Call to Order Chairman Clive Taylor called the meeting to order at 6:00 p.m. 2. Approval of Minutes of August 20, 2008 The minutes of August 20, 2008 were approved by unanimous vote. 4. Reports and Discussion 4.1 Derelict Vessel Report Deputy Jason Riddle reported that the State Grant from the Clean Water Act to move and dispose of derelict vessels is now under contract for removal. He noted that he is also trying to find the last registered owner of several derelict barges that are located in the estuary on the south side upon entering the Dania Cut-Off Canal from the Intracoastal side. These barges can still be used and are thought to belong to a company that operates out of Dania. 4.2 Marina Update—Captain Jay Jackson Captain Jay Jackson, Dockmaster,reported: 1) the Marina purchased a Honda Portable Generator with a 2,000 gallon per hour Sump Pump; 2) City Officials executed the transfer of the FAU i almost 100% full and will be Lease on September 5 2008• and 3 Fixed Dockage s Marina p ) g 100% full by the end of the month. Chairman Taylor read a memo from Frank Herzhold, Director of Marine Industries, regarding the FIND Derelict Vessels Program. He thought this funding may be available for the City of Dania Beach. Chairman Taylor provided the memo to Deputy Riddle. 5. Old Business Chairman Taylor reported on the Punk Rocks located under the bridge by 595. He said he and Mike Grady went before the County Board but there was not much interest. He then contacted Frank Herzhold and told him the problem and he indicated that perhaps they could assist with some funding. He noted the state and county have jurisdiction and perhaps a letter from the City, or Marine Advisory Board, be sent to the County, attention John Fiore, requesting they look into the matter. 6. New Business Chairman Taylor noted that Hollywood would begin renting non-motorized sailboat spots on the beach on a trial basis. The City of Ft. Lauderdale also allows this. He thought Dania Beach might consider this for the north end of the beach. Chairman Taylor suggested a Life Guard attend the next meeting to discuss the proposal of boat storage for the beach. Gary Rowe suggested the Board study the area to determine the feasibility of the boat turnaround area and trailer parking before bringing this to the City Commission for action. 7. Board Member Comments The Board discussed barges and derelict vessels that are anchored in Hollywood and Broward County waterways. The Board concurred that this should be brought to the attention of DNR. 8. Ansbro, City Attorney DATE: September 30, 2008 RE: Proposed Change to City Ordinance Entitled "Flood Damage Prevention"; New Regulations for "Marinas" In April, 2005, the City s "Flood Damage Prevention Ordinance (Chapter 12 of the City Code of Ordinances) was amended and updated in a number of respects to comply with suggestions made by FEMA representatives. One of the principal changes had to do with raising the "lowest floor" requirement (this includes the lowest floor of the lowest enclosed area for a building, even a basement of a building, with certain exceptions, such as garages and storage areas). At FEMA's suggestion, the City raised the requirement so that a new or substantially improved building would have to be constructed with the lowest floor at least one foot higher than what the Flood Insurance Rate Map for a particular area would require (usually between four feet and seven feet above mean sea level). City staff, including Mayor Albert Jones and City Commissioner Bob Anton, met with FEMA representatives last Friday, September 26, 2008. It was discovered that marinas need not be subject to the "FEMA plus one foot" requirement, if the City chose to amend its flood ordinances. Since marinas are expected to undergo renovations, including the Banyan Bay Marina, the City intends to amend the ordinance, to provide a requirement that either allows for an elevation to meet only the maximum FEMA requirement, or "FEMA plus one inch", possibly. Since a definition has to be created for a"marina", I drafted a definition to read as follows: "Marina" means a facility with access to navigable waters that provides moorings or places for storage of boats and may include associated uses such as repair and service facilities, offices, retail sale of supplies, equipment and sundries and restaurants. A marina may be a principal use of the site upon which it is located or it may be an accessory use to a principal residential use. The definition is based in part on a definitions of marinas in Webster's Dictionary and dictionaries used by planners. I expanded it to identify some, but not all, "related uses". TJA:slw 2 ORDINANCE NO. 2008- AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA PERTAINING TO FLOOD REGULATIONS; AMENDING CHAPTER 12, "FLOOD DAMAGE PREVENTION" OF THE CITY CODE OF ORDINANCES TO CREATE A DEFINITION FOR THE TERM "MARINA" (SECTION 12-5, "DEFINITIONS") AND CREATING A SPECIFIC BASE FLOOD ELEVATION FOR MARINAS (CODE SECTION 12-52 "SPECIFIC STANDARDS'; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Section 12-5, "Definitions" of the City Code of Ordinances is amended to read as follows: "Marina" means a facility with access to navigable waters that provides secure moorings or places for storage of pleasure boats and similar vessels, including related uses such as repair facilities, offices, retail sale of marine supplies, equipment and sundries and restaurants, but excluding any residential use". Section 2. That Section 12-52 of the City Code of Ordinances is amended to read as follows: Sec. 12-52. Specific Standards. In all areas of special flood hazard where base flood elevation data have been provided, as set forth in section 12-7 or section 12-32 (k), the following provisions are required: (6) Marinas. New construction or substantial improvement of any marina shall have the lowest floor, including basement, elevated no lower than one inch (1") above the base flood elevation as specified on the Flood Insurance Rate Mai Buildings such as dry stack facilities and other elevated buildings to be constructed or improved are permitted under the provisions of Section 12-52 (3), below. Section 3. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed. Section 5. That this Ordinance shall be effective immediately at adoption on second reading. PASSED on first reading on 2008. PASSED AND ADOPTED on second reading on 2008. ALBERT C.
