PRESENT WERE: MAYOR COMMISSIONER FRANK E. EBY E. B. ELKINS ROBERT E. HOUSTON JAMES J. MCMILLAN E. S. TUBBS, JR. CITY ATTORNEY CLARKE WALDEN CITY CLERK MARY THORNHILL Meeting called to order at 12:00 o' clock noon by Mayor Eby for the purpose of canvassing the votes of the Primary Election held October 14, 1958. The City Clerk presented results of election as certified to by the duly appointed election boards as follows: E. B. ELKINS 434 TED KAY 172 GEORGE W. KELLY 394 EUGENE D. PANELLA 143 CLARENCE PARKHURST 135 H. A. RICKARDS 349 RUSSELL E. SEAY, JR. 630 LUTHER SPARKMAN 379 DONALD A. WELLS . 350- CARL ZENOBIA 105 The commission finds and "certifies that the results of the votes cast by the duly qualified electors voting at said Primary Election was correct and accepted the tabulation of the duly appointed election boards. DATED THIS 15th DAY OF OCTOBER, 1958, A. D. MAYOR-COMMISSIONER �c COMMISSIONER COMMISSIONER COMMISSIONER A motion was made by Commissioner McMillan that results of the Primary Election As certified by the duly qualified clerks and inspectors be accepted; motion seconded by Commissioner Elkins, and the roll being called, the following commissioners voted: Elkins Yes Houston Yes McMillan Yes Tubbs Yes Eby Yes Commissioner Houston advised the commissioners that he had been informed that the owners of the golf course on Stirling Road were negotiating for the purchase of ten acres adjacent to the golf course for the expansion of the course. This ten acres is within the city limits. Sometime ago the commission passed an ordinance establishing the right-of-way for the ex- tension of 12th Avenue, from Stirling Road to Broward Road, this right-of-wayto be 35 feet. This is a section line road as well as the west city limits. If the golf course is extend- ed as planned it will take in the right-of-way for this street. I feel that the owners of the golf course should be made aware of the fact as we are going to have to do something right away about this street as the 'new Collins school is going to be ready to open soon. The County Commission will have to obtain the right of way for the west side of .this street as it is not in the city limits. Mayor Eby suggested that Attorney Walden be authorized to con- tact the owners of the golf course and make them aware of the fact and to negotiate with them for the right-of-way, ss we have to get it, even if we have to go through condemnation proceedings. Attorney Walden advised that Ordinance No. 372 passed on final reading the 18th of March, 1957 established the right-of-way for the extension of 12th Avenue, from Stirling Road to Broward Road. It was a part of the street widening program for the City of Denis. It was agreed by all commissioners preset t to authorize Attorney Walden to negotiate with the owners of the golf' course for the right of way for the extension of 12th Avenue, and if no agree- ment can be reached, to start oondemnation proceedings. Commissioner Houston advised the commission that Mr. George ' Polera, a member of the County Planning and Zoning Board had advised him that a request for industrial zoning for property . between the west city limits of Dania and the Seaboard Railway was on the agenda at their meeting tonight for a public hear- ing. Inasmuch as we have been considering annexing this area he thought the commission would like to have a voice in the proposed change. The people that own homes in this area do not want industrial zoning. Commissioner Houston .wss authorized to attend this hearing and advise the board that the City Commission wishes the zoning to remain as it is.
