I Wawa 1004-2004 ROLL CALL Also Present: Edward Bourgious - Present Laurence Leeds, AICP, Director Community Development George Jason - Present Corinne Church, AICP, Principal Planner Victor Lohmann - Present Thomas Ansbro, City Attorney GaryLuedkte - Present Lou Ann Cunningham, Board Clerk Lottye Crooms - Present Distribution of draft minutes from the April 23, 2003, May 21, 2003, June 18, 2003, and October 15, 2003 Planning and Zoning Advisory Board for the boards review. 1) Owner/Applicant: City of Dania Beach Location: 300 NE 2 Street, Dania Beach VA-25-04 - Variance request to construct a 24 foot high one-story multi-purpose recreation center at Frost Park. (Chapter 28, Zoning, Article 4 Schedule of Lot, Yard and Bulk Regulations, allows buildings within the Open Space zoning district to be no more than 16 feet). SP-25-04 - Site Plan request to construct a 6,000 square foot multi-purpose recreation center at Frost Park. Laurence Leeds, AICP, Director Community Development, addressed the board describing the City's request. Mr. Leeds concluded stating that staff is recommending approval of the request. Chairperson Crooms opened the item for public comment hearing no one and seeing no one the item was closed. Motion made by Victor Lohman, seconded by Gary Luedkte to approve the Variance VA-25-04 and Site Plan SP-25-04 requests. Motion passed on the following roll call: Edward Bourgious - yes George Jason - yes Victor Lohmann - yes Gary Luedkte - yes Loyye Crooms - yes Ivan Pato, City Manager, addressed the board to thanking them for their support. --------------------------------------------------------------------- Planning and Zoning Advisory Board MINUTES 1 April 21, 2004 2) Applicant: Ch& Serabian on behalf of James Bao Location: 2501 Griffin Rd., Dania Beach SP-78-03 - Request by Charles Serabian, on behalf of James Barron for site plan request to convert an existing building into a Subway restaurant located at 2501 Griffin Road. Continued from March 17, 2004 Regular Meeting Staff has requested this item be continued until the May 19, 2004 Planning and Zoning Advisory Board Meeting Motion made by Victor Lohmann, to continued until the May 19, 2004 Planning and Zoning Advisory Board Meeting, Seconded by George Jason. Motion passed on the following roll call: Edward Bourgious - yes George Jason - yes Victor Lohmann - yes Gary Luedkte - yes Loytte Crooms - yes --------------------------------------------------------------------- 3) Applicant: Shelley Eichner AICP, Calvin Giordanno and Associates Property Owner: MKN Investments, LLC Location: Griffin Lakes Townhome Site - West side of Ravenswood Road at Gulstream Road VA-18-04 - Variance request as follows: i) To allow 37 percent pervious area in order to allow the installation of rear yard/court yard patios for up to 427 townhouse units. Chapter 28, Zoning, Section 29.10 Pervious Area Requirements, requires that 40 percent of the land area remain pervious to effectively provide for the drainage of stormwater. ii) To waive the requirement for 100 percent irrigation coverage requirement by allowing individual back yard and courtyard areas to be non-irrigated. Chapter 26, Vegetation, Section 26-53(h). Plant material and installation requirements state that all irrigation systems shall be designed to have a minimum of one hundred (100) percent coverage with a one hundred (100) percent overlap. Corinne Church, AICP, Principal Planner addressed the board describing the variance request to the board. Ms. Church concluded her summation stating that staff is recommending approval of the pervious area variance subject to approval by the Public Services Director. Mr. Leeds indicated that staff is not in support of the 100% irrigation waiver. Shahin Hekmat, P.E., of Calvin, Giordanno and Associates addressed the comments made by staff. The board questioned the use of private irrigation by the unit owners. At this time the item was opened for public comment. Faye Bartolmeus addressed the board regarding the use of irrigation with city water. Hearing no one and seeing no one further. The public hearing was closed. Further discussion regarding the types of improvements the owners would be allowed to make. Motion made by Victor Lohmann to approve the 37% pervious area variance request VA-18-04 based on approval by the Public Services Director, seconded by George Jason. Motion passed on the following roll call: Edward Bourgious - yes George Jason - yes Victor Lohmann - yes Gary Luedkte - no Loytte Crooms - yes After further discussion between the petitioner, board and staff, a motion was made by George Jason to deny the request for a waiver of the 100% irrigation coverage requirement VA-18-04, seconded by Edward Bourgious. Motion passed on the following roll call: Edward Bourgious - yes George Jason - yes Victor Lohmann - yes Gary Luedkte - no Loytte Crooms - yes Board member Lohmann indicated he would consider changing his recommendation if municipal water could be used to irrigate the courtyards --------------------------------------------------------------------- 4) Applicant: City of Dania Beach Location: City wide Request by the City of Dania Beach Community Development Department and Public Services Department to approve an amendment to the Comprehensive Plan by adding a Water Supply Plan as required by State Statue. Laurence Leeds, AICP, Director Community Development addressed the board describing the amendment. Fernando Vazquez, Director of Public Services and Fred Bloetcher, Consultant for the City, answered questions by the board. Motion passed on the following roll call: Edward Bourgious - yes George Jason - yes Victor Lohmann - yes Gary Luedkte - yes Loytte Crooms - yes --------------------------------------------------------------------- 5) Applicant: Ralph Denuzzio & Associates Owner: Bonito Irastoriza, B & JCM Properties, LLC Location: Northwest corner of 1-95 and Stirling Road LUF-11-04 - Request by Ralph Denuzzio & Associates representing B & I Properties, Ltd., for assignment of commercial flex acreage (20% at the NW corner of 1-95 and Stirling Road. Laurence Leeds, AICP, Director of Community Development, addressed the board to describe the request. Attorney, Richard Coker addressed the board describing the request for commercial flex assignment and to answer any questions by the board. Chairperson Crooms opened the item for public comment hearing no on eand seeing no one the item was closed. Motion made by Gary Luedkte to recommend approval for the request to assign commercial flex acreage LUF-11-04 for a period of six months, seconded by Victor Lohmann.
