ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY THE PLANNING AND ZONING BOARD AND CITY COMMISSION WITH REGARD TO ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE WHICH INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. SP-21-95 - The request of Sun Gardens, Ltd. for the approval of a site plan for 24 apartments to be known as Sun Garden Apartments on property located on the south side of NW 1st Street (Tigertail Blvd.) and 142 feet west of NW 10 Ct.. This property is legally described as: All of Tract "A", "Stoinoffs Valhalla", according to the plat thereof, as recorded in Plat Book 146, Page 22 of the Public Records of Broward County, Florida, less the South 333.98 feet thereof. Said lands situate in the City of Dania, Broward County, Florida. Will Allen briefly described the proposed site plan to the board, stating that the 2.017 acres is located on the south side of NW 1st Street. Mr. Allen further explained that the project will consist of 2 twelve unit buildings for a total of 24 apartment units, with access coming from NW 1 st Street. The plat of Stoinoff s Valhalla is restricted to 50 garden apartments, 26 units have been built on the south 333 feet of the site and the proposed 24 units meet the plat 1 Planning and Minutes Zoning Board DECEMBER 15, 1995 0 requirements. Mr. Allen confirmed that the site plan is consistent with all zoning district requirements, plat, and meets all the requirements of landscaping, utilities and parking, and concluded with the staff recommending approval. Mr. Allen concluded by introducing Mr. Milton Jones, a registered agent for Sun Gardens, Ltd.. Mr. Jones explained the project to the board and Mr. Al Davis, Architect, was open to any questions from the board. The board questioned the type of units and price range for the rentals. Questions were also raised about the optional tot lot and volleyball court. Motion made by Robert Harris to approve SP-21-95, seconded by Victor Lohmann. Motion passed on the following roll call: John Chamberlain - no Kim Daise - yes Robert Harris - yes Victor Lohmann - yes 2. SP-22-95 - The request of the Broward County Board of County Commissioners for site plan approval for an 18,889 sq. ft. addition to the Broward County Medical Examiners Building at 5301 SW 31 Avenue. This property is legally described as: Parcel `A', Broward County Fire Station No. 5 / Morgue site, according to the plat thereof, as recorded in Plat Book 123, Page 33, of the Public Records of Broward County, Florida. Said lands lying in Broward County, Florida, Containing 9.595 acres more or less. Will Allen explained the site as being in the south western limits of the City! of Dania at the Broward County Morgue. Mr. Allen briefly explained the existing site and the proposed addition. He stated that the property is zoned A-1 Limited Agricultural, and the use permits publicly owned buildings and operational uses. He also noted that this site plan had been previously approved by the City Commission back in 1991. Mr. Allen stated that section 8(4)(p) of the Dania City Code indicates that an approved site plan expires after 18 months. It was further stated that the site plan is the same as the previously approved one with the exception of a 5' berm around the north property line and that an additional 6 trees have been added to the berm area. In 1991 the Commission requested the 5' berm with 2 trees to be added to the site plan. Mr. Allen concluded his summation stating that the site plan conforms to all zoning regulations, it meets all set back, height, parking and landscape requirements and exceeds stipulations placed on it by the City Commission back in 1991. Ed Seymor, Architect for Broward County, was present to answer questions by the board. After questions of the operational uses at the site and landscaping, a motion was made by John Chamberlain seconded by Robert Harris to recommend approval of site plan SP-22-95. Review of Evaluation and Appraisal Report for the City of Dania Comprehensive Plan for transmittal to the Department of Community Affairs. Will Allen introduced Leigh Kerr, of Leigh Kerr and Associates, to give an update of the E.A.R. and to answer any questions by the board. Leigh Kerr pointed out the goals and objectives portion of the plan and referenced significant improvements made in the area of housing in the Northwest section.
