Motion passed unanimously. APPROVAL OF MINUTES Approval of Minutes for the January 16, 2008,Planning and Zoning Advisory Board Meeting. Hearing no further discussion, a motion was made by Patrick Schilling, seconded by Edward Bourgeois to recommend approval of the minutes for the January 16, 2008, Planning and Zoning Advisory Board Meeting. Motion passed on the following roll call: Edward Bourgeois — yes Patrick Schilling — yes Paul Fetscher — yes Acting Community Development Director, Corinne Lajoie, AICP, addressed the board to introduce the Department's newest staff member, Associate Planner, Kristin Dion. PLANNING AND ZONING BOARD ITEMS Chairman Fetscher recognized board member, Lottye Crooms as in attendance at 7:05 pm 1) VA-01-08 — Variance request by Alex Williams to allow a monument sign at the Seventh Day Adventist Church located at 134 NW 12th Avenue, Dania Beach, in an area zoned RS-6000 Residential. (Chapter 28, Zoning Article 28 Signs, Section 28.090 Identification sign. Does not allow the construction of a monument sign in residential districts zoned RS-6000.) Kristin Dion, Associate Planner, addressed the board to describe the variance request for a sign at the Seventh Day Adventist Church. Ms. Dion described the location of the proposed sign, allowed code regarding signs in the RS-6000 zoning district. Ms. Dion indicated that recommendation is being left to the board's discretion. Planning and Zoning Advisory Board Meeting 1 Minutes February 20,2008 Mr. Alex Williams addressed the board regarding the request for construction of the proposed sign. Mr. Williams indicated that the sign was inadvertently purchased larger than allowed by the code. Chairman Fetscher opened the item for public comment. p Raymond Smith 236 NW 7th Avenue spoke in favor of the church stating that it would bring not only beauty to the community, but would let the community know all of the positive things the church is doing in the community. Hearing no one and seeing no one further the public hearing was closed. Chairman Fetscher commented on how important bringing positive messages are to the community. After further discussion regarding the location of the sign, a motion was made by Lottye Crooms to recommend approval of variance VA-01-08, seconded by Edward Bourgeois. Motion to approve passed on the following roll call: Edward Bourgeois — yes Lottye Crooms — yes Patrick Schilling — no Paul Fetscher — yes 2) Zoning Text Amendments: a) Administrative Variance Procedures: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO ZONING; REPEALING SECTION 10-15 (ENTITLED "ADMINISTRATIVE VARIANCE PROCEDURES") OF CHAPTER 28, "ZONING", OF THE CITY CODE OF ORDINANCES; CREATING A NEW ARTICLE IV-A TO BE ENTITLED "ADMINISTRATIVE VARIANCE PROCEDURES" TO BE PLACED IN CHAPTER 33, THE "ZONING APPENDIX" OF THE CITY CODE OF ORDINANCES, TO PRESCRIBE REVISED CONDITIONS GOVERNING SUCH VARIANCES WHICH ARE GRANTED BY THE DIRECTOR OF COMMUNITY DEVELOPMENT WITHOUT REVIEW BY THE PLANNING AND ZONING BOARD AND THE CITY COMMISSION, SUBJECT TO CERTAIN LIMITATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Corinne Lajoie, AICP, Acting Community Development Director addressed the board describing the proposed text amendment revising the administrative variance procedures. Ms. Lajoie described each of the changes and that notices will still be made notifying the public. Chairman Fetscher recognized board member, Angeline Flowers as in attendance at 7:1 S pm. Chairman Fetscher opened the item for public comment, hearing no one or seeing no one the public hearing was closed. Planning and Zoning Advisory Board Meeting 2 Minutes February 20,2008 Chairman Fetscher indicated that he had reservations recommending approval, as this change diminishes the power of the Planning and Zoning Advisory Board. Motion by Patrick Schilling to recommend approval of the Administrative Variance text amendment, seconded by Edward Bourgeois. Motion to approve passed on the following roll call: Edward Bourgeois — yes Lottye Crooms - yes Angeline Flowers — yes Patrick Schilling — yes Paul Fetscher — no b) Pervious and Impervious Areas: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO ZONING; REPEALING ARTICLE 29 (ENTITLED "PERVIOUS AND IMPERVIOUS AREAS") OF CHAPTER 28, "ZONING", OF THE CITY CODE OF ORDINANCES; CREATING A NEW ARTICLE 3 TO BE ENTITLED "IMPERVIOUS LAND AREA REQUIREMENTS" TO BE PLACED IN CHAPTER 33, THE "ZONING APPENDIX" OF THE CITY CODE OF ORDINANCES, TO PRESCRIBE NEW REGULATIONS GOVERNING PERVIOUS AND IMPERVIOUS AREAS OF LAND WITH THE CITY; ESTABLISHING CERTAIN PERCENTAGES OF AREAS OF LAND REQUIRED TO BE PERVIOUS, BASED UPON ZONING DISTRICTS AND PROVIDING FOR WAIVER OF SUCH REQUIREMENTS UNDER LIMITED CIRCUMSTANCES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Corinne Lajoie, AICP, Acting Community Development Director addressed the board describing the text amendment amending the pervious area requirements. Ms. Lajoie indicated that the amendment would reduce the pervious area requirements, breaking it down further for certain zoning districts, which would reduce the need for waivers. She further indicated that the amendment would still require engineering concerns relating to pervious/impervious areas to be addressed. Chairman Fetscher opened the item for public comment, hearing no one or seeing no one the public hearing was closed. Motion by Edward Bourgeois to recommend approval of the text amendment to the Pervious and Impervious code section, seconded by Angeline Flowers. Motion to approve passed on the following roll call: Edward Bourgeois — yes Lottye Crooms - yes Angeline Flowers — yes Patrick Schilling — no Paul Fetscher — no Planning and Zoning Advisory Board Meeting 3 Minutes February 20,2008 c) Site Plans, Special Exceptions, Variances and Appeals Planning and Zoning Board Authority: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO ZONING; AMENDING SECTION 8-4 (ENTITLED "SITE PLAN AS CONDITION TO BUILDING PERMIT") OF THE CITY CODE OF ORDINANCES TO ADD CONDITIONS APPLICABLE TO THE EXPIRATION OF SITE PLAN APPROVALS AND TO CHANGE THE SPATIAL REQUIREMENTS FOR BUILDING ADDITIONS WHICH ARE EXEMPT FROM SITE PLAN REVIEW; AMENDING SECTIONS 10.12 ("SPECIAL EXCEPTIONS"), 10.13 ("VARIANCES") AND 10.30 ("APPEALS") OF CHAPTER 28, "ZONING", OF THE CITY CODE OF ORDINANCES TO ADD CONDITIONS APPLICABLE TO THE EXPIRATION OF SPECIAL EXCEPTIONS, VARIANCES AND APPEALS; CREATING ARTICLE IV-B OF CHAPTER 33, KNOWN AS THE "ZONING APPENDIX" OF THE CODE OF ORDINANCES, TO GRANT AUTHORITY TO THE PLANNING AND ZONING BOARD TO APPROVE VARIANCES PERTAINING TO SINGLE-FAMILY HOMES (EXCLUDING MARINE-RELATED STRUCTURES) AND TO APPROVE BUILDING ADDITIONS SUBJECT TO CERTAIN RESTRICTIONS, AND PROVIDING FOR EXPIRATION OF APPROVALS OF VARIANCES, SPECIAL EXCEPTIONS, APPEALS AND SITE PLANS, AS WELL AS EXTENSIONS OF THE FOREGOING SUBJECT TO CERTAIN LIMITATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Corinne Lajoie, AICP, Acting Community Development Director addressed the board describing the proposed text amendment revising the regulations for site plans, variances and special exceptions, and granting final approval authority to the Planning and Zoning Board for certain variance and site plan requests. Chairman Fetscher opened the item for public comment, hearing no one or seeing no one the public hearing was closed. Motion by Edward Bourgeois to recommend approval of the proposed text amendment, seconded by Patrick Schilling.
