The City Commission of the City of Dania, Florida, met in
Regular Session in the Commission Room at the City Hall.

Meeting called to order at 8:00 P. M. by Mayor Eby.
Mayor Eby -stated that Commissioner McMillan requested to be ex-
cused due to a death in the family.
A motion was made by Commissioner Elkins that Commissioner
McMillan be excused; motion seconded by Commissioner Tubbs and
carried.
Minutes of the meeting held May 12, 1958 were read. A motion
was made by Commissioner Tubbs minutes be approved as read;
motion seconded by Commissioner Elkins, and the roll being
called, the following commissioners voted:

Application for transfer of Bar License from Julius Boroski
to Angelo R. Giannantonio, Dania Bar, was presented.
A motion was made by Commissioner Elkins this application be
approved on second reading; motion seconded by Commissioner
Tubbs, and the roll being called, the following commissioners
voted:

Hearing for Objections to paving S. E. Third Avenue, from S. E.
6th Street to S. E. 7th Street, was read.
Mayor Eby called for objections to this paving.
There were no objections.
A Resolution of Necessity for the paving •of-S. E. Third Avenue,
from S. E. 6th Street to S. E. 7th Street was read by Attorney
Walden.
Commissioner Houston asked Attorney Walden if there was a delay
in the paving of this street for several months, would the
passage of this resolution be sufficient?
Attorney Malden advised that it would.

A motion was made by Commissioner Houston this resolution be .

Mayor Eby advised that the hearing for objedtions to pave an .,
alley between S. E. 6th Street and S. E. 7th Street, from S. E.
Second Avenue to S. E. Third Avenue, was continued from the last
regular meeting of the Commission and asked if there were any
objectors to this paving.
Mrs . Runyan, owner of property abutting this alley stated that
she objected to the paving as it would put her home in a hole
and there would be no way for her to get the water out. That
she understood last week when we were having heavy rains that a
boat could be floated in her yard. She was out of town and did
not see it.
Mayor Eby asked Mrs. Runyan if she had considered what she was
going to do with the situation that existed, that something had
to be done to relieve the condition.
Commissioner Houston stated that he did not see where we could
continue the hearing any further, and made a motion that the
Resolution of Necessity for the paving of an alley between S. E.
6th Street and S. E. 7th Street, between S. E. Second Avenue and
S. E. Third Avenue, be passed; motion seconded by Commissioner
Tubbs, and the roll b eing called, the following commissioners
voted:

Commissioner Houston stated that the commission wanted to co-
operate with every one, and not hurt them by making these im-
provements, but that he proposed to offer something later on in
the meeting that he thought would be a solution to part of the
problem existing in this particular location. The objections
will be registered.
Mayor Eby called for objections to the paving of a street from
Gulfstream Road into 30 Acre Park.
There were no objections.
A Resolution of Necessity was read by the Attorney.
A motion was made by Commissioner Houston that the Resolution of
Necessity for paving street from Gulfstream Road to 30 Acre Park
be passed; motion seconded by Commissioner Tubbs, and the roll
being called, the following commissioners voted:

A Resolution of Necessity was read by Attorney Walden.
A motion was made by Commissioner Tubbs the Resolution of Necessity
for the paving of N. W. Second Street, from N. W. 8th Avenue to
N. W. 12th Avenue, N. W. llth Avenue, from N. W. First Street
to N. W. Second Street, be passed; motion seconded by Commission-
er Houston, and the roll being called, the following commission-
ors voted:

A letter was read from Mrs. Helen T. Hurst and Mr. & Mrs. 0. W.
Leach, requesti6gthat steps be taken to require property owners
of low` lying land at N. E. Second Avenue and N. E. Second Street,
to fill this land as it was causing a serious health and sani-
tation problem.
Commissioner Houston stated that we were filling some low lying
land and correcting some of the conditions and creating others.
Some of the lots we have filled are high and dry, and when it
rains the water backs up and other lots are flooded. We dis-
cussed this same thing last year, and at that time I stated
that if these 16ts were filled we would take a sewer line down
to the canal. I do not see where we can do anything until the
lots are filled. The City spent $300.00 last week pumping
water from the low lying lots around town.
Bob Cognetta -- I live in .a duplex south of the American Legion
Hall, it is low, water stands when it rains, and it is infedted
with rats, snakes and lizards. Can anything be done about this
condition?
Commissioner Houston stated that this could be turned over to
' the City Manager for immediate action.
An Ordinance requiring sidewalks to be constructed in the City.
of Dania, was read by Attorney Walden.
Commissioner Houston asked Attorney Walden if the ordinance
required the subdivider to post a bond for sidewalks?
Attorney Walden advised it did.
Commissioner Houston then stated that in his opinion for four
foot sidewalks, the ordinance should state that the bond should
be in the amount of 01.60 per linear foot. Another thing,
could we stipulate in the ordinance that when a building is
erected, sidewalks are to be constructed? This ordinance covers
sidewalks in the entire subdivision, these subdividers can go
in and spot houses all over the subdivision and it might be
years before the sidewalks were put in. In this way we would
be sure. of sidewalks there there are buildings.
A motion was made by Commissioner Houston this ordinance be
passed on first reading, subject to these changes being made
on or before the passage on second reading; motion seconded by
Commissioner Tubbs, and the roll being called, the following
commissioners voted:

Bills for filling lots were presented from C. P. Hill as follows:

A motion was made by Commissioner Houston these bills be paid;
motion seconded by Commissioner Elkins, and the roll being call-

Commissioner Houston stated that sometime ago the Supreme Court
handed down a decision on false arrests by police officers. What
steps can we take to protect ourselves, along with the training
of our officers. I can see where this can be done very easily.
Attorney Walden advised that the city .should have insurance
coverhge, ,as they are responsible for any police officer.
Commissioner Houston stated that Attorney Walden should check
on this immediately and find out what we can do in regards to
this matter, if anything.
Commissioner Houston stated that another thing he had been think-
ing about was a decision rendered by the Judge a short time ago
where a party stepped into a meter box in the City of Hollywood.
That it was his understanding that the meters and boxes were not
the property of the city after they were installed. I know some-
time ago we discussed ownership of meters. What I want to know
is -- are we liable for something like what happened in Hollywood?
If that happened to us, I am afraid the commissioners would not
get paid for a few months, and that would be bad. I would like
to see the attorney check on this also, andrreport to us as soon
as possible .
Commissioner Houston stated that the Garden Club had agreed to
take over the project offered them by the Commission to beautify
the cemetery. They are going to raise a lot of plants, and there '
is no way to protect them at the cemetery. When we rebuilt the
ball park we did not use all the chain link fence fromtthe old
one, I would like to see the City Manager put this fence up on
the west side of the new maintenance building at the cemetery,
and put in a gate, and turn the key over to the Garden Club,
in this way they can have some protection for their plants . This
should be' done immediately so they can get started.
Commissioner Houston stated that at the last meeting it was sug-
gested that we have a larger packer truck here for demonstration
to see if that was what we needed. This past week we had one
here and I followed it around, and I did not- think it was possible,
but they finished at 2:00 o'clock in the afternoon. I think we
should go ahead and advertise for bids forithis type of packer,
trading in the old one . I believe with this additional facility
and the effective manner in which it works, we will not need an
additional truck for a few years.
Mayor Eby stated that he saw the truck right after 4:00 P. M. and
they were on the next days work.
A motion was made by Commissioner Houston authorizing. the City
Manager to advertise for bids for a 16 yard packer, complete with
chassis, with a trade in of the Reo Packer, bids to be received is
until 8:30 P. M., Monday, July 72 1958; motion seconded by Com-
missioner Tubbs, and the roll being called, the following com-
missioners voted:

Commissioner Houston stated that we have heard a lot about
surface water, storm drainage and sewers. That he had an idea
that he thought was practical and feasible, however, it was up
to the engineers to tell us if it is possible to do it. One of
our problems is in the northeast section of the city. Another
is S. E. Second Avenue . We agreed that some way should be pro-
vided for sanitary sewers if we can afford them. We should
bear in mind at the same time the need for storm sewers to some
extent for the east side of the city. The State Road Department
installed catch basins in the middle of the block off Federal
'Highway when it was widened. If we could continue this line
' to Second Avenue, then up Second Avenue to where we have a 36
inch storm sewer to the San Soucy apartment on East Dania Beach
Boulevard. The Streets will be torn up and it will be a good
time to do something about storm drainage. There is not a line
in front of the Hotel or Lobster House. The line from Frost
Park along Fronton Boulevard is overtaxed now, but we could put
a pump at the end of the line to pull the water through. If we
are going to tear up the streets and alleys we might as well
lay a storm sewer if at all possible.
I would like to get together with the commission at a special
meeting and see what solution we can come up with. We went
into this a year ago and the only thing holding it up at this
time seems to me to be the filling of low lying lots. This
will not take care of all our problems, but it will give some
relief. We had quite a problem on S. E. 13th Terrace last week.
We went in there and put in fill and graded a shoulder and re-
lieved the situation.
Mayor Eby stated that we would have to first authorize an engineer
to prepare drawings to see if this is feasible . If the lines on
Beach Boulevard are overloaded, they may come up with something
else . The natural slope of the land is to the south. It seems
to me that the sewer should be from the Legion Hall north to the
' Dania Cut-Off canal. Thellong range planning should be for sur-
face drainage as well as sewers. But first we have to get the
water into the street before the sewers do any good.
Commissioner Houston stated that the line he spoke of on S. E.
Second Avenue would not take care of S. E. 4th Avenue or S. E.
5th Avenue. It would only take care of water from Federal
Highway down to Second Avenue.
Mayor Eby suggested a special meeting with the Fiscal Agent
sometime this week so that work could be started as soon as
possible on this project.
Commissioner Houston stated that Porter Reynolds, Landscape
Architect, had presented a preliminary plan for a new entrance
to the cemetery, and he thought we could advertise for bids for
the work.
A motion was made by Commissioner Tubbs to advertise for bids
for entrance to Dania Memorial Park Cemetery, to be received
until 8:30 P. M. , Monday, July 7, 1958; motion seconded by Com-
missioner Elkins, and the roll being called, the following com-
missioners voted:

Commissioner Houston stated that some areas in the city is still
being farmed, and he would like to see the City Manager see that
this land is disced and dragged before they get out. If this
is not done, have the city do it and assess the owners for it.

Commissioner Houston stated that something had to be done about
storm drainage as Mr. Eby said. So we might as well plan on it.
Take for instance the Runyan home -- it has probably been there
30 years, at that time nothing was thought about elevations when
a building was started at that time. We are going to have to
raise elevations in that area and some one has to get hurt. It
might be possible to pour a 6 inch floor in this house to raise
the floor level -- I do not know. That is one of the things we
will have to find out from the engineers.
Mayor Eby stated that several months ago we advertised for and
agreed to purchase a bookkeeping machine. We have been to Ft. 1
Lauderdale, to see their system in operation. Forms have been
ordered, and the only hold up now seems to be whether we are
going to use a typewriter machine or not. The Burrough's man
has contacted me several times and would like to know something.
Commissioner Houston stated that we apthorized the City Manager
to contact the Auditor and see if there was going to be a saving
in their time and fees if we go into this type of bookkeeping.
Mayor Eby stated that he did not think there would be a reduction
in the fee of the Auditor. The difference would be -- you will be
getting an audit rather than an auditor rendering a bookkeeping
service. The books will be in shape for an audit should you need
one for a fiscal agent for a bond issue. All places are getting
away from the old Boston ledger system of accounting, and putting
in modern machine bookkeeping. In this way all transactions go
throughtyour books, the way we have now you do not know how much
water is billed, only how much collected for. The prime factor
will be to get the books set up, then the auditors will only have
to come in say four times a year, or what ever we want. That will
have to be worked out between the commission and the auditors.
City Manager Malley stated that Mr. Lindfors told him after the
machine wa,s in operation they would not have to spend as much time ,
in the office, they would only be auditing, not bookkeeping.
That the bookkeeping would be done by our employees.
Commissioner Houston stated that we were told if we put in this
machine it would take care of everything. We put in a cash reg-
ister, and we were told to run every thing through that, and all
our worries would be over. I question this machine due to the
size of our operation. I can see it for a place like the bank
having a use for them We can go ober board with machines. We
discussed whether we needed a typewriter or not -- and decided
against it. I cannot see paying the auditors an additional $2,600
or $2, 700 over and above the $100 retainer fee and buying this
machine - We were told there would not be any less time spent in
the office. This is the first I have heard about coming only
4 t ime s a year..
Mayor Eby stated that he would like to have Mr. Malley check again
with the auditors, but that he personally could not see where there
would be any less time spent in the office. I would like to see
something done, it has been hanging fire for a long time. The
forms to be used on the machine have been printed.
Mayor Eby asked City Manager Malley to check with Mr. Lindfors
again and we can bring it up at a special meeting and make some
decision. '
There being no further business, on motion and vote, the meeting
adjourned.
