this time. Minutes of meetings held November 27, 1963 and two meetings held December 2, 1963 were read. A motion was made by Commissioner Tarpley minutes be approved as read. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes Young Yes f•' Hill Yes Attorney Walden read an ordinance annexing to the City of Dania, Florida, certain territory contiguous thereto and more particularly described herein, by extending the corporate limits of said City to include said territory; fixing the liability of the annexed territory for taxes, licenses and other municipal charges of the City of Dania; providing for the continuance of Broward County, Florida, zoning class- ifications as to such annexed territory until such annexed territory is zoned according to the laws and ordinances of City of Dania, Florida; establishing the status of such annexed territory in regard to muni- cipal regulations, services and benefits; providing for a special elect- ion to be held in the City of Dania and in the territory to be annexed ,r. pursuant to the provisions of Chapter 171.04, Florida Statutes, 1961; providing for an effective date; and repealing all ordinances in con- flict herewith to the extent of such conflict, in its entirety. Attorney Walden: In Section 2. (a) regarding the franchise tax. I did not know whether you wished to start collecting this tax this early or not. Maybe it is best not to change it at this time, it can be done later if you see fit. There will be one slight change in Section 5. (a) , where we say the qualified electors will be those that are qualified the date the ord- inance is passed. :' :. • Since the ordinance was drafted, we obtained an opinion from the Attorney General. He suggests we follow the State Election Laws as to voters in the unincorporated area. That law requires that • any elector may register any time up to 30 days before the date of the election. So it will in effect be changed to provide that the qualified electors shall be those that are registered in ac- cordance with State Election Laws. I do recommend that one change. • A motion was made by Commissioner Thornton that the ordinance be passed on third reading with the change as recommended by the City Attorney. We can go downstairs and check all the bids to see if there are any discrepencies in the bidding, and give you a recommendation tonight. The official tabulation can be made tomorrow. Attorney Walden: I think it would be proper to have a motion that the bids be turned over to Mr. Philpott and the City Manager for tabulation and a recommendation back to the Commission later in the meeting. A motion was made by Commissioner Thornton that the bids for the construction of an addition to the water treatment plant be referred to the Engineer and City Manager for tabulation and recommendation. The motion was seconded by Commissioner Tarpley and carried. �4. ;t • Recommendations from the December 10, 1963 meeting of the Planning and Zoning board were presented as follows: (1) Mr. John Buck, representing Donnelly Advertising Corporation. Request for permit to erect two billboard signs on North Federal • flighway. Location No. 1 - For southbound traffic only' - On the east side of US #1, north of the Airport entrance. Lots 12-24, Less SRD R/W, and that part of the W 1/2 of Rich- Land Avenue lying east of Lots 17-24, Block B, • Richland Little Farms. Location No. 2 - For Northbound traffic only - On the east side of US #1, south of the Airport entrance. Lots 1-11, Less SRD R/W, Block 4, North Wyldwood Park/. • Mr. Buck also presented a letter from Mr. Joseph P. Canouse, Assis- tant County Attorney, to the board requesting the board to waive their hearing due to the fact that the tourist season was beginning and time was important to have the signs erected in order to serve • their purpose, an& Mr. Buck requested a waiver of the hearing. A motion was made by Mr. Jackson and''seconded by Mr. Kennedy that the waiver of hearing request be denied. Motion carried. A motion was made by Mr. Jackson and seconded by Mr. Casciello, to • advertise for a public hearing to be held January 14, 1964, at 8:00 o 'clock 'P. M. Motion carried. Commissioner Young: In the last few days I have discussed this . sign matter with two of the County Commissioners and also the Man- ager of the airport. The recommendation that I have comes under the directional sign provision in our ordinance whereby the County can obtain the permit, and further providing the county will enter into an agreement with the city stipulating that when the sign is no longer used for this particular purpose that the county will, at its own cost and expense, remove the sign. There was another item • mentioned -- that is the words-- Dania, Florida -- be inserted on both signs. I see Commissioner Adler in the audience, and I believe he can tell you this was agreeable with them. A motion was made by Commissioner Young that a permit be issued to the Broward County Commission with the above mentioned provisions and conditions. The motion was seconded byCommissioner Grammer. Commissioner Thornton: I would like to ask Mr. Walden if, this re- quest for a public hearing had been advertised? Attorney Walden: No. Mr.. Buck should withdraw his application for the sign and the County make the application. Commissioner Tarpley: This does not seem like a directional sign to me--- it is a billboard. • Commissioner Young: I would like to ask the Attorney for his inter- pretation on the legality of the permit being issued to the County? r • Attorney Walden: I think I could make a decision either way. To give you a little background-- about ten or twelve years ago the City adopted a very detailed and lengthy sign ordinance. It was very good from the standpoint of the City as it was almost impossible for anybody to get a sign erected. In 1956 we were sued over that sign ordinance and the Court indicated that it would hold up, although, O the basic ordinance was illegal. So more or less as an emergency measure we passed an ordinance that was s stop gap, and later we adop- ted the building code that picked up some more sign ordinances. The zoning board complained about the sign ordinances being confusing, which they are. • I think the basic intent of all our ordinances is that government bodies be excepted from the application of them, and on that basis you can let the County go ahead with the signs. I will give you a legal opinion to that effect. Actually, the County is the one • that assumes the risk if it is illegal and I think they understand that. Not that it is illegal, but, if some taxpayer was to sue to have the sign taken down under our ordinance, the County is the one that takes the risk over the legality of the sign rather than the City. • Commissioner Thornton: Mr. Adler are you willing to assume this responsibility? Commissioner Adler: Yes. I was on the commission with Commissioner Thornton when this first ordinance Was passed. I do not like to see • the City cluttered up with signs. .'- But I believe the exception in the ordinance is that government bodies be allowed such type signs as we are asking for. our airport is for all of Broward County and it benefits all the cities in the County. This is the first year we have had any money in the airport budget to advertise. That is • why we are putting up the signs to let the people know it is there. The sign will read -- Dania, Florida -- and all the literature ad- vertising the airport lists Dania first in all the .cities being served by this airport. If there is any legal question whether or not you have a right to grant this permit, the County is agreeable that if it becomes necessary to defend this action, it will be the responsibility of the County. The suggestion that Commissioner Young made that this permit be issued in the name of Broward County, Department of Airports, and that when we cease to use if for advertising the airport, the':.signs will come down, is an excellent suggestion. The intent of the ord- inance is that no billboard signs will be erected. I thank the commission for their cooperation in this matter. Commissioner Tarpley: Do you think these signs will actually help the airport? The locations are almost on the entrance. Commissioner Adler: I cannot answer that question. The county has hired an engineering and advertising firm that is supposed to be the best in the county, to advise us. I know nothing about the ad- o vertising business. Whether it is beneficial or not, I do not know. Mayor Hill called for a roll call vote on the motion. The vote was as follows: Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes t: • Mayor Hill called for a recommendation from Mr. Philpott, Engineer, for awarding a contract for the construction of an addition to the water treatment plant. Mr. Philpott, Engineer, introduced Mr. Bach, resident engineer for • the HHFA, and they recommended the contract be awarded by resolution to the Water Conditioning Equipment Corp. , low bidder at $113, 088.00. Mr. Bach: Since the bids did come within the amount of money ap- proved by the HHFA, the commission can make a tentative award to- night, if it is the pleasure to do so, by a resolution making the • award tentative to the concurrance and approval of the HHFA. Which means that you should tonight, or at your earliest conven- ience, have a proposal signed by the bidder and gather also a proof of advertising for bids, a tabulation of bids, which should be cert- ified by the city clerk, a letter from the mayor proposing the award • and indicating the name and the address of the bidder and the amount, and a copy of the resolution passed by the City commission. All of this should be forwarded to the regional office in Atlanta to Mr. Edward Baxter. • It will not be necessary, since you come within the funds, to take out the two alternates. You can award the contract on the basis of the basic proposal, which is $113, 088.00. The reason for the deductible alternates was that in the event that the bid was in excess of the amount of the money set up in the project, these two • items would be at your disposal. Since they did come within the amount of money, we would suggest and prefer that you not take out alternates one and two. Commissioner Thornton: Will the grant apply 50% also on alternates one and two? • Mr. Bach: That is a very good point. Your grant that is committed to this project cannot exceed 50% of the total project cost. Commissioner Thornton: I would like to know because we are approving something here and I would like for the people to know what they are getting. Mr. Bach: The next procedure after forwarding the necessary doc- uments to the regional office is to await the concurrance of the regional office in the award. The next step will. then be signing the contracts, sending two (2) ' copies of the contract documents and two (2) sets of plans to the regional office. However, you can issue your notice to proceed to the contractor as soon as you receive concurrance of the award. The revue and approval of your contract • documents can be done concurrent with construction. I want to point out also that there is a 120 day target date for getting this project. under construction, and that 120 days dates from September 16, 1963. It will be sometime around January 15, 1964. Let me state also that if it appears for some reason that you cannot • get concurrance in your award within that time, it would be incumbent upon you to request a 30 day extension of time. It is written into the law in the legislation that the project must start within 120 days from the grant offer. So if you find you are going to run into difficulty in meeting that target date; I would suggest that as soon as you know you are going to have difficulty, get your request in to the regional office. I might add, I left my card with the city clerk and if you will let me know I will certainly contact the reg- ional office and help you in getting this extension if necessary. We prefer you get the project under construction as soon as possible. F " • ® Commissioner Young: I move that we adopt and pass a resolution tentatively awarding the contract for the expansion of the water treatment plant to the Water Conditioning Equipment, Corp. , lowest and best bidder, contract being in the amount of $113, 088.00. Also, the letter from the mayor as requested by Mr. Bach. • Mayor Hill called for continuation of recommendations from the Planning and Zoning Board. They were as follows: Attorney Walden read item as follows: • Henry Ransburgh, attorney for David Greenburg and Thelma Russo. Request for rezoning Lots 1, 2, 3, Block 3, St. James Park North, from B-2 to C-1. A motion was made by Commissioner Rickards and seconded by Mr. Jack- son, to advertise for a public hearing to be held on January 14, 1964, • at 8:30 o 'clock P. M. for the purpose of hearing objections to the rezoning. Motion carried. Attorney Walden: All you can do at this time is to authorize the public hearing as recommended. • A motion was made by Commissioner Young to accept the recommendation of the Planning and Zoning Board and advertise for a public hearing to be held January 14, 1964, at 8:30 o'clock P. M. The motion was seconded by Commissioner Thornton, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes ' Young Yes Hill Yes Item 3. Mr. James Santana - Request for a warehouse to be built on Lot 20, Block 20, Town of Dania. Chairman.Loury asked Consultant Reilly if the parking facilities were adequate and also if the plans were in order. Mr. Reilly stated that everything was in order. A motion was made by Mr. Cas- ciello and seconded by Mr. Jackson that the plans be approved as shown if satisfactory to the building inspector. Motion carried. A motion was made by Commissioner Tarpley to accept the recommend- ation of the Planning and Zoning.Board. The motion was seconded by Commissioner Thornton, and the roll being called, the Commission- ers voted as follows: Grammer I. will not vote on this as I own the piece of property. I will pass. Tarpley Yes Thornton Yes Young. . Yes -8 Hill Yes ® Attorney Walden: On the last two items of the Zoning Board recom- mendations, a letter was written to the commission by the chairman, Mr. Loury. The first letter is in regard to the sign ordinance, in which they would like to have an interpretation which would serve as a guide in the future. I would suggest that a committee be appointed from the Zoning Board members and the Commission to come up with a recommendation on the sign ordinances. Commissioner Thornton: Don't you think we have a good sign ord- inance? Attorney Walden: Yes. It is so confusing that most people get discouraged and do not bother to follow through to get a permit. Commissioner Thornton: Let 's keep the one we have. It has held • up so far. Attorney Walden: It can be tabled until a later date if that is waht you wish. It is a confusing ordinance as we have done every- thing we can to stop billboard signs. Although the law says there ' • is nothing illegal about a sign in itself, in some cases though they are illegal. /ton A motion was made by Commissioner Thorn-to table that portion of Item 4 relating to a sign ordinance. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: Grammer Yes Tarpley Yes Thornton Yes • Young Pass Hill Yes Part 2 of Item 4. • In a letter from Mr. Loury the board recommended deleting the second public hearing when one has been held by the Planning and Zoning Board. The members feel it will expedite the ,issuing of building permits. Attorney Walden: Mr. Lindeman, what are the objections to the second hearing? Mr. Lindeman: It is the time element. Sometime it takes as long as six weeks to two months to get a building permit when two public • hearings are held. Attorney Walden: We have adopted a policy on this. That is in re- quiring two public hearings. In the case of a person wanting to build something and an ordinance prohibits it, you can do one of two things. You ask for a variance permit whereby the commission • simply makes an exception to the zoning ordinance, or alternatively the applicant can ask for the property to be rezoned so he can do whatever he wishes to do under the zoning. The variance permit under our charter requires a public hearing before the zoning board. A public hearing before the. commission on a variance is not required under our charter. There is just , the opposite of that on rezoning. The zoning board does not have to hold a public hearing, the commission does. c.• oftentimes when an applicant starts out he does not know exactly ® what he wants. So to keep from having the wrong hearing at the wrong time, it has been the policy to require a hearing before both boards. That is one area where you can require a minimum number of hearings • under the Charter. That is the only place where there has been a big problem. In one case before us tonight-- I talked to Mr. Ransburgh before the meeting and he told me he would like to have it where he could • ask for either a variance or a change of zoning. He wants to ask for both, in the hopes of getting one or the other. In that case he has to have both hearings if he wants to give the shotgun effect to it. On a variance permit, the zoning board holds a public hear- ing, on rezoning, the commission holds the hearing. That is what • the Charter requires. Commissioner Grammer: Does a variance still have to come before the commission? Attorney Walden: Yes. You accept or reject the recommendation • of the zoning board.' Commissioner Grammer: Last year when Mr. Rickards was on the com- mission he recommended that anything that was within the zoning laws, the set-backs, the parking and everything else being in order, that • it should not come before the zoning board or the commission. While we are making a change, I would like to have this included. That has been slowing the progress of Dania. Sometime people spend two or three months getting something approved. They get tired of waiting and go somewhere else. As long as everything is alright it should • be left up to the building inspector to issue a permit. Attorney Walden: A month or so ago the zoning board made a recom- mendation. It will require a lot of modifications of several ord- inances and it will be a month or more before I can have it ready. A motion was made by Commissbner Thornton that the zoning board hold public hearings on requests for a variance permit; the city commission hold public hearing on requests f or rezoning, as provided under the Charter. Mayor Hill called for objections, if any, to the change of zoning as advertised. O There were- no objections. Attorney Walden read an ordinance rezoning Lots 1, 2, 3, 4, Block 1, Victoria Villas. • A motion was made by Commissioner Tarpley this ordinance be passed on first reading. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: O Grammer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes • City Manager Tubbs read a letter from the State Road Department re- questing the City to enter into an agreement whereby they agree to relocate or adjust any facilities to conform to the proposed roadway construction. Namely, Sheridan Street from SR9 to SR5, or State Road 822. Also enclosed is a resolution to be executed by the officials • of the City. Attorney Walden advised that the only utilities the city would have in this right-of-way is water lines. It merely means the city will agree to move or relocate any water lines that are. in the right-of- way. Commissioner Tarpley: If we pass this resolution, it should read SR 822 and not Sheridan Street. A motion was made by Commissioner Thornton this resolution be passed. The Motion wa s seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes A, Tarpley Yes • Thornton Yes Young Yes Hill Yes City Manager Tubbs advised that 'there was' $2, 000 in the Perpetual Care Fund of the Dania Memorial Park, and recommended bonds in the amount of $2,000 be purchased. Commissioner Young asked what type bonds were being bought and what was the rate of interest? City Clerk Mary Thornhill advised that the yield on most of the bonds is 2 1/2; 3 and 3 1/2 % depending on what the bond market is at the time of the purchase. That she usually checks with Mr. Frank Eby at the Dania Bank before purchasing as they receive the bond market re- port every day. Only Government Bonds are purchased. -11- r it Si - • A motion was made by Commissioner Thornton that the $2, 000 in the Perpetual Care Fund be invested in Government Bonds. The motion was seconded by Commissioner Tarpley, and the roll being called, the Commissioners voted as follows: • Grmmmer Yes Tarpley Yes Thornton Yes Young Yes Hill Yes • City Manager Tubbs: For a number of years it has been the policy of the City Commission to provide for a Christmas Bonus for all employees. We have an item in the budget for this. It has always been approved by resolution. The amounts are $25.00 for one year service or more; from 9 months to one year $15.00; from 6 months . • to 9 months $10.00. A motion was made by Commissioner Thornton that a resolution be drawn and passed granting Christmas Bonuses as recommended by the City Manager. The motinn was seconded by Commissioner Young, and • the roll being called, the Commissioners voted as follows: Grammer Yes Tarpl'ey Yes Thornton Yes • Young Yes Hill Yes Commissioner Grammer: On one of the patrolman-- we will not call any names-- I recommend he be paid the $25.00 one year bonus. Commissioner Thornton: If you are going to change one, you will have to change them all. We are not going to pick out just one. , There are two men in question -- Robert Cowart and Ed Burton, and I will make a motion they be included for the �25.00 one year bonus. Hill Yes City Manager Tubbs presented' a bill from Smith & Hooten Electric , Company in the amount of $1,500.00 which is the balance due on lights for West Side Park. Commissioner Tarpley: I will make' a motion to table this matter for the time being in order to give it a little more study. The • motion was seconded by Commissioner Young and carried. City Manager Tubbs: We have $2, 500 in the budget for the library, and as of this date we have not paid then anything. I would like to know what your wishes are. They have never requested any money, • I don't know whether they are shy or .what it is. Commissioner Tarpley: They were supposed to go ahead and put in air conditioning, buy a filing cabinet and use the balance for the salary of the librarian. • A motion was made by Commissioner Thornton that the library the amount budgeted when it is requisitioned. You were all sent a copy of the letter from, - the City Attorney as to the cost What do you wish to do about it? The cost is $35.00 each copy. • Commissioner Thornton: any one wishing to see the Charter can come to the City Hall and see it, if it is going to cost that much. Commissioner Tarpley.' I know there are quite a few copies around the city, I know of three. Is there any way we can get them back? Attorney Walden: In 1949 when the basic charter was enacted, I do not know who did it, but some one mimeographed it and I think there are a few copies around still. In virtually every- session of the legislature since 1949 we have had amendments. To complete the charter you have to include all the subsequent acts: ` Commissioner Thornton: How many copies are you talking about making? •: The City Attorney has one, there is one, in the office, how many do you need? They will just disappear if you have them around. Commissioner Grammer: I want one in my office. I figure all the rest of the commissioner around the city, have one, then I am en titled to one. I recommend we have ten copies made. Commissioner Tarpley: I do not have one. Commissioner Thornton: Neither do 'I'. Commissioner Young: Is there a possibility of buying a law book from the Secretary of State that would have the charter in it? • Would it be any cheaper? Attorney Walden: Y ou can buy the 1949 Acts, which is the basic charter, and you would have to buy each subsequent year in order to have all the amendments. • commissioner Young: I have a copy in my office, and I very freq- uently refer to it. It is a photostatic copy and it is getting black from handling and hard to read. You would be surprised at the information you get out of it from time to time. I will • second the motion to have ten (10) copies made. Commissioner Thornton: I would like to add to the motion that each person that gets a copy, signs a receipt and agrees to return it when his term expires, or pay the cost--$35.00. • Commissioner Grammer: I will include that in my motion, and also add to my original motion that the city manager or the city clerk write a letter to all the ex-commissioners that have copies and ask them to return them. • Mayor Hill called for a roll call vote on the motion. They travel all over the country and hold conventions. They were at Watson Park, Miami Beach, last year. There will be 20 or 30 trailers, they will use gopher holes for dishwater. All their toilets are self contained units. They want .to use, the recreation building to show movies, hold meetings, talent shows, dancing, etc. They will be parked in a wagon style setting. They want use of the park for five days sometime in February. Commissioner Tarpley: in the first place, gopher holes for dishwater • will not work in the type soil,' in Frost Park. Commissioner Grammer: Why can't they park at the 30 Acre Park. City Manager Tubbs: They want to use the recreation building and • cooking facilities. John Kotch: I live in this area and all the homes cost at least $20,000. Commissioner Young: Has this been referred to the Chamber of Com- merce for recommendation? • City Manager Tubbs: No. The letter was addressed to the Commission, and I brought it to your attention first to see what you wished to do with it. • Commissioner Young: I would like to see it referred to the Chamber of Commerce for recommendation. Mayor Hill called for a recommendation for appointment of a Munici= pal Judge. • A motion was made by Commissioner Tarpley that a resolution be drawn and passed appointing A. M. Black Municipal Judge, at the salary provided in the budget; to serve at the discretion' of the Commission. If some one wanted .to stop and shop in Dania • there is no where to park. The sidewalks should be swept and kept clean as well as the streets. Also, last year, some one put an old stove on his premises. He had talked to Mr. Tubbs about it and he said there was nothing he could do about it. Mr. Tanner, from Sunshine Villas_ What is the status of the sanitary sewer project at the present time? City Manager Tubbs: Mr. Philpott thought he would be ready with the report the first of this week. I talked to him Friday and he has run into difficulty because of a few changes such as storm drainage that has been done since the last revision of the plans. So he has to raise or lower some of the mains which calls for redesign. They should be ready within the next" few days. Mrs. Tanner: Is there any way the shopping center could be cleaned • up? It is awfully dirty. -15- • �l • Commissioner Thornton: That is private property and we cannot clean it up. The only thing to do is quit trading with the mer- chant there. We have been trying to enforce a lot of things over there but we do not seem to get anywhere with it. • Commissioner Young: We had a meeting with the owner about six months ago and he promised the place would be cleaned up and the drains in the parking lot taken care of. City Manger Tubbs: He asked me for the names of some people that • did work on drains. I gave him the names of three people that do that type work, and he has not contacted any one of them about the job. Commissioner Thornton: Mr. Walden,. is there anything legally we can do to get the place cleaned up and the drainage fixed? • Attorney Walden: No. Mr. Tanner: Dan't you have the authority. to abate a nuisance in this city? • Attorney Walden: The County Solicitor has that duty in this state. Commissioner Tarpley: Can we put the $5, 000 we received from the fronton on a Time Deposit for six months? • Commissioner Thornton: What will you do if they ask for it back before the six months is up? Commissioner Tarpley: They cannot get it unless they put the side- walks in. • Commissioner Thornton: Can we switch money around that way Mr. Walden? Attorney Walden: This will have to be done by resolution and it • has to stary there for a certain period of time before you can draw any interest. Commissioner- Tarpley: There is an old building on S. W. 6th Street . on the rear of the.-.lot. The lot is overgrown with weeds and it is an eye sore. Can't we do something about getting it cleaned up? City Manager Tubbs: We have been working on this for about a year. There was one big building on the lot, we have gotten it torn down, and the owner asked to leave this small building to be used as a tool shed until he got his new house built. We will get to work on it again and see if we can get the lot cleared. Commissioner Tarpley: I would like to see the drinking fountain at the fishing pier removed, painted and put back.
