Motion made by George Jason, seconded by Edward Bourgeois to excuse Lottye Crooms and Patrick
Schilling. Motion passed unanimously.
SUMMARY OF COMMISSION ACTION—Corinne Church, AICP,Principal Planner
PLANNING AND ZONING BOARD ITEMS
1) VA-15-06 —Variance request by applicant/ owner Michael Dielo to allow parking/ storage of a boat
25' 9" in length on property located at 703 SE P Lane, Dania Beach. (Chapter 25, Article III,
Division 6, Section 25-125 (d) states "In no event shall any boat exceeding twenty-five (25) feet in
length or eight (8) feet in width be parked or stored on residential property unless it is within a
completely enclosed, roofed and walled permanent structure."

Michael Deilo 703 SE P Lane addressed the board describing the variance request to allow for
parking of a boat which is 9 inches over the allowed limit.
Corinne Church, AICP, Principal Planner addressed the board describing the variance request
indicating that the subject property is zoned Residential Single Family (RS-6000). She further stated
that the property fronts on SE 3 Lane and backs up to.SE 4th Avenue. The boat is parked at the rear of
the property, adjacent to SE 4th Avenue.

Chairman Fetscher opened the item for public comment. Hearing no one and seeing no one, the
public hearing was closed.
Edward Bourgeois said he was contacted by some surrounding homeowners who objected to the
variance; but since the petitioner is such a good neighbor they did not want to object in person. He
indicated that they would prefer that the boat be hidden from the sight.
After discussion with the petitioner, staff and board members, a motion was made by Edward
Bourgeois, seconded by Patrick Schilling to recommend approval of variance request VA-15-06,
provided that the petitioner erects a 6 foot sliding gate (not chain link) to camouflage the vessel.

2) VA-19-06 — Eric Terzian, applicant, representing Charles & Franceska Akiba, property owner, is
requesting a parking variance to allow a cafe with zero parking spaces; at an existing building located
at 2 North Federal Highway. (Chapter 28, Zoning 6.21. Off Street Parking Requirements, indicates
that 9 parking spaces are required.)
Sandrine Terzian 6 N Federal Hwy., and David Sheps representing the petitioner, addressed the board
describing the variance request.
Corinne Church, AICP, Principal Planner addressed the board describing the location of the site as the
north west corner of Dania Beach Boulevard and Federal Highway, further indicating that the building
is currently occupied by an antique store which obtained a restaurant license in 2002. She indicated
that the Occupational License for the restaurant use has since expired. Ms. Church continued
indicating that the applicant is now requesting to establish a cafe at this location. She gave the
dimensions of the proposed cafe as 720 square feet, stating that approximately half will be use for

customer service area, requiring 9 parking spaces. Ms. Church concluded that according to the
survey, there is no parking provided on site and therefore, the applicant is requesting a variance to
allow the cafe with no parking spaces.
Laurence Leeds, AICP, Director Community Development, addressed the board describing the
existing conditions of the neighborhood. _Mr. Leeds indicated that he spoke to Mr. Akiba and advised
him that he could not open the restaurant prior to obtaining a variance and occupational license. City
Attorney Ansbro addressed the applicants stating that all approvals must be obtained and all
inspections must be completed with an occupational license issued prior to opening this business.
Mr. Shep indicated that there are only 10 seats in the cafe and the hours of operation are from 8:00 am
to 5:00 pm.
Chairman Fetscher opened the item for public comment. Hearing no one and seeing no one further,
the public hearing was closed.
Further discussion by the board regarding hours of operation, number of seats, limitations of use and
future visioning for the downtown area.

Hearing no further staff or board discussion a motion was made by Edward Bourgeois, seconded by
George Jason to recommend approval of variance request VA-19-06 subject to all approvals,
inspections and licenses being obtained from the city and also limiting the number of seat to be no
more than 15. Motion passed on the following roll call:

The following two items (VA-16-06 and VA-17-06)were addressed simultaneously.
3) VA-16-06 - The applicant, John Bartley, representing Albert Iriondo, for property located at 303 SW
2°d Avenue, is requesting a variance for the following:
a) To allow a single family home on a 58.23 foot wide parcel; (Chapter 28, Zoning Article 4, District
Regulations, Schedule of lot, yard and bulk regulations, requires lot widths in RD-8000 zoning
districts to be a minimum of 80 feet wide.)
b) To allow an air conditioner in the street side yard; (Chapter 28, Zoning, Article 5.31 (c) Yard
Regulations,prohibit the placement of air conditioners in street side yards.)
4) VA-17-06 - The applicant, John Bartley, representing Albert Iriondo, for property located at 307 SW
2"d Avenue, is requesting a variance to allow a single family home on a 50 foot wide parcel; (Chapter
28, Zoning Article 4, District Regulations, Schedule of lot, yard and bulk regulations, requires lot
widths in RD-8000 zoning districts be a minimum of 80 feet wide.)
John Bartley 201 SE 2 Avenue addressed the board describing the variance request. Mr. Bartley
indicated that Mr. Iriondo is no longer a principal in the property. He further described the existing
conditions of the site.
Laurence Leeds, AICP, Director Community Development, addressed the board giving a description
of the current conditions of the site and pending code enforcement actions.
VA-16-06 - Corinne Church, AICP, Principal Planner addressed the board describing the variance
request indicating that the property is generally located in a residential area west of Federal Highway
and south of Stirling Road on the south-east corner of SW 2"a Ave and SW 3rd Street. Ms. Church
further indicated that the property owner plans to build a single family home on lots 43 and 44 and
that the area of these lots combined covers approximately 7,657 Square Feet and is 58.23 in width.
Ms. Church also described the applicant's second request for the air conditioning unit to be placed in
the side street yard.
VA-17-06 - Corinne Church, AICP, Principal Planner addressed the board describing the variance
request indicating that the applicant requests to build a single family home on two lots, which when
combined, measure 50' in width. She indicated that the RD-8000 - 80' lot width was intended for
duplex lots, and not single family residences, and in this case, the applicant wishes to build a single
family home on a 50' foot wide parcel. Ms. Church noted that this variance application includes lots
41 and 42 and that the adjacent lots 43 and 44 (See VA-16-06) are the subject of a separate variance
application to build a second single family home. Ms. Church concluded her presentation, indicating
that all four lots (41-44) are currently occupied by a single dilapidated home subject to pending code
and unsafe structure actions.

Margaret Fischer addressed the board speaking in favor of the variance.
John Frostbutter addressed the board indicating no objection of the variance.
Hearing no one and seeing no one further,the public hearing was closed.
Mr. Bartley addressed the board requesting clarification of the intent of the ordinance. Further
questions by the board regarding the placement of the air conditioner unit.

George Jason to recommend approval of variance request VA-16-06 and VA-17-06. Motion passed

5) Request submitted by Cindy Meyer on behalf of Hollywood Investments Group, LLC for property
generally located on the north side of Dania Beach Boulevard between US 1 and NE 1 st Court the
following:
a) 5E-03-06 — Special Exception request to allocate 325 Local Activity Center ("LAC") dwelling
units to construct a mixed-use residential/commercial development.
b) VA-03-06—Variance Requests:
i) Variance request to allow a 140 foot high (ceiling of highest floor) mixed-use
residential/commercial building(Maximum height in C-2 is 40 feet).
ii) Variance to allow building to be built on the future right-of-way line of US 1 and Dania
Beach Boulevard(Zoning Code requires a 10 foot setback from the future right-of-way line).
iii) Variance to allow tandem parking (back-to-back spaces) for all two and three bed room
apartment units(Tandem parking not permitted by code).
iv) Variance to allow tandem parking for over 50% of required restaurant parking (Tandem
parking not permitted by code).
v) Variance to waive pervious area requirement(Code requires 15% - 30%).
c) VC-03-06: Request to vacate (and close street) for a portion of NE 1 Avenue generally located
between the Pirates Inn and the former Fish Grill properties. Request to vacate 15 alley located on
the former Fish Grill site and a 1 '/2 foot wide utility easement.
d) SP-03-06: Request for site plan approval for a 140 foot tall mixed use (retail/restaurant/residential)
development. Project to be known as"One Dania Beach/(Casa Beni)"
Cindy Meyer, 2755 Treasure Cove Circle, representing Hollywood Investments, Inc., addressed the
board describing the request, and further requesting a continuance until the next regular meeting, so
that some of the site plan issues can be addressed.
