Motion passed unanimously. f 1. PL-02-95 - The request for preliminary plat approval for a 14.84 acre parcel located south of NW 10th Street and west of the F.E.C. Railroad and US 1. This plat is requested by the Broward County Aviation Department. The title of the plat is TRAILS END FLL AIRPORT PLAT (PLAT 5). The property is legally described as follows: A parcel of land being a portion of PASADENA IN HOLLYWOOD as recorded in Plat book 10, page 20 of the public records of Broward County, Florida and a portion of J.E. HASBROUCK's REPLAT as recorded in Plat book 16, page 20 of the Public Records of Broward County, Florida, said parcel being more particularly described as follows: COMMENCE at the Northeast corner of the Northwest One-Quarter (NW1/4) of Section 34, Township 50 South, Range 42 East; THENCE on a grid bearing a S 01°5343" E 1 Planning and MINUTES Zoning Board March 9, 1995 i 0 along the East line of the said Northwest One-Quarter (NW1/4) a distance of 25.01 feet to a line 25.00 feet South of an parallel with the North line of said Northwest One-Quarter (N1/4), said point being the POINT OF BEGINNING; THENCE S 89042'16" W along said parallel line a distance of 999.94 feet to the West line of the East one-Half (E1/2) of Northeast One-Quarter (NE 1/4) of Northwest One- Quarter (NW1/4) of said Section 34; THENCE S 01°51'12" E along the said West line a distance of 637.95 feet to the Southwest corner of the North One-Half(N1/2) of the Northeast One-Quarter NE 1/4 of the said Northwest' One-Quarter (NW1/4); THENCE N 89"26'39" E along the South line of the said North One-Half (N1/2) a distance of 936.17 feet to a line 25.00 feet West of and parallel with the right-of-way line of the Florida East Coast Railway; THENCE N 12038'13" E West g y Y along said parallel line a distance of 624.86 feet; THENCE N 38°48'14" W a distance of 31.17 feet to a line 25.00 feet South of and parallel with the North line of the Northeast One-Quarter (NE 1/4); THENCE S 89042'16" W along said parallel line a distance of 74.01 feet to the POINT OF BEGINNING; Said Land situate within the City of Dania, Broward County, Florida, containing 14.84 acres, more or less. Growth Management Director, Will Allen addressed the board to give an overview of the requested 14.84 acre perimeter plat which is to the south of Griffin Rd. (south of NW 10th Street), west of the F.E.C. R.R. and west of U.S. 1. The location map was displayed for the board and the property was described as having a zoning of C-3. The surrounding properties were described as IRO and RD-6000. Mr. Allen explained that this property was previously the Trail's End Trailer Park property and that all of the trailers have been auctioned off and are presently being removed. A perimeter plat is requested to save the trips that have been associated with the property from the mobile home park. Currently there are 201 mobile homes, a duplex and 3 garden apts. on the site. The proposed use on parcel "A" is for a 16,450 sq. ft. rental car facility and parcel "B" would be used as open space, driveway and buffering (landscaping). Mr. Allen explained that a rental car agency is a special exception use in the C-4 zoning district, so zoning, special exception and site plan petitions would be reviewed at a later date. Variances could also be reviewed if necessary. The access point on NW 10 Street was displayed. The plat shows access of 100 feet on NW 10 Street with a 60' opening on the corner of NW 10th Street to allow for an additional access off Griffin Rd. for the property to the west. The petitioner would have to pay for any excess trips required for a rental car agency. Mr. Allen concluded his summation stating that staff recommends approval of this perimeter plat as it conforms to the platting requirements, the City's code and State Statute. It is also recommended that the right-of-way, that would be granted through the property and serve as the driveway for the proposed rental car agency, serve as the access to the adjoining property which currently has limited access. Leigh Kerr, Planning Consultant representing the property owners to the south, addressed the 2 Planning and MINUTES Zoning Board March 9, 1995 board with concerns of access to their property. For the record, a letter from Leigh Kerr and Associates dated March 9, 1995 was submitted in regards to Trails End FLL Airport Plat 5 and Airport 10 access. Mr. Kerr stated the concerns his client has in obtaining access to their site. Hearing no one and seeing no one further Chairman lacino closed the public hearing. At this time the petition was brought back to the board for discussion. Linda Strutt from Williams, Hattfield and Stoner addressed the board to answer any questions the board might have. Ms. Strutt explained that they were shooting for sometime in June of 1995, for a final approval and then 18 months to record. Motion made by Robert Harris to recommend approval of PL-02-95, seconded by Tim Mc Leod. Motion passed on the following roll call: Tim Mc Leod - yes Robert Harris - yes Cliff lacino - yes Mr. Allen displayed for the board a prepared sketch of the proposed project and briefly discussed the concept. Barbara Monahan, representing Broward County Attorney's Office, addressed the board and stated that the mobile homes on the Trail's End site had been auctioned off and should be removed, and the property cleaned up by March 30, 1995. Linda Strutt stated that as soon as the plat can be approved and recorded, this property will return to the tax rolls. 2. LU-03-95 - Request by Berry and Calvin, Inc. on behalf on VSTNMIF Oakridge Partnership to change the future land use designation for the Banyan Oakridge Commercial Plat at the Southwest corner of Griffin Road and SW 31 Avenue. The proposal is to transmit a proposed amendment to the land use plan by designating 24.1655 acres as Residential Medium 16 DU/AC, which is presently designated as commercial. The property is legally described as follows: All Parcel A, "Banyan Oakridge Commercial Plat" According To The Plat Thereof As Recorded In Plat Book 157, Page 3 Of The Public Records Of Broward County, Florida Less The Following Described Lands: Commence At The Northeast Corner Of Section 31, Township 50 South, Range 42 East; Thence South 00018'53" West Along The East Line Of Said Section A Distance Of 435.55 Feet; Thence North 87030'47" West A Distance Of 40.03 Feet To The Point Of Beginning; Thence Continue North 87030'47" West A Distance Of 581.67 Feet; Thence North 00002'48" West Along A Line 25.00 Feet East Of And Parallel With The Centerline Of A 50. 00 Foot Access Opening, As Shown On Said Banyan Oakridge Commercial Plat A Distance Of 358.10 Feet To An Intersection With The Arc Of A Curve Concave To The South (Said Point Bears South 00009'27" East From The Radius Point Of The Next Described Curve); Thence Easterly Along Said Curve Having A Radius Of 3 Planning and MINUTES Zoning Board March 9, 1995 4 I 7055.00 Feet, A Central Angel Of 01°28'37", And An Arc Distance Of 181.85 Feet To A Point Of Tangency; Thence North 88021'56" East A Distance Of 191.40 Feet; Thence South 87030'47" East A Distance Of 186.50 Feet To A Point Of Curvature; Thence Easterly And Southerly Along The Arc Of A Curve Concave To The Southwest Having A Radius 25.00 Feet. Said Lands Lying In The City Of Dania, Broward County, Florida. Will Allen described this proposal as a request for a Land Use Amendment to change the designation of 24.1655 acres at Griffin and SW 31 Avenue. The present zoning for the entire 29+ acres was described as B-3 (which is commercial) and has a land use of commercial. The request is to change the land use designation for 24 acres of the property from commercial to residential (medium 16 units per acre). This property had a previous land use change for the entire property (29+ acres) to commercial and was platted for a 300,000 sq. ft. shopping center. Five (5) of the acres in the north corner will remain commercial to stay consistent with the zoning along Griffin Rd. The surrounding properties were described as a golf course, which no longer exists, and a small strip center; Key North is directly to the south which has a land use of medium 16 and which zoning allows approximately 15 units per acre (R-3). The process for adoption of a land use amendment was discussed and it was stated that this is the "Transmittal" stage. A public hearing is held by the City Commission which recommends approval of the transmittal and of the land use change. The proposed land use is then transmitted to the State of Florida, Department of Community Affairs, the Regional Planning Council, etc., comments are made in relation to feasibility and is then reviewed by staff and brought back to the City Commission for adoption. Staff Recommends transmittal with a recommendation to approve the amendment. The recommendation is based on the proposed use being compatible with surrounding uses. This change will not have a negative impact on the site or neighborhood. It is consistent with the comprehensive plan goals, objectives and policies. Medium 16 units per acre is consistent with the Key North development to the south. Robert Harris questioned the previous density of the property prior to the first land use change. Mr. Allen responded stating the previous land use was Multi-family 10 and commercial recreation. Information was relayed in reference to the plan meeting concurrency requirements, having adequate levels of service provided and generating significantly less traffic than was previously approved (13,000 trips less per day). As a residential development, land would have to be provided for parks or an impact fee would be collected to provide such land. Water and Sewer usage will increase, but there is capacity to serve these needs through Broward County Utilities. Discussion about the future use of the property was made and Chairman lacino called the public hearing to order. Attorney Edward Stacker addressed the board for the petitioner. Mr. Stacker addressed concerns of past and future land use by the board, and future plans for the site. Dan Smith, project manager representing the owners addressed the board relaying the need to change the land use due to the negative response received in obtaining lessors for the property. He also discussed the future residential, as well as the piece of remaining commercial, plans of the site. Hearing and seeing no one further Chairman lacino closed the public hearing. Motion was made by Tim Mc Leod to recommend approval of the proposed transmittal of the land use change, seconded by Robert Harris. Motion passed on the following roll call: Tim Mc Leod - yes Robert Harris - yes Cliff lacino - yes Chairman lacino announced to the board that after 6 years, the last 2 being Chairman, his intention to retire from the Planning and Zoning board. Chairman lacino expressed his enjoyment on serving. Immediately following adjournment, pictures were taken. Motion made by Tim Mc Leod, seconded by Robert Harris to adjourn.
