APPROVAL OF MINUTES —
Board approval of the July 21, 2004 &August 18, 2004 Planning &Zoning Advisory Board.
Motion made by Victor Lohmann, seconded by George Jason to approve the July 21, 2004
and August 18, 2004 Planning and Zoning Advisory Board minutes. Motion passed on the
following roll call :
Edward Bourgeois - yes George Jason - yes
Victor Lohmann - yes Gary Luedtke - abstain due to absence
Lottye Crooms - abstain due to absence
1) Request by Mark Kieser, with Craven Thompson & Associates, Inc., representing
Stephen St. Clair, for property generally located on the west side of NW 9 Avenue
between NW 3 Place and NW 3 Terrace, for the following:
i) RZ-53-02 - Rezoning request from C-3 (Commercial) to C-4 (Commercial)
ii) SE-54-02 - Special Exception request to permit outdoor storage of 5.7 acres in a C-
4 Zoning District. (Chapter 28, Zoning, Article 4.20 Schedule of Use Regulations)
iii) VA-54-02-Variance request from Chapter 26, Vegetation, Article VI, Landscaping,
to:
a) Waive 20% VUA Landscape requirement
b) Waive landscape peninsulas, terminal landscape peninsulas and other interior
vehicular landscape areas.
c) Waive wheel stop and curb requirements
vi) SW-53-04—Side Walk Waiver request along NW 9 Avenue.
v) SP-17-04—Site Plan Request or the proposed construction of an outdoor storage
area.

Corinne Church, AICP, Principal Planner for the Community Development Department
addressed the board, describing the requests for property generally located south of the
Competition Cycle Center on the west side of NW 9 Avenue between NW 3 Place and NW 3
Terrace. Ms. Church stated that staff recommends approval of the rezoning request, she also
indicated that staff is recommending approval, subject to conditions being addressed prior to the
City Commission Meeting for the special exception, variances, as follows:
1. Add the following landscape plan notes:
■ All landscape islands shall be excavated to 30" and backfilled with the specified
soil mix.
■ Continuous hedge "branch touching branch" provided at time of installation.
■ All plant material including sod and irrigation needs to repaired or replaced to meet
code at time of CO inspection.
■ All guying material must be removed within 1 year and no changes with out City of
Dania Beach approval.
■ All PVC risers painted flat black to the irrigation note (irrigation plan also).
■ All hedges (both coco plum and ficus) to be minimum 24" high at time of planting
and 36" high within one year
■ Change Glaucus Cassia trees specifications as follows: 14 foot starting height, 2"
DBH, 5 clear trunk, 7 foot spread.
■ Specify the type of soil and fertilizer proposed.
2. Provide the color rendering of the proposed 8' tall wall. This includes type, color and any
embellishments.
3. Site Plan to show type 'D' curbing along the length of the entrance drive on the north
side of the property, along the length of the southern most drive and around the
landscape area surrounding the FPL pylon (currently shown in site plan).
4. Architect and owner to submit letters agreeing that post-permit landscape plan changes
require prior staff approval of revised landscape plans.
5. Use restrictions as indicated in Site Data Box on Sheet 1 of 1 (see attached).
Ms. Church further stated that staff is recommending approval of the site plan request
conditioned on the rezoing, special exception, variances and staffs' conditions being approved.
Ms. Church concluded by indicating that the Public Services Director has not yet provided a
recommendation on the sidewalk waiver, but in a memorandum dated June 8, 2004, from
Detective Richard Tarant, CPP (CPTED Specialist), of the Broward Sheriffs office after
reviewing the site plan in accordance with C.P.T.E.D. regulations, is recommending that the
sidewalk waiver be granted.
Laurence Leeds, AICP, Director of Community Development addressed the board comments
regarding sidewalk waiver and future development along the Dania Cut-off Canal.
Joe Handley with Craven Thompson & Associates, representing the property owner, addressed
the board to describe the project and answer any questions by the board.

Steven St. Clair, property owner, indicated for the board, that there would not be access to the
site from this business °Competition Cycle Center". The petitioner indicated that they would like
to phase the project and Mr. Leeds indicated that a phasing plan would need to be submitted
and reviewed prior to City Commission hearing. After further discussion by board members, it
was agreed that FPL confirmation regarding approval of the project at the site and recordation
of the right of way easement discussed should be submitted prior to building permit
Chairperson Lottye Crooms opened the item for public comment. Hearing no one and seeing
no one, the public hearing was closed and the item was brought back to the board for
discussion.
Hearing no further discussion, motion was made by Gary Luedtke, seconded by Victor Lohmann
to recommend approval of the requests for Rezoning (RZ-53-02), Special Exception (SE-54-02),
Variance (VA-54-02), Side Walk Waiver (SW-53-04) and Site Plan (SP-17-04) subject to staffs'
conditions; and in addition amending condition #1 of staffs' conditions relating to the
specification of the Glaucus Cassia trees; also requiring that the petitioner obtain
acknowledgement of the use under the power lines; and to have the future roadway easement
for NW 9th Avenue approved by the city attorney and recorded prior to issuance of a building
permit. The motion passed on the following roll call:

Victor Lohmann suggested a joint meeting with Marine Advisory Board regarding properties
located on the south bank of the Dania cutoff canal. Motion made by Victor Lohmann to contact
Marine advisory board and set up meeting to discuss issues, seconded by Edward Bourgeios.
Motion passed unanimously.
