Motion passed unanimously. PLANNING AND ZONING BOARD ITEMS 1. SP-50-07 — Request by Manny Synalovski of Cubellis / SGR representing Harry Dornbusch, Atlantic 18, LLC., for approval of the proposed construction of 80,745 square foot of warehouse and office space at property generally located at 1249 Stirling Road, Dania Beach. The proposed site plan includes a rear yard setback waiver. Laurence Leeds, AICP, Director Community Development addressed the board describing the request for site plan. Mr. Leeds indicated that the plan complies with parking, loading, setback (excluding rear yard), and building height requirements and that the proposed use is consistent with existing IROM zoning as well as the Future Land Use Plan Map ("Industrial"). He stated that the Fire-Marshall and Public Services Director have reviewed the plan and provided comments to the applicant. Planning and Zoning Advisory Board Meeting 1 October 17,2007 MINUTES Mr. Leeds described the requests for setback and pervious area waivers as: Setback Waiver: The provided 15' rear yard landscaped setback area is acceptable based on the height of the building(28'). Pervious Area Waiver: 15% pervious area is acceptable in this location. The site plan provides significant landscaping along Stirling Road,the most visible part of the site. Mr. Leeds concluded indicating that staff is recommending approval of the proposed site plan, including waivers, subject to the following conditions: 1) Applicant to provide additional landscaping in the front yard and identify a suitable substitute for the Geiger trees. 2) Applicant to modify the north parapet treatment of Building No. 1 consistent with Building 4. Jose Sale with Cubellis/ SGR addressed the board indicating that the applicant concurs with all of staffs comments and recommendations and is available to answer any questions. Vice-Chairman Schilling opened the item for public comment, hearing no one or seeing no one the public hearing was closed. Hearing no further discussion, a motion was made by Edward Bourgeois, seconded by Angeline Flowers to recommend approval of the site plan request SP-05-07. VA-52-07 — Request by Dennis Maier to allow unpaved, gravel parking in the vacant lot east of the Mr. M's Sandwich Shop (Mr. M's is located 1975 Stirling Road, Dania Beach). Dania Beach Code of Ordinances, Article V. Off-Street Parking Requirements of the Zoning Appendix, requires all areas to be hard surfaced and spaces, entrances and exits to be marked (The applicant has requested a continuance of this item until the November 21, 2007, Regular Planning and Zoning Advisory Board Meeting.) Vice-Chairman Schilling opened the item for public comment, hearing no one or seeing no one the public hearing was closed. A motion was made by Angeline Flowers, seconded by Edward Bourgeois to continue the variance request VA-52-07 until November 17, 2007 Regular Planning and Zoning Board meeting. VA-56-07—Request by owner/applicant Paul Comeau for property located at 1402 NW 8th Street, for a variance to allow the construction of a building addition (sunroom) with a 10- foot rear yard setback (15' required). Chapter 28, Zoning, Article 4.21 "Schedule of lot yard and bulk regulations"requires a 15-foot rear yard setback. VA-63-07 — Request by Susan Engle of Envirocare, Inc. representing Ariel Bentata, Manager of Venetian Beach LLC., for the following variances: 1) Construct finger piers 13 feet into the waterway (12' allowed). 2) Construct mooring piles 30 feet into the waterway (12' allowed). The Dania Beach Code of Ordinances, Zoning Appendix, Article 33-40 states docks and mooring piles cannot extend more that �e� of the proposed construcrion of townhouses atay width or 20 feet� �4430 SW chever is less. Laurence Leeds, AICP, Director Community Development addressed the board describing the request and the zoning code as it relates to docks and canal widths. He briefly described a site plan that is proposed to be submitted to the city at a later date, changing the previously approved 3 story town home site plan to 2 stories. Mr. Leeds indicated that the staff normally refers these variance requests to the Marine Advisory Board and that he has attended their board meeting this evening and they have approved the plan from a technical standpoint. Mr. Leeds indicated that a petition submitted by the neighborhood objecting to the variance request. The petition was entered into the record as an exhibit to the variance request. Vice-Chairman Schilling opened the item for public comment Jay Fields 4501 SW 30th Way questioned whether the Marine Advisory Board was told that there is a private boat basin on the east side of the canal. Mr. Fields indicated that the canal on the east side of the property needs to be researched further as the homeowners have deeds to 60 feet of the canal and it is not included as part of the navigable waterway. Mr. Fields objected to the granting of the variance. Rick Buckner 4601 SW 30th Way spoke in opposition of the variance request. Matt Kocsis 4680 SW 32na Avenue spoke in opposition and is looking for clarification. Silvio Quaranta 4531 SW 30th Way spoke in opposition and clarified his findings with the Army Corps of Engineers regarding the navigable portion of the canal and their verification of ownership. Susan Engle addressed the board responding to the public comments. Ms. Engle gave her opinion regarding submerged land on the canals and dredging. She further indicated that her company was not aware of the properties on the east side of the canal owning that portion of the canal and would obtain a legal opinion. Mr. Leeds indicated that this item will need to go back to the Marine Advisory Board, it and would need to be re-advertised once a legal opinion is obtained. It was requested that the neighbors be notified of this item going before the Marine Advisory Board. Hearing no one or seeing no one further,the public hearing was closed. There was a consensus that the item should be withdrawn until legal opinions are obtained. No further action was necessary, as the item was withdrawn by the applicant. Motion to call Paul Fetscher and Lottye Crooms to move the November Planning Board meeting to the Wednesday after Thanksgiving.
