HomeMy WebLinkAboutR-2008-221 Solid Waste Assessment Collection RESOLUTION NO. 2008-221 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE IN THE CITY OF DANIA BEACH, FLORIDA; AMENDING RESOLUTION 64-96 DESCRIBING THE METHOD OF ASSESSING SOLID WASTE COSTS AND COLLECTION OF ANNUAL SOLID WASTE SERVICE ASSESSMENTS TO INCLUDE ALL PROPERTIES LOCATED WITHIN THE BOUNDARIES OF THE CITY OF DANIA BEACH FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2009; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE OF SUCH HEARING; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida, enacted Ordinance No. 09-96 (the "Ordinance"), which authorizes the imposition of annual Solid Waste Service Assessments for Solid Waste collection and disposal services, facilities or programs against certain Assessed Property within the City; and WHEREAS, Resolution 64-96 adopted in July 1996 allows the City to collect its solid waste assessment using the tax bill collection method for property located within Griffin Road Annexation Area; and WHEREAS, the City Commission desires to expand the annual solid waste collection and disposal assessment program using the tax bill collection method to incorporate all properties within the City of Dania Beach including those previously billed under the City's water and sewer utility billing collection system; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That this Resolution is adopted pursuant to the provisions of the Solid Waste Service Assessment Ordinance (Ordinance No. 09-96), sections 166.021 and 166.041, Florida Statutes, and other applicable provisions of law. Section 2. That this Resolution amends Resolution 64-96 to use the uniform method of collecting solid waste assessment for all properties located within the boundaries of the City of Dania Beach according to the map as attached in Appendix "A". Section 3. That the City Clerk has published weekly for four consecutive weeks prior to the adoption of this Resolution a notice of the intent of the City to use the uniform method of collecting such assessment and such is in compliance with Florida Statute 197.3632 (3) (a). Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on December 9, 2008. ALBERT C.
