APPROVAL OF MINUTES:
June 19, 1996 Planning and Zoning Board Meeting. Motion made by Victor Lohmann
to approve the minutes of June 19, 1996 Planning and Zoning Board meeting,
seconded by Anthony Stevens. Motion passed on the following roll call:

1. VA-24-96 - The request of Joseph Prevish, owner, for a variance from Section 33-
40(13)(c) of the Dania zoning code entitled "Docks and Mooring Structures." The
request is to permit the installation of a boat lift at 1421 NW 9 Street which would
extend into the waterway more than the 10 percent allowed by Section 33-40(13)(c).
The request is to construct a boat lift which would extend 12' or 20 percent of the 60'
waterway.
This property is legally described as: Lot 24, Block 1, Florian Isles, according to the
plat thereof, as recorded in Plat Book 50, Page 17 of the Public Records of Broward
County Florida.

Will Allen, Growth Management Director addressed the board to introduce the case.
Mr. Allen explained the petition as being a request to construct a boat lift on the
waterway known as the Tarpon canal, in the rear of 1421 NW 9 St. The request is to
allow the boat lift to extend 12' (20%) into the 60' wide waterway. The Zoning Code
indicates that no extension of a boat lift (or device capable of being submerged) can
extend more than 10% of the width of the water way without an approved variance
and the attachment of a guide pole to the end of the device. Mr. Allen further
explained that the code specifies that vessels moored to mooring structures shall not
exceed 30% of the width of the waterway. The zoning for this and surrounding
properties in the area is RS-6000 which requires a 6,000 sq. ft. lot. This property
meets all of the minimum requirements of this district. Mr. Allen then introduced the
petitioner, Joseph Prevish to state the hardship in this case. Joseph Prevish
addressed the board and explained the schematics of the boat lift and the area of the
yard and dock-to the board. Mr. Prevish further explained that because of the design
of the patio and the dock, this would be the only place to install the lift without having
to tear up the existing patio which would be a very costly expense. Questions by the
board concerning placement of the lift and the orientation and size of the boat. After
further questions by the board regarding safety and environmental concerns,
Chairperson Daise opened this item to the public for comment. Hearing no one and
seeing no one the public hearing was closed. Motion was made by John Etling to
recommend approval of VA-24-96, seconded by Anthony Stevens. Motion passed
on the following roll call:

*It was noted that this item will go before the City Commission as a public hearing on October 8, 1996.
2. VA-25-96 - The request of Associated Marine Technologies, Inc., 490 Taylor Road, for
variances from the building height and side yard setback regulations for a building
within the IG, Industrial General, zoning district as listed in Section 4.202 Schedule of
Lot, Yard and Bulk Regulations of the Dania zoning code. The variances requested
are:
1) To construct a building addition with a side yard setback of 10'. Section 4.202
requires a minimum side yard setback of 20'.
2) To construct a building addition which has a height of 47'6". Section 4.202 indicates
the maximum height is not to exceed 35'.

This property is legally described as: Parcels 'A' and 'B', Transworld Plat, recorded
in Plat Book 116, Page 8, of the public records of Broward County, Florida.
Will Allen addressed the board explaining the two variances requested and how they
relate to the following site plan request to enlarge the existing building. Mr. Allen
explained the land use of the site as Industrial, zoning as Industrial General and
confirmed that boat manufacturing is a permitted use in this district. Mr. Allen explained
the requested variances for the proposed structure as a 10' side yard on west side, a
20' minimum is required; and a 47'6" height, a 35' maximum is allowed. ! Mr. Allen
suggested reviewing the site plan at the same time to better understand thei variances
requested. The petitioner is requesting a building addition for a business that primarily
repairs boats. The site for the proposed additions are parcels A and B of the
Transworld Plat. The plat is 194,933 sq. ft., zoned IG (Industrial General) and is
located on the North side of the Dania Cutoff Canal. Their is right of way for the street
which bisects the property included on the plat, and located across this street is where
the F.P.L. lines are located. Site plan includes parking on the north side of the road,
which is now almost at the northern limits of the city after the airport changes. Adjoining
uses to the east along the Dania cutoff canal are Derekor Gunnell, Powell Brothers, and
Port LaDania which are all "boat'T'ship" uses. To the west is vacant property, Parcel C
of the Rita Shaw plat, FPL lines and vacant property which is zoned Industrial. To the
north is Taylor Lane, NE 911 St., F.P.L. right of way, right of way for NE 101h St., and the
properties in which Broward County has purchased, (Value Rent a Car, Lancaster
Steel...i.e.). To the south is the Dania cut-off canal and across the canal is residentially
zoned property. The request is to construct additions to the existing 13,858 sq. ft bldg.
The phase 1 addition is 12,030 sq. ft., located at the south side of the present building
toward the Dania Cutoff canal; the second addition proposed is 4,000 sq. ft. located at
the North side of the present building making a total building of 29,888 sq. ft. The
building is located on parcel A of the Transworld plat. 60 parking spaces are provided
on parcels A and B, (20 of which are located on B), which meets the code. The front
and rear set-backs are met. The present building has a 10' side yard setback on the
west and the variance for the additions proposed are to match the existing building and
to keep the access way consistent which is needed for vehicles and operations of the
boat repair facility. The height is proposed to be 47'6" to the peak, the code allows for
only 35'. The building is proposed to be a steel wall building which would match the
existing building.
Mr. Allen introduced Steven Rock who is the Architect for Associated Marine,
addressed the board to answer any questions and to explain the variance requests to
the board. Mr. Rock gave a brief overview of the original building structure. Mr. Rock
explained that similar height variances were approved for surrounding buildings in the
immediate area, with the same use. He explained the need for the additional height as
to be able to provide for the repair of the larger boats under cover due to inclimate
weather, and to keep the dust and debris associated with the repairs of such boats

contained. Presently, they are limited to the size of the boats they can work on under
cover because of the height of their building and either have to work outside weather
permitting, which takes longer or turn the business away. The variance for the side
yard set back is needed to keep a continuous line with the building line for vehicular
access (large boat access and emergency vehicles.) Mr. Scott Miser, owner of
Associated Marine answered questions raised by the board regarding the storage of the
fuel tanks and combustible materials and a clarification of the hardship for the height
variance. Mr. Miser explained that his hardship for the height of the buildin was that
presently it is too costly to work on the average boat because parts of the bc at have to
be dismantled to allow it to fit in the present building; this makes it more ex ensive to
work on the average boat which would causes business to be lost to the n Dighboring
competition. Mr. Allen confirmed the variance hardships and confirmed that,the F.P.L.
power lines are much higher than the proposed height variance request and would
cause no problem with airport flight paths. He also stated that the height is consistent
with the character of the neighborhood. Photographs were distributed to the board, and
after further discussion Chairperson Daise opened this item for public hearing. Hearing
no one and seeing no one, Chairperson Daise closed the public hearing. A question
was raised about the parking being split on two parcels of land, Mr. Allen confirmed that
parking can be on more than 1 location as long as you own it and if the parking was lost
a variance would have to be obtained at a later date. Motion was made by Anthony
Stevens, seconded by Victor Lohmann to recommend approval of VA-25-96. Motion
passed on the following roll call:

3. SP-26-96 - The request of Associated Marine Technologies, Inc. for site plan approval
for the proposed additions to the building at 490 Taylor Lane. The request is to
construct a 12,030 sq. ft. addition to the south side of the existing 13,858 sq. ft. building
as Phase 1 and to construct a 4,000 sq. ft. addition to the north side of the existing
building as Phase 2.
This property is legally described as: Parcels `A' and 'B', Transworld Plat, recorded
in Plat Book 116, Page 8, of the public records of Broward County, Florida.
Chairperson Daise opened the item for public comment. Hearing no one and seeing no
one a motion was made by John Etling, seconded by Anthony Stevens to recommend
approval of SP-26-96. Motion passed on the following roll call:

4. PL-20-96 - A request for preliminary plat approval for 0.747 acres of property located at
the northwest corner of Federal Highway and SW 10 Street. This plat requested by the
Taco Bell Corporation would be titled "TACO BELL AT DANIA".
The petitioner was not in attendance for this item so it was continued to the next regular
Planning and Zoning Board hearing.
