Motion passed unanimously. Motion made by Gary Luedtke nominating George Jason as Vice-chairperson, seconded by Chairperson Crooms. Motion passed unanimously. 9) SP-21-03—The City of Dania Beach is proposing site improvements to Charlie Thomas Park, located at 800 NW 2"d Street, Dania Beach. Improvements generally located at the Northwest corner of NW 8th Avenue and NW 1st Street. Bonnie Temchuk, Assistant to the City Manager, spoke and presented the item. She explained the site plan for various site improvements, including new walking paths, a junior basketball court, three (3) new pavilions, picnic tables, grills, hoops and backboards for the community. Laurence Leeds, AICP, Director of Community Department, addressed the Board and gave a brief description of the request stating that staff is recommending approval. Chairperson Crooms opened the item for public comment. Hearin no one and seeing no one, Ms. Crooms closed the public hearing, bringing the item 9 9 P 9 9 9 back to the Board for further discussion and possible action. Motion made by George Jason to recommend approval of site plan request SP-21-03, seconded by Gary Luedtke. Motion passed on the following roll call: Edward Bourgeois yes George Jason yes Chairperson Crooms yes Gary Luedtke yes 1) Request by County Homes Development Corporation for property located north of Griffin Road along SW 33`d Avenue, Dania Beach,for the following: VA-10-03—Variance request to allow the following: Planning and Zoning Advisory Board MINUTES 1 April23, 2003 a) Parking Variance to allow eleven (11) parking spaces (12 spaces required); Chapter 28, Zoning, Article 6.21 Off-Street Parking; b) Generalized Landscape Variance, Chapter 26, Vegetation, Article IV Landscaping. SP-09-03—Site Plan request for the construction of five (5)town homes Thomas Ansbro, Board Attorney informed the Board that the applicant has requested a continuance of the items to May 21, 2003. Corinne Church, AICP, Principal Planner, explained that the applicant is here to answer any questions from the citizens due to the fact that notices were mailed out prior to the applicant making a request for continuance. Chairperson Crooms opened the item for public comment. Hearing no one and seeing no one the public hearing was closed. Motion made by Gary Luedtke to recommend the above item be continued to the May 21, 2003 Planning and Zoning Advisory Board meeting, seconded by George Jason. Patel, for property located at the northwest corner of US 1 and SW loth Street. Mr. Patel is requesting the following: SP-11-03 — Special Exception Request—To allow a motel with less than 100 rooms in a C-3 (Commercial)zoning district. Chapter 28, Zoning Article 4, District Regulations. SP-11-03—Site Plan request to construct a hotel and related parking areas. VA-12-03 —Variance Request: 1) Variance to exceed maximum 3-story height. Chapter 28, Zoning Article 4, District Regulations, Schedule of Lot Yard and Bulk Regulations; 2) Variance to waive the five (5)foot setback requirement for the six (6)foot wall/fence required to adjacent to residentially zoned properties. Chapter 26, Vegetation Article IV Landscaping—26.50 (b) (1); 3) Waive minimum peninsula parking lot island size. Chapter 26, Vegetation Article IV Landscaping; 4) Waive 30% minimum pervious landscape area requirements. Chapter 28, Article 29 Pervious and Impervious Areas; 5) Provide a five foot wide landscape buffer along the north and west lot line. (Minimum 10 foot required) Chapter 26, Vegetation Article IV Landscaping; 6) Waive minimum 20% of Vehicle Use Area pervious area. Corinne Church, AICP, Principal Planner, informed the Board that the applicant has withdrawn all of the requests. Thomas Ansbro, Board Attorney, stated that no formal action is required by the Board. 3) VA-15-03 — Request by Jerry Estep for property located at 958 Nautilus Isle, Dania Beach, to extend a boat- lifting device 18 feet into a 80 foot wide canal (The Zoning Code allows boat-lifting devices to extend no more than 10% of the canal width without a variance. In this case, the Zoning Code allows boat-lifting devices to extend no more than 8 feet into a 80-foot wide canal). Laurence Leeds, AICP, Director of Community Development, addressed the Board and gave a summation and brief description of the variance request. Mr. Jerry Estep addressed the Board describing the hardship associated with his request to extend his boat-lifting device. He presented exhibits of no objection letters from his neighbors and photographs showing the comparison of his and adjoining neighbors' docks. Michael Morrison, contractor representing Mr. Estep, addressed the Board and explained the variance request. Mr. Morrison stated that the existing dock and two dolphin pilings have been permitted and inspected by the city's building department. Mr. Morrison explained that the proposed boat-lift is originally his, which was approved bu a variance and granted a year ago. In other words, this proposed boat-lift is to be moved from Mr. Morrison's property to Mr. Estep's property two doors away; and it would then be tied onto Mr. Estep's existing pilings. Mr. Leeds questioned Mr. Morrison's intention of moving his boat-life to his neighbor. Mr. Morrison responded that he no longer needs it because he has purchased a bigger boat and his boat-lift could no longer hold it. He confirmed that the boat-lift placed at Mr. Esteps' property will not change or be replaced. Mr. Morrison inquired as to why mooring pilings are permitted but boat-lifts require a variance, when both of them occupy the same space. Mr. Morrison further added that the canal is very shallow up against the seawall at low tide. The boat-lift literally would be sitting on the berm and the boat could not be launched. Chairperson Crooms opened the item for public comment. Billie Phipps of 946 Nautilus Isle, spoke in opposition of the variance request. Hearing no one and seeing no one further, Chairperson Crooms closed the public hearing, bringing the item back to the board for further discussion and possible action. Mr. Leeds said that should the Board recommended approval of the variance, it may be granted subject to the condition that Mr. Morrison has to voluntarily deed restrict his property. Planning and Zoning Advisory Board MINUTES 3 April 23, 2003 • • Mr. Morrison confirmed that all of the pilings were removed from his property. Mr. Luedtke commented that property owners living in the waterfront community should check the depth of the water of their canal and city codes regarding installation of boat-lift device, before making a decision to purchase a boat, to avoid applying for a variance. Motion made by George Jason to recommend approval of variance request as submitted. Motion died for lack of second. After passing the gavel, a motion was made by Chairperson Crooms to forward the variance request VA-15-03 to the City Commission without a recommendation by the board, seconded by Gary Luedtke.
