' Anm adjourned meeting of the City Council of the City of Dania Florida was held Monday December 12th A.D.1927 at 7:30 P.M.in the City Hall, pursuant to adjournment of the meeting held Friday December 9th A.D.1927 at 7:30 P.M. The following were present: Arthur C. O'Hea, Mayor John B. Gregory, Councilman J.M.Holding, Councilman F.L.Neville, Councilman O.S.Peok, Councilman. Councilman M.C.Frost was abaent from the meeting. The following also were present: Raymond T. Skinner, City Clerk T.D.Ellis, Jr. , City Attorney. ` Mayor O'Hea called the meeting to order. Councilman Gregory reported that he had conferred with M.C. Frost and that the latter had said he thought he would have his affairs in shape so he could serve on the council in a short time. Councilman Holding offered a resolution asking that the depository for the Bond money and sinking funds of the City of Dania be required to give bond insuring the deposits and to pay interest on these deposits. He moved the adoption of the resolution. There being no second to the motion, it was lost, and no action was taken in the matter. The City Clerk then read Ordinance No.19 which is as follows: ? AN ORDINANCE No. 19 AUTHORIZING THE SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY 'PO USE THE PUBLIC STREETS OF THE CITY OF DANIA FLORIDA FOR THE PURPOSE OF PLACING POLES AND ELECTRICAL CONDUCTORS THEREIN. BE IT ORDAINED by the City Council of the City of Dania,Florida: Section 1. That permission be and the same is hereby granted to j the Southern Bell Telephone and Telegraph Oompany, its successors and assigns, to erect, operate and maintain lines of telephone and telegraph, including the necessary poles, fixtures and electrical conductors upon, along, under and over the public roads, streets, and highways of the City of Dania, Florida, as its business may from time to time require, provided that all poles shall be neat and symetrioal. Section 2. That the work of erecting poles by virtue of this ordinance shall be done under the supervision of the street committee and the said Southern Bell Telephone and Telegraph Company shall replace and properly relay any sidewalk or street that may be displaced by reason of the erection of such poles, and upon failure of the Company to do so, after twenty days ' notice in writing shall have been given by the Mayor of said City to said Company, the City may repair such portion of the sidewalk or street that may have been disturbed by said company, and collect the cost so incurred from said Company. Section 3. That in consideration of the rights and krivileges herein granted, said company shall, upon demand, provide space for one cross arm on each pole, on which the said City may desire to attach either fire alarm telegraph or police telegraph wires for the free use of the police and fire alarm telegraph system of the said City; provided however, that no use shall be made of such space by said City which will result in interfering with or impairing the operation or use of said Company's property or service or will endanger the property or employees of said Company. �ir Section 4. That said Company shall at all times be subject to the City Ordinances now in existence or which may hereafter be passed relative to the use of the public streets by telephone and telegraph companies. Section 5. That said Company shall indemnify the said City against, and assume all liabilities for damages which may arise or accrue to said City from any injury to persons or property from the doing of any work herein authorized, or the neglect of said company or any of its employees to comply with any ordinance relative to the use of the streets of said City, and the acceptance by the Company of this ordinance shall be an agreement by it to pay to the said City any sum of money for which the City may become liable from or by reason of such injury. Section 6. That said company 'shall file with the City Clerk of the said City its acceptance of this ordinance within sixty (60) days from date when it shall take effect. Section 7. That this ordinance shall be in force and effect for a term of thirty (30) years from and after its passage, and the said City hereby reserved the right and requires the said Company as a condition precedent to the taking effect of this grant, to give and grant to the City of Dania the right, at and after the expiration of such term, to purchase the telephone and telegraph lines or other property in said City used under or in connection withthis grant, or such part of such property as the municipality may desire to purchase at a valuation of the property real and personal, desired, which valuation shall be fixed by arbitration, as may be provided by law; and the acceptance of this ordinance shall operate as a grant by the said Company to the City of said right to purchase. Section 8. This ordinance shall take effect upon its passage and approval by the mayor. Skinner, City Clerk, hereby certify that the above is a true and correct copy of an ordinance passed at a meeting of the City Council of the City of Dania, Florida, held on the 12th Day of December 1927 and approved by the Mayor of said City on the 12th Day of Deoember,1827. City Clerk Councilman Gregory moved that the ftrm:txmi& second and third readings be waived and the ordinance be placed upon its final passage The motion was seconded by Councilman Neville and upon roll call the council voted as follows: Councilman Gregory, Aye Councilman Holding, Aye Councilman Neville, Aye Councilman Peck Aye Those voting Nay, None Councilman Peck made a motion that the ordinance be passed as read. The motion was seconded by Councilman Neville and upon roll call, the council voted as follows: Councilman Gregory, Aye rti, ; Councilman Holding, Aye Councilman Neville, Aye Councilman Peck, Aye Those voting Nay, None Whereupon the Mayor attached his signature to the ordinance and it became ordinance No. 19 of the ordinances of the City of Dania, Florida. Councilman Neville made a motion that the bill of Thompson, Wood & Hoffman for 5�100t00 for an approving opinion on the V60,000.00 bond issue be paid. The motion was seconded by Councilman Gregory and upon vote being taken the motion carried unanimously. GouncilmenPeok made a motion that the Municipal Investment Corporation be paid a commission of �1,500.00 for selling the Dania bonds as soon as the bond money arrives. The motion was seconded by Councilman Neville and upon being put to a vote of the council the motion was carried unanimously. Councilman Holding made a motion t$at T.D.Ellis Jr. , be paid §1,370.25 as soon as the mond money arrives, for services in having the bonds validated and approved. The motion was seconded by Councilman Neville and upon being put to a vote of the council the motion was carried unanimously. Councilman Gregory made a motion that the City Manager be authorized to proceed with the water works extension under the contract held by the M.E.Hoffman Construction Co. as soon as the bond money arrives. The motion was seconded by councilman Neville and upon being put to a vote of the council was unanimously carried. Councilman Gregory made arma a motion that the sum of y250.00 be transferred from the capital fund to the general fund for the purpose of cleaning the lots along the Dixie Highway. The motion was seconded by 8ouncilman Peck and upon being put to a vote of the council was carried unanimously. Councilman Peck made a motion to adjourn until Thursday Dec. 29th at 7:30 P.M.
