HomeMy WebLinkAbout97016 - MINUTES - City Commission MUIUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF DANIA FLORIDA HELD FRIDAY FEBRUARY loth A.D.1928 at it 7;30 2.14. An adjourned meeting of the City Council of the City of Dania, Florida was held Friday evening February loth A.D.1928 at 7:30 P.I,;. in the City Hall. The following were present: Arthur C. O 'Hea, Mayor T.R.Brown, Councilman John B. Gregory, Councilman J.IA.Holding, Councilman O. S.Peok, Councilman Councilman F.L.Neville was absent from the city. The following also were present: Raymond T. Skinner, City Clerk T.D.Ellis, Jr. ,City Attorney. Mayor O'Hea called the meeting to order. The minutes of the regular meeting held January 3rd, 1926 and the adjourned meetings held January 5th, 19th, 23rd and 26th were read and approved. Mr. Frank 11. Fleetwood of the Lauderdale News appeared before the council and asked that the city take a page advertisement in t the harbor edition of the News. Following a discussion Councilman Peck made a motion that the city take a page advertisement in the Ft. Lauderdale News and the Hollywood News. The motion was seconded by Councilman Brown and upon being put to a vote of council was unanimously carried. Mayor O'Hea announced that he had been appointed on the finance committee for the Harbor Celebration to be held Feb. 22nd and said ... that Dania's portion of the expense had been placed at �500.00. Councilman Holding made a motion that �1500.00 be appropriated from the Capital Fund to nx=t be transferred to the Port Authority for the erection of a permanent sign board marking the entrance to the harbor, as Dania's contribution to the fund. The motion was seconded by Councilman Gregory and upon being put to a vote was unanimously carried. The City Clerk, read the following resolution entitled : A RESOLUTION CONFIRLIING LOCt..1 ASSESSLIENT ROLL FOR 10011 ILIPROVELMIT NO.2 WITHIN THE CITY OF DISIA,FLORIDA. WHEREAS the assessment roll for local improvement No. 2 of the City of Dania, Florida had been completed and submitted to the City Council on the 26th day of January A.D.1928, and WHEREAS at s meeting of the City Council held on said date of January 26th, 1926, the City Council passed a Resolution confirming a resolution ordering Local Improvement No. 2 and instructing the City Clerk to cause publication to be made of said assessment roll for said improvement in two issues of THE RECORD a newspaper p published in the City of Dania, Florida, and to attach to said assessment roll a notice to Property owners that & hearing would be held by the City Council on the loth day of February A.D.1928 at 7:90 o 'clock P.Li. in the City Hall to hear and consider complaints from property owners upon said assessments as provided in said assessment roll,and WHEREAS the City Clerk has caused said assessment roll and said notice to be published in two issues of THE RECORD a newspaper published in the City of Dania, Florida, and ';IHEREZ3 the City Council in meeting now assembled as an equalizing board to hear and consider any and all complaints as to such assessmen- to has had no complaint& as to said assessments brought to the attention of the City Council, now, therefore t � BE IT RESOLVED by the City Council of the City of Dania, Florida: Section 1. That the assessments of property for Local Improvement No. 2 as set forth in the assessment roll for Local Improvement No. 2 of the City of Dania, Florida, copy of which is hereto attached, be and the same are hereby confiemed and approved, and said assessments are declared to be liens upon the property which such assessments are made until paid in accordance with the conditions stated in said assessment roll, provided, howener, that upon the completion of said improvement the City of Dania shall rebcto to the owner of any property which shall have been specially assessed for said improvement the difference in the assessment as originally made a now approved and confirmed, and the proportionate part of the actual cost of said improvement to be paid by special assessment as shall be finally determined upon the completion of said improvement and payment therefor -by the City of Dania, Florida. ' Section 2. This resolution shall be in force and take effect from and after its adoption. Passed and adopted this loth day of February A.D.1928. Approved: Mayor Mayor City Clerk Councilman Holding made a motion that the resolution be adopted as read. The motion was seconded by councilman Peak and upon being put to a vote of the council was unanimously adopted. The City Clerk then read the following resolution entitled: A RESOLUTION AUTHORIZING THE MLYOR AND CITY CLERK I9 THE CITY OF DdNIA FLORIDA 10 EXECUTE A RENEWAL NOTE OF THE CITY OF DANIA IN THE nJOUNT OF FIVE THOUSAND DOLLARS ( $5,000.00) TO DANIA BANK AND TRUST COmpitITY. BE IT RESOLVED by the City Council of the City of Dania, Florida: Section 1. That the Mayor and. City Clerk be and they are hereby authorized and directed to execute a renewal note of the City of Dania, Florida, in the amount of Five Thousand Dollars, ($5,000.00) to the Dania Bank & Trust Company, payable ninety days after date , in order to renew the note of the City of Dania, Florida in the sam said sum dated November 2nd, A.D.1927, due and payable to said Dania Bank & Trust Company on February 2nd, A.D.1928. Section 2. All Resolutions or parts of Resolutions in oomflict herewith are repealed hereby. Section 3. This resolution shall take effect from and after its passage and adoption and its approval by the mayor. Passed and adopted this loth day of February A..D.1928 Approved: Mayor s ; Idayor City Clerk Councilman Gregory made a motion that the resolution be adopted as read. The motion was seconded by Councilman Brown and upon being put to a vote of the council the resolution was unanimously adopted. The City Clerk then read the following ordinance entitled: AN ORDINI ;CE PROVIDING FOR THE SUPPRESSION AND PROHIBITION OF STRAY ANIBIALS GND FOVILS lND THE SALE OF STRAY ANIIiAL8 AND FOWLS. BE IT ORDAINED by the council of the City of Dania, Florida: Section 1. No mule, cow,horse, hog, sheep,goot,bovine or other animal shall be permitted to run at large within the City of Dania i now shall any chickens, ducks, geese, turkeys, guineas or other domestic fowls be permitted to run at large within the City of Dania. Any such animal or fowl described herein which may be found running at large within said Bity of Dania mey be caught and held by any policeman or authorized agent of the Police Department. Section 2. The owner of any animal or fowl caught or imprisoned as aforesaid shall be entitled of the possession of said animal or fowl upon proof of ownership and payment of one Dollar (*1.00 ) together with accrued costs. Said costs shall consist of necessary expenses for the catching of said animal or fowl and for the feeding of said animal or fowl while in the custody of the City of Dania. Section S. When animals or fowls are caught, notice shall be posted for a period of ten (10) days on the bulletin board in the City Hall, giving the owner the privilege of redeeming the same by paying all Nees and expenses including feeding which shall be taxed up as costs and collected from the person redeeming or buying such animal or fowl, and all of said fees shall be paid to the City Clerk. Section 4. In case the owner of any animal or fowl shall fail to redeem the same after notice has been posted for ten (10) days as provided herein the Chief of Police shall sell such animal or fowl at public auction. r Section 5. Any fix person, firm or association who shall be guilty of violation of any of the provisions of this Ordinance and shall permit any animal or fowl to become a nuisance and damage property, shall upon conviction before the mayor be subject to a fine of not more than twenty-five dollars (W.00) or imprisonment for not more than one (1) day, or by both such fine and imprisonment within .;. the discretion of the mayor. Section 6. This ordinance shall take effect and be in force from its passage as provided by law. Section 7. All Ordinances or parts of Ordinances in conflict heretith are repealed hereby. Passed and Adopted this loth day of February A.D.1928. Attest: Mayor City Clerk Councilman Brown made a motion that the second and third readings of the ordinance be waived. The motion was seconded by Councilman Peck and upon roll call being taken the council voted as follows: Councilman Gregory, Aye Councilman Brown, Aye Councilman Holding, Aye Councilman Peck, aye Those voting nay, Done Councilman Brown made a motion that the ordinance be adopted as read. The motion was seconded by councilman Peck and upon roll oall the council voted as follows: Councilman Gregory, Aye Councilman Brown, aye r- Councilman Holding, P.ye Councilman Peck, Aye -` Those voting nay, None ua:": Whereupon Mayor O'Hea affixed his signature to the ordinance and it became ordinance No. 21 of the Ordinances of the City of Dania Florida. Councilman Gregory made a motion that the City Manager be authorized to advertise for bids ffi on sidewalks on First Avenue north west to second street northwest and First Avenue southwest to Third street South West and all cross streets connecting with the Dixie highway. The motion was seconded by Councilman Holding and upon being put to a vote of the council was unanimously adopted. Officer Floyd Robinson appeared before the council and asked that the City purchase a new uniform for him. Councilman Gregory made a motion that the city purchase the uniform. The motion was seconded by Councilman Brown and upon being put to a vote of the council was unanimously carried. The motion was seconded by Councilman Holding and upon being put to a vote the motion was unanimously adopted. Councilman Gregory Made a motion that council adjourn until Monday March 5th at 7:30 P.Iii. The motion was seconded by councilman Brown and upon being put to a vote was unanimously carried.
