Much discussion and attention has been given to this property try various departments of the City and the County because the owner has been seeking to approve the platting of the property into residential lots. This process has been ongoing for over 3 years. The Owner has expended several thousand of dollars in making plans, des'gns, and on-site assessments of the preserve area and how best to protect an]maintain same upon development. Documentation of these expenditures can be given upon request. As you recently became aware, one of the main impediments is tha fact that the property contains an area designated as a Natural Resource Area subject ro the Natural Forest Co:.mrunity requirements. Tbis (as you now know)has been the root of all of the code enforcement issues -which thankfully have now all been corrected by the Owner. In the main-the problem has been that the property contained it"preserve'which cannot be disturbed- whereas the City has cited the property for being over-grown and unattended and did In fact perform clearing end cutting on the property even though the property was not penttitted to ba disturbed in say way(see copy of limi attached). These then form the basis for legitimate abatement of the existifig lien amounts. Therefore, it is our n:quest that this matter be placed on the next available agenda for abatement of the lien. The exterior surface of the structure is deteriorated. 3. DBCC 13-34 (a) Nuisance Accumulation. It is unlawful for any owner or operator of premises within the city to allow the accumulation of or to accumulate any garbage, litter, stagnant water, trash, untended vegetation, or to allow any discoloration, or any nuisance as defined in section 13-21 upon the premises. There is trash and litter on the premises. All trash and litter on the premises must be removed. 4. DBCC 13-34 (b) Property and Right of Way Maintenance. Each owner or operator of property within the city shall keep such property, and the adjoining unpaved portions of the public rights-of- way, swales and canal banks, clean and free from any accumulation of garbage, trash, and litter. There is trash and litter on the rights of way adjoining the property. Remove all trash and litter from the property's adjoining rights of way. 5. DBCC 13-34 (c) Untended Vegetation Minimum Standards. The owners and operators of all improved property within the city shall not permit untended vegetation upon such property, and the adjoining portions of rights of way, swales, and canal banks. There is untended vegetation on the property and the rights of way adjoining the property. C. The Special Magistrate found in Code Compliance Special Magistrate Case #07-0102, in Final Order signed April 10, 2007, that Respondent, Dania Beach Hotel LLP, did allow the code violations stated in paragraphs b.(1) through b.(5) of this Order to exist on the subject property. The current violations are repeat violations pursuant to Florida Statute 162.04 (5). Upon consideration thereof, it is thereupon ORDERED: 1.
