Motion passed unanimously. PLANNING AND ZONING BOARD ITEMS 1) SP-14-07 - Rabbi Andrew Skurowitz, representing the applicant Brauser Maimonides Academy, is requesting a site plan for the proposed development of a 2-story, 11,636 square foot classroom building located at 5300 SW 40 Avenue. Corinne Lajoie, AICP, Principal Planner addressed the board describing the request. She indicated that the school is undergoing a phased expansion, and that phase one has been completed, phase two is under construction. Ms. Lajoie concluded stating that this site plan deals only with phase three and that staff recommends approval as the applicant has met with all of staff s comments. Manny Synalovski addressed the board briefly describing this phase of the project and concurring with staffs' presentation. Chairman Fetcher opened the item for public comment, hearing no one or seeing no one the public hearing was closed. Motion passed on the following roll call: Edward Bourgeois — yes Lottye Crooms — yes Paul Fetscher — yes 2) LU-38-07 - Daniel Habibe with Calvin Giordano and Associates representing the property owner, Florida Power and Light, is requesting a Future Land Use Plan Amendment from "Conservation"to "Utilities" for property located on the east side of SE 5 h Avenue, between SE P Street and SE P Terrace (301 SE 5th Avenue), in Dania Beach. The site is currently occupied by an FPL Substation. The applicant has requested the above land use plan amendment to replace the existing facility with a new substation. The proposed substation will occupy the same site as the existing substation plus additional land to the east. Laurence Leeds, AICP, Director Community Development, addressed the board describing the request for land use change. He described the location of the site, that the subject parcel is approximately three acres in size and is currently being used as an unmanned electrical substation. Mr. Leeds gave a brief history of the site and the proposed upgrades to the existing facility. Mr. Leeds indicated that staff has requested that the applicant provide additional information regarding the specifications of the new facility (noise, electrical generation) as compared with what exists today. He also requested that the applicant meet with the surrounding property owners to discuss the project. Mr. Leeds concluded indicating that if the Planning and Zoning Board chooses to recommend approval of the "Utilities" land use, staff is recommending that the City Attorney provide a legal mechanism to restrict development to only what is shown on the current site plan. Nectaria Vargas, legal representative for FPL, addressed the board regarding the proposed upgrades to the substation and impacts on the neighborhood. Ms. Vargas concluded stating that the applicant concurs with staffs' comments and plans on meeting with the neighbors once the final plans for the upgraded substation are complete. Bruce Barber with FPL addressed the board addressing questions regarding flood elevations, efficiency of the upgraded station,pervious area and elevation of the equipment. Mr. Leeds requested that the applicant submit elevation cross sections for the file. Chairman Fetcher opened the item for public comment. Steve Rush 334 SE P Street questioned the impacts on the surrounding pump station and drainage canals for the area to the north of the FPL site. Ms. Vargas indicated that the on site drainage is sufficient to hold the drainage on the site. The proposed requests are for the following: RZ-87-06 —Request to change the zoning from C-3 (General Commercial) to C-4 (Service and Warehouse Commercial). VA-39-07—Variance request to allow: 10 feet adjacent to the north lot line 1) Sable Palm Trees (varying heights) planted every J (Chapter 26, Vegetation, Article N Landscaping, Sec. 26-50 requires a two rows of shade trees,trees in each row to be planted every 40 feet.)2) 15 foot building setback adjacent to the north lot line (Chapter 28, Zoning, 4, Code rrt wires District Regulations, Schedule of Lot, Yard and Bulk The Zoning q buildings located adjacent to a single-family zoning districts or any existing single-family homes provide a setback equal to one (1) times the building height.
