Approval of Agenda — Motion made by Bob Adams, seconded by Paul Fetscher to continue item 4, VA-60-99 and SP-61-99. Motion passed unanimously. ADMINISTRATIVE BUSINESS 3. Minutes — Approval of minutes of the August 18, 1999 regular meeting. Motion made by Bob Adams, seconded by Richard Seay to approve minutes as presented. Motion passed unanimously. OLD BUSINESS 4. VA-60-99 - Variance request by the City of Dania Beach, owner of property located at the southwest corner of SW 45th Street and SW 30th Avenue from the following zoning Continued codes: (CONTINUED FROM JULY 21, 1999 REGULAR MEETING) Chapter 26, Vegetation; Article IV, Landscaping. Sec. 26-50. Landscape requirements for areas separating business, commercial and industrial property from residential property, (b) When any business, commercial or industrial zoned or used property, directly abuts on a residential zoned or used property, without separators between them such as a street, alley, canal or other public open space, then the business, commercial or industrial zoned or used property shall be provided with a landscaped area at least ten (10) feet in depth adjacent to the residential zoned or used property. Such landscape area shall meet the following requirements: (1) Provide a six-foot masonry wall or solid wooden fence five (5) feet off of the residential zoned or used property. (3) The area between the wall or fence and the commercial, business or industrial property shall be landscaped by providing a tree every eighty (80) feet staggered from the ones on the other side of the wall. (Please note that the landscaping required for this item is being met, and that only the wall/fence is being omitted.) SP-61-99 — Site plan request by the City of Dania Beach for the construction of a Municipal Fire Rescue Station No. 93. (if the Planning and Zoning board acts on this petition at this meeting, a public hearing will be held by the City Commission. on Tuesday, September 28, 1999.) Planning and Zoning Board 1 September 15, 1999 MINUTES NEW BUSINESS 5. VA-73-99 — Variance request by Jimmy Villarrdel, President of JGV Properties, owner of property located at 16 North Federal Hwy, Downtown Dania Beach, Florida 33004. Mr. Villarrdel is requesting a variance from the following code sections: Chapter 28, Zoning Article 4. District Regulations, Schedule Of lot, yard and bulk regulations — C-2 zoning district requires a 10 foot side yard setback. Mr. Villarrdel is proposing a five-foot setback for a proposed addition which would match the existing building. Chapter 28, Zoning Article 6.21 Off Street Parking requirements in conjunction with a proposed site plan request for renovations to an existing building. Mr. Villarrdel is requesting that he be allowed to provide 17 parking spaces where the code calls for 18 spaces. Chapter 28, Zoning Article 28.10, Pervious and Impervious Areas which provides that the land covered by buildings, structures and impervious surfaces shall not exceed seventy percent (70%)for commercial uses. Chapter 26, Vegetation, Article IV, Landscaping, Sec. 26-51. Perimeter landscape requirements for business, commercial and industrial properties. A five-foot landscape buffer shall be provided around the perimeter of the property except for areas required to provide landscape buffers in accordance with section 26-50. Such landscape buffer shall contain one (1) tree for each forty (40) linear feet and a row of hedges. Mr. Villarrdel is proposing a four-foot landscape buffer. SP-74-99 — Site plan request by Jimmy Villarrdel, President of JGV Properties, owner of property located at 16 North Federal Hwy, Downtown Dania Beach, Florida 33004. Mr. Villarrdel is proposing an addition and renovations to the existing building at 16 North Federal Hwy., Downtown Dania Beach. (If the Planning and Zoning board acts on this petition at this meeting, a public hearing will be held by the City Commission. on Tuesday, September 28, 1999.) Terry Virta, AICP, Growth Management Director addressed the board with a summation supporting the variance for the renovation of the Downtown structure. Mr. Virta stated the reasons why the petitioner is in need of the proposed variance. Jason Dubow questioned staff on the reason why the variance application did not list all variances. Mr. Virta answered that all the variances were advertised and included in the public hearing notice. The clerk sworn in Ed Spellman, Architect for the petitioner. Mr. Spellman described for the board the proposed project. Board questioned as to the type of trash pick-up and dumpster style. Dr. Fetscher questioned the parking aisle size. It was determined that it is deficient by 4 feet. The clerk sworn in Jimmy Villarrdel of JGV Properties. Mr Villarrdel addressed the board explaining the project and asking the board to vote favorably. The clerk sworn in Michael Garrett, Mainstreet Program Coordinator. Mr. Garrett addressed the board speaking in favor of the project. Richard Seay stated that he is grateful to the petitioner for his efforts to improve the Downtown area and he hopes that others will follow.
