The City Commission of the City of Dania, Florida, met in Regular Session in the Commission Room at the City Hall. PRESENT WERE: MAYOR COMMISSIONER FRANK E. EBY COMMISSIONERS E. B. ELKINS ROBERT E. A motion was made by Commissioner Elkins minutes be approved as read; motion seconded by Commissioner Tubbs, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yes Transfer of bar license from Julius Boroski to Angelo R. Giannantonio, Dania Bar, 1435 South Federal Highway, was presented. A motion was made by Commissioner Houston this application be approved on first reading; motion seconded by Commissioner Tubbs, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yes Bill from B & C Construction Company in the amount of $2,295.63, Requisition No. 2, on the construction of an Adult Recreation Building, Public Rest Rooms and Dance Patio, at Frost Park, and approved by the Architect, Victor A. Larson, was presented. A motion was made by Commissioner Elkins this bill be paid; motion seconded by Commissioner McMillan, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yes Bill from B & C Construction Company in the amount of $1,427 .49, Requisition No. 1, on the construction of Concession Stand and Rest Rooms at 30 Acre park, and approved by the City Manager and Building Inspector, was presented,! , Commissioner Houston asked if the contractor had presented paid bills on materials, and what percentage of the building is com- pleted? Building Inspector Raymond advised the commission that the build- ing was about 40% completed, and this was about a 20% draw. That he would recommend payment of this draw subject to paid bills being presented before the second draw, if everything was in order. t: 2 _ Attorney Walden advised that the contract was a lump sum con- tract, payment upon completion of the building, or as the com- mission desires. E. 13th Street a few days ago, and especially commending Commissioner Houston for his time and patience in this matter. A letter was read from the Dania Chamber of Commerce advising ' the Commission that the lease on property where the CC building is now located expires in 30 days. They are requesting consider- ation by the commission for moving the present building to an agreed upon location in the Community Park area, near the Post Office and City Hall. Commissioner Houston stated that the Commission was arranging a meeting with_ the CC Officials regarding the 4th of July Cele- bration, and this matter could also be discussed at that time. That he was in favor of the CC staying down town. They had been offered this park site several years ago when they wanted a location in the Wayside Park, but at that time they felt they wanted to be on the other side of the highway. Perhaps we can work out something with them before their lease expires. Mayor Eby stated that a meeting was scheduled within the next few days regarding the 4th of July Celebration, and recommended this matter be tabled until the next meeting before any action is taken. Mayor Eby stated that the fee for advertising for a zoning change on Block 5, Dalton Manor had been received, and a date for a public hearing should be set. A motion was made by Commissioner Houston authorizing the adver- tising for a public hearing to be held before the Planning and Zoning Board, June 3, 1958, at 8:00 o'clock P.M., for Block. 5, Dalton Manor, changing the zoning from R-2 Classification to R-3 Classification; motion seconded by Commissioner Elkins, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yes F1' f - 5 - A letter was read from the Planning and Zoning Board, signed by Luther Sparkman, Chairmen, as follows : "It is the opinion of the Planning and Zoning Board that the re- quest to omit sidewalks in the Shelter Island development would be a violation of the existing sidewalk ordinance of the City of Dania. To assume the right to grant a property owner permission to violate a city ordinance is beyond the authority of this board, and would establish a precedent where other property owners may make similar requests. It is therefore felt that Mr. Conger .of the Shelter Island sub- ' division request a variance on this matter and process it in accordance with the procedure established by our ordinance. Luther Sparkman Chairman Planning & Zoning Board " Mr. Conger stated that he requested a variance several months ago on the sidewalk ordinance, and that he had spoken to each member of the Zoning Board and they told me they could not see any ad- vantage to sidewalks in this subdivision. That he was supposed to get a copy of the letter from the Zoning Board, but that he had not received it. That according to the ordinance the Plann- ing and Zoning Board has the right to say whether sidewalks are to be constructed or not. Attorney Walden advised Mr. Conger that the Zoning Board was only an advisory board, they did not have any powers. But if he had made application for a variance the Zoning Board should make a re- commendation to the Commission on that basis . Commissioner Houston stated that we were just passing the buck, lets face it, Mr . Conger wants to know something now. The Zoning ' Board does not have any authority, they only recommend. If this ' goes back to the Zoning Board it will be another three weeks be- fore you will know any thing. Mayor Eby advised Mr. Conger that the Zoning Board does not have Power to pass laws, the power lies with the Commission, and they are fully aware of the circumstances, and know that it warrants a lot of consideration. We do not want to hurt any one, if we act too hastily on this we w ill be putting ourselves in jeopardy. A motion was made by Commissioner Houston to refer the request for a variance, if he has made one, back to the Zoning Board for a recommendation; motion seconded by Commissioner Tubbs, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yes Commissioner Houston asked Attorney Walden if it was necessary to advertise for objections to filling lots, that were filled by special assessment? Attorney Walden advised that this was handled the same as any other special assessment, and would have to be advertised for ' objections. A motion was made by Commissioner Houston to advertise for object- ions to the assessment list for the filling of Lots 16, 17, 18, 19, 20 and 21, Block 2; Masonts Subdivision, and Block 3, Beach- way, motion seconded by Commissioner Elkins, and the roll being called, the following commissioners voted: _ Elkins Yes Houston Yes y., McMillan Yes Tubbs Yes Eby Yes 6- Mayor Eby introduced Mr. Grant & Mr. Allaman, of the firm of Jack F. Cooper & Associates, Inc. Mr. Allaman presented a preliminary drawing of topography of the eastern portion of the City, showing permanent bench marks, floor elevations, proposed grades for streets, grades and elevations for area not developed, directing the flow of water, with possible drainage on 5th Avenue, canals and secondary drainage. This is a preliminary map subject to revue and changes. We are very happy to present this to you, as we understand this ' is the first topographical survey made for any city in this area, in fact. in Broward County. If this is adopted we will have a more satisfactory way of coping with drainage problems. We will leave this map with Mr. Malley and he can make it avail- able to the residents of the City of Dania. Mayor Eby stated that if this survey is accepted by the com- mission, we will have to follow the elevations set forth for future development of the eastern section of the City. Commissioner Houston stated there were several things he thought should be kicked around. We are talking aboutl:the area East of Federal .Highway. Tl?e next street east of Second Avenue, there is a 7 foot elevation at the south City limits, and 5i •feet at Beach Boulevard. We have a request now for sidewalks on S. E. Second Avenue, we know it is too low now, so what can we do about elevations for sidewalks? Will it effect floor levels of houses already built? You show 4 foot elevations at 5th Avenue, that seems to me to be too low. It will cost more money to fill if you raise elevations. But I think the eleva- tions should be kept as high as possible, you can never get them too high in this country. All the buildings on the West side of S. E. Second Avenue are high. There is one duplex on 14th Street that might be too low. I am not only thinking of drainage, but also of getting the property up.. Mayor Eby stated that the method for getting the water out is for trunk lines to canals. and toward the Beach Boulevard. That we should get some of the contractors and other interested persons in to go over this map, as it was a '.big problem and an important one. We should not go into it hastily. We will have the City Manager set up a time, and give you a call so that we can go over this together and iron out some of the problems be- fore any definite action is taken. Mr. Florian developer of Florian Isles presented a tentative plat to the commission for approval. Commissioner Houston advised Mr. Florian that the commission had given tentative approval to his plat subject to the linen plat being presented to the Zoning Board for approval. There is no reason why you cannot go ahead with streets and water lines. Of course, you know it has to be done under our supervision and inspection. The Zoning Board will ask for street, water and sidewalksbonds being posted before the linen plat is approved. You can put in rock roads until your buildings are finished so that you can get into the property, and your streets will not be torn up by trucks. Commissioner Houston stated that the recreation committee was asked for a recommendation on a fence for the Woodlawn Cemetery. That after talking to Mr. Porter Reynolds, we have decided to wait . He is designing an entrance to the Memorial Park Cemetery and wants to wait until he has this plan ready, and will tie in the two. Commissioner Houston stated that the recreation committee was .3commending putting in additional seawall and 3 or 4 more small boat ramps at the 30 Acre Park. The type of boat docks and seawall should be decided upon before hiring an engineer. r - 7 - Mayor Eby stated that he had seen some docks he liked along the New River Canal in Fort Lauderdale . The ones we built are too shallow. Commissioner McMillan stated that Hollywood has a very good one as he had used it several times and launched a boat with out too much trouble . Commissioner Houston stated that the Garden Club was very much interested in taking over the beautification of the Memorial Park Cemetery. They are having a meeting at noon tomorrow and will let us know if they will accept the job. Commissioner Houston stated that he would like to inquire about getting lights at the comfort stations bding built at Dania Beach. We should contact Florida Power & Light Company immed- iately, as they may have to cross the street in order to get service there . I would also like to see them put street lights on poles they put up out there. We have a new maintenance building at the Memorial Park Ceme- tery. Weoneed a drive up to the building. I would like to see the City Manager get several bids on this work. There is no need to advertise for bids for a small job like thief as it will not cost $500.00. We need a 12 foot drive, with a 10 or 12 foot apron in front. The drive should be asphalt. As you come into the cemetery there is a circular drive on each side . Mr. Reynolds plan calls for trees around this drive, now would be a good time to plant them. We should get prices on trees and get them in. The type of trees called for on the plan cost between $25 and $50, They will make a better appearance to the cemetery. I have been milling over something in my mind now for three or four years. I believe we now have the solution. I am in favor of all these improvements as fast as possible if economically sound at this time. All businesses here and all over the coun- try need money, and we should get some in circulation. The thing I have been thinking about is sanitary sewers. We were stopped at one time from building on the east side of Federal Highway by the Broward County Health Department. I went with the City Man- ager to talk to Dr. Hughes and assured him we would do something about sewers as soon as possible. In fact, we did everything but build the sewers, and he agreed to go along with us up to a cer- tain point. We are handicapped in this area, you cannot get FHA loans because of the fact we do-not have sanitary sewers. There 1s one corporation that has bought 65 or 70 acres to the east of Olsen Jr-Hi School. They cannot move until we satisfy the Health Department. It has been suggested that a possible solution they go ahead and build a disposal plant. I am definitely opposed to any concern coming into t he City and building a plant afd after a certain length of time they will try to turn it overto the City. After making quite a few investigations among engineers and from people who finance these projects it is `. not practicable . I do not know yet what our solution will be. We have a problem, we are not going to be able to develop to the east until we do something. We might as well face it and do some- thing. Unless we investigate and start some kind of program we will never know. We have to find out how we can pay for such an undertaking. Hire engineers to make a survey to find out the cost. This topographical survey may be of some use, I do not know. The cost of a plant will be somewhere in the neighborhood of ' .�600,000 to $700,000. This commission should immediately appoint a fiscal agent to start work on methods of financing such a project. We should also hire an engineer to start work on cost and a pre- liminary plan on a disposal plant, whether we can cover the entire city at this time, or whether it would be better to build in stages, say over a period of ten years. We have several times borrowed money on bonds. If there is a city in this area that can finance _ such a project, the City of Dania is that city. We have floated several issues. I think we are in a position to enter into some _ 8 - kind of proposal and get the ball rolling. We have had the same fiscal agent.represent us in all of the previous issues, he has worked very closely with us and we have been able to get the best interest rates of any of the cities around here. I think we should appoint the B. J. Van Ingen & Company of Miami to act as our Fiscal Agent. This firm is recognized all over the country. I have talked to Mr. Hodge, they have worked out these problems in this area, and if we give them time they can tell us the cost of such an undertaking, and whether or not we can go into it, and whether or not we can do the entire city now or 1/2 now and wait until a later date to complete the pro- ' fedt. I would like to hear some discussion from the other commissioners about how they feel about this proposal. It looks to me like we have held this up long enough. We have been think- ing -- let some one else do it, and we get off on something else and let sewers wait. We now have to do something. Commissioner McMillan stated that he agreed with Commissioner Houston that something should be a one about sanitary sewers. That he also thought we should do something about an incinerator. Commissioner Houston stated that Mr. Gillespie of Smith & Gillespie, Engineers, met with him several years ago and they spent the day together going over the possibility of building an incinerator. I thought at the time it might be possible and - feasible for us to go into an incinerator and perhaps we could have Broward County as a customer. After him explaining to me the cost of operation and up keep I saw where this was definite- ly out. Until we have a population of over 10,000 it is not practical . I do not know what the answer to this problem is -- but it is not an incinerator at this time . At the time Holly- wood went into theirs, they wanted us tp put up money and go in with them, but at the time we could not see it. Mayor Eby stated that if we could get sanitary sewers started that would be a step in the right direction. Commissioner Houston stated that we have one garbage truck that is 5 or 6 years old, and within the next year it is going to be expensive to keep it on the road, as the repairs are beginning • to be enormous. I would like for us to start looking around for a new and larger truck and packer. On a heavy day now this truck is making four trips to the dump. It may mean a great saving to put on a larger truck if an incinerator is not prac- tical, we may have to abandon the present dump, and that will mean we are going to have to make a longer haul to some place in the county, and that could be as much as ten miles. We do not know what our problem will be In the next two years and there is no need to buy the smaller truck. Commissioner McMillan asked what would this larger truck do to the alleys• in the City, that the alley in the rear of his home was breaking up now? Mayor Eby stated that we are :all well aware of the problem of sanitary sewers. We should arrange a meeting as soon as possible with Mr. Hodge. It will not cost us any money for preliminary work. Commissioner Houston stated that we have worked with Mr. Hodge on three other issues and we know whati-they can doh: and I see no reason to change. We have one thing in our favor. At the time we purchased the 30 Acre Park we had different engineers tell us this was an ideal site for a disposal plant. We are very fortunate in having this land paid for. We never thought we would have to use all of it for a park at the time we bought it. I would not like to see a private concern put a plant in the southern end of the City. This is an ideal location on the inland water way. - 9 - Commissioner Elkins stated that he was in favor of sanitary sewers, as well as sidewalks all over the city. This is one thing we have to do . I am whole heartedly in agreement about the sewers. An incinerator would be nice, but it seems the cost Li is prohibitive at this time . A motion was made by Commissioner Houston to appoint the Be J. Van Ingen & Company as Fiscal Agents to get necessary data to- gether for the installation of a disposal plant and sanitary sewers, and that Mr. Hodge be notified immediately of this ap- pointment; motion seconded by Commissioner Tubbs, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yea Mayor Eby asked about closing the City Hall. Saturday morning and giving employees a nice holiday week-end for Memorial Day and July 4. He stated that all banks and other City offices in the county would be closed. Commissioner Houston stated that he thought the City Hall should be open Saturday morning for the collection of water bills, that he did not care who was there just so long as the office was open. When you are around as much as I am you will see how many people come in after a holiday to pay their bills. Mayor Eby stated that he thought it would be a nice gesture on the part of the commission to do this; as it is done by other cities and county government.
