ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY THE PLANNING AND ZONING ADVISORY BOARD WITH REGARD TO ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS,AND FOR SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. Motion passed unanimously MINUTES APPROVAL—September 7,2005 Special Meeting, and September 29, 2005 Regular, October 19, 2005 Regular,November 16, 2005 Regular, Motion was made by, Lottye Crooms, seconded by to Edward Bourgeois to recommend approval of the September 7, 2005, Special Meeting, September 29, 205 Regular Meeting, October 19, 2005 Regular Meeting and November 16,2005 Regular Planning and Zoning Advisory Board Meetings. Motion passed on the following roll call: Edward Bourgeois — Yes Loyye Crooms — Yes George Jason — Yes Dr. Paul Fetscher — Yes PLANNING AND ZONING BOARD ITEMS 1) VA-09-06 - Request by property owner, Robert Anton for a setback variance to allow a shed three (3) feet from the side and rear property line (code requires ten (10) feet setback from side and rear property lines) for property located at 838 Argonaut Isle. • Laurence Leeds, AICP, Director Community Development Department, advised the board that Mr. Anton has withdrawn this request. Planning and Zoning-Advisory Board Meeting Minutes FEBR UARY 1 S,2006 4 2) VA-02-06- Request by John Bartley, representing the property owner, David J. Wallace, for the proposed construction of a single family home at property located at 317 NE 2°d Court, Dania Beach. • The applicant is requesting the following variances to allow: i) Construction on a lot which contains an area of 7,630 square feet. (Chapter 28, Zoning, Article 4, Schedule of Lot, Yard and Bulk Regulations, requires a minimum lot size of 8,000 square feet in an RS-8000 zoning district.) ii) 38% lot coverage, 3% more than the maximum coverage allowed. (Chapter 28, Zoning, Article 4, Schedule of Lot, Yard and Bulk Regulations, requires that a maximum of 35% lot coverage be allowed.) iii) A five (5) foot variance from the required lot width, applicant is proposing construction on a lot with 70' of width and 109' of lot depth. (Chapter 28, Zoning, Article 4, Schedule of Lot, Yard and Bulk Regulations requires that a lots width be 75' or greater in the RS-8000 zoning district.) iv) An a/c compressor and pool pump with a three (3) foot side yard setback. (Chapter 28, Zoning Article 5, Supplementary Lot Regulations, Section 5.31(c) Air conditioning units, heating units, pool pumps, and related equipment shall not be located in a front yard or required seven (7) foot side yard. Such devices and related equipment may be located in a rear yard provided a minimum five-foot setback is provided to an property line. YP Pert Y ) Corinne Church, AICP, Principal Planner addressed the board describing the variance requests, the zoning, and general location of the site. Ms. Church described each variance request, indicating that staff is withholding recommendation and leaving it up to the boards discretion. • Mr. John Bartle addressed the e board representing Mr. Wallace. Mr. Bartley indicated that all of the homes in the RS-8000 area appear to be built as non-conforming structures. Mr. David Wallace addressed the board indicating that all of the lots on his street are 60 foot wide. Chairman Fetscher opened the item for public comment. Craig McAdams addressed the board requesting a rendering of the proposed house. Mr. Bartley brought out the plans for the home for Mr. McAdams to review. Hearing no one and seeing no one further, the public hearing was closed. The board verified the placement of the air conditioning unit with staff and the petitioner. Hearing no further staff or board discussion a motion was made by Loytte Crooms, seconded by George Jason to recommend approval of all items 1-4 of variance request VA-02-06. Motion passed on the following roll call: Edward Bourgeois — Yes Loytte Crooms — Yes George Jason — Yes Dr. Paul Fetscher — Yes. • 3) VA-06-06 - The applicant, K & P Mechanical Solutions, Inc., on behalf of the owner, J D Investment Realty, LLC, property located at 3010 Ravenswood Road, Dania Beach, Florida, is requesting a variance to allow the following: Planning and Zoning Advisory Board Meeting Minutes FEBRUARY 15,2006 i) To allow 316 square feet of office space while providing zero parking spaces; The zoning code • requires 1 additional parking space. (Chapter 28, Zoning, Article 6.21 Off Street Parking requires that 1 parking space for each 250 square feet of office space.) ii) To allow an additional 720 square feet of floor area(mezzanine) to be added while providing zero parking spaces; The Dania Beach zoning code requires 1 additional parking space. (Chapter 28, Zoning, Article 6.21 Off Street Parking requires that 1 parking space for each 800 square feet of warehouse space.) Corinne Church, AICP, Principal Planner described the zoning and existing conditions of the site further describing each of the variance requests. Ms. Church indicated that staff is recommending approval if the applicant provides a letter of no objection from the condominium association. John Kneiss, 3010 Ravenswood Road, unit owner, addressed the board regarding the variance request. He also indicated that he has a letter from the condominium association and submitted to staff and the board for their review. Chairman Fetscher opened the item for public comment. Hearing no one and seeing no one, the public hearing was closed. Hearing no further staff or board discussion a motion was made by George Jason, seconded by Loytte Crooms to recommend approval of the variance request VA-06-06. Motion passed on the following roll call: . Edward Bourgeois — Yes Loytte Crooms — Yes George Jason — Yes Dr. Paul Fetscher — Yes 4) VA-08-06 - Request by Raymond Smith, President, E & S Construction, Inc., property owner, for the proposed construction of a single family home, property generally located north of Dania Beach Boulevard, south of NW 1 Street and east of NW 13 Avenue, Dania Beach. The applicant is requesting the following variances to allow: i) To allow a 14 foot front setback; (Chapter 28, Zoning, Article 4 Schedule of Lot, Yard and Bulk regulations requires 25 feet front setback.) ii) To allow a 12 foot side setback for a combined side setback of 24 feet; code requires 15 foot side setback and 30 foot combined. (Chapter 28, Zoning, Article 4 Schedule of Lot, Yard and Bulk regulations requires 25 feet front setback.) iii) To allow mechanical equipment in the front yard; code requires mechanical equipment to be located in rear yards. (Chapter 28, Zoning Article 5, Supplementary Lot Regulations, Section 5.31(c) Air conditioning units, heating units, pool pumps, and related equipment shall not be located in a front yard or required side yard.) Corinne Church, AICP, Principal Planner described the existing conditions and zoning for the site. • She described the variance request to the board indicating that staff is withholding recommendation and leaving it up to the boards discretion. Planning and Zoning Advisory Board Meeting Minutes FEBRUARY15,2006 Laurence Leeds, AICP, Director, Community Development Department, described the history of the RD-8000 zoning change for this area and the Commissions intent for the change. • Raymond Smith addressed the board regarding his intentions for the construction of a single family home. Chairman Fetscher opened the item for public comment. Hearing no one and seeing no one, the public hearing was closed. The board questioned whether there was a dedicated street behind this property. Ms. Church indicated that there may be a "paper street" in the area, but physically there is not. Further discussion by staff and the board regarding NW 12t'Avenue. Hearing no further staff or board discussion a motion was made by Lottye Crooms, seconded by George Jason, to recommend approval of the variance request VA-08-06. Motion passed on the following roll call: Edward Bourgeois — Yes Loytte Crooms — Yes George Jason — Yes Dr. Paul Fetscher — Yes 5) VA-72-05 - Patrick Vaccaro is requesting a variance to build a single family home on a 50 foot wide unplatted parcel (metes and bounds description). Section 39-579 of the applicable 1991 Broward County Zoning Code requires a minimum 60 foot wide parcel unless the property is a platted lot of record. Property located at 2982 SW 45th Street, Dania Beach, Florida. • Laurence Leeds AICP Director CommunityDevelopment described h p the variance request to the board and the petitioners request to build a single family home. Mr. Leeds further stated that this lot does not meet the definition of a platted "lot of record" and as such, cannot be built upon without a variance. Patrick Vaccaro addressed the board describing his request. Chairman Fetscher opened the item for public comment. Faye Bartlemous addressed the board commenting on the request, not speaking in favor or against the request. Hearing no one and seeing no one further,the public hearing was closed. After further discussion by the board, staff and the petitioner, a motion was made by George Jason to recommend approval of the request. The motion died for lack of second. It was the opinion of Attorney Ansbro that he would need approval on the variance to obtain a certificate of occupancy for the home that is already constructed. Motion made by George Jason, seconded by Loytte Crooms, to recommend that the variance request • VA-72-05 be continued and re-advertised for both lots.
