REGULAR MEETING
NOVEMBER 7, 1989

APPROVAL OF MINUTES:
A motion not to adopt the minutes of the last meeting which was not
submitted, was made by Irving Spindel , seconded by Joseph Lamarr, and
passed unanimously on a roll call vote .
The City Attorney was asked to read out the items presented for
discussion:
VA-54-89 A variance request to construct two duplexes on the subject
parcel , as follows:
(1 ) West 62. 5 ' of subject parcel :
a) 80 ' lot depth (90 ' required) ;
b) 5, 116 sq. ft . lot (6,000 sq. ft . required) ;
c) 7. 5 ft . rear yard setback ( 15 ft . required) ;
d) Three parking spaces provided (four required) .
(2 ) East 75.0 ' of subject parcel :
a) 80 ' lot depth (90 ' required) ;
b ) 7. 5 ft . rear yard setback ( 15 ft . required) ;
c) Two parking spaces provided (four required) .

property located on the Southwest corner of NE 2nd Avenue
and NE lst Street . (Continued from 10/3/89 ) .
Legally described as Lot 9, Block 5, "Beachway" , according
to the plat thereof as recorded in Plat Book 8, Page 33 of
the Public Records of Broward County, Florida .
Mr. Archie Ryan, Petitioner, explained that the variance
request was first submitted on the September agenda, that
at the October meeting he asked for a continuance to revise
the site plan, and that the revised request is now before
this meeting.
The Chairman opened the hearing to the public. Mr. Rozer
and Mr. Paul Demayo spoke against. No one else spoke and
the Chairman closed the public hearing .
After some discussion, City Attorney Adler suggested that
since the request as set out on the Agenda did not truly
reflect the petitioner's requirements , that he be allowed
to amend and resubmit it at the next meeting.
A motion advising the petitioner to amend and resubmit th'
variance request was made by Joseph Lamarr, seconded b;
Irving Spindel and unanimously passed.

VA-74-89 A variance request to construct a new retail building in
conjunction with an existing apartment building in a C-2
district with 9 parking spaces ( 17 spaces required) .
Petitioner/Owner - Brent M. Godlewski ; property located at
41 NE 1st Avenue (Southeast corner of NE 1st Avenue and NE
lst Street) .
Legally described Lot 1 and less the west 15.0 feet thereof
and Lot 4 and less the west 15.0 feet thereof in block 12
of map of the Town of Modelo Dade County, Florida,
according to the plat thereof recorded in plat Book B at
page 49 of the Public Records of Dade County, Florida, said
lands lying and being in Broward County, Florida.
Mr. Godlewski explained his request .
The Chairman opened the hearing to the public. John
Bruckner stated that he was neither for nor against but in
his opinion further consideration should be given to
parking as the City lacked adequate commercial parking .
The Chairman closed the public hearing.
A motion to deny the request so that the petition could
study ways of providing adequate parking and resubmit his
request at the next meeting, was made by Irving Spindel ,
seconded by Joseph Lamarr and passed unanimously.
SP-82-89 A site plan request for a new retail building in
conjunction with an existing apartment building.
Petitioner/Owner - Brent M. Godlewski ; property located at
41 NE 1st Avenue .
Legally described Lot 1 and less the west 15. 0 feet thereof
and Lot 4 and less the west 15.0 feet thereof in block 12
of map of the Town of Modelo Dade County, Florida,
according to the plat thereof recorded in plat Book B at
page 49 of the Public Records of Dade County, Florida, said
lands lying and being in Broward County, Florida .
The City Attorney, Mr. Frank Adler, pointed out that this
site plan request was a part of and dependent upon the
outcome of the variance request just discussed and should
therefore be continued.
A motion to continue SP-82-89 was made by Joseph Lamarr,
seconded by Irving Spindel and passed unanimously.
ZT-75-89 A zoning text change to permit hand car washes as a special
exception use in a C-3 district . Petitioner - Neil M.
Ferrara; Owner - Robert Summers; property located at 202
South Federal Highway.
Legally described as the North 16. 00 feet of the South
30.94 feet of the East 16.00 feet of the West 59 .95 of Lot
27, Block 'A' of "Park Hill Amended" according to the Plat
thereof , as recorded in Plat Book 3, Page 16 of the Public
Records of Broward County, Florida.
Mr. Archie Ryan representing the Petitioner Mr. Neill
Ferrara, explained the request .
The Chairman opened the meeting to the public. Mr. Robert
Marshall , owner of the Robert Summers Salon and surrounding
property, assured the Board that the car washing would be a
good, clean operation similar to his salon operation.

Mr. Spindel voiced his concern about the proper drainage
for the run-off of soapy water and stated that he felt it
would cause a health hazard.
A motion that both ZT-75-89 and SE-76-89 be continued until
further study of the drainage question could be done and
resubmitted at the next meeting, was made by Irving
Spindel , seconded by Joseph Lamarr and unanimously passed.
SE-76-89 A special exception for a car hand wash in a C-3 district .
Petitioner - Neil M. Ferrara; Owner - Robert Summers;
property located at 202 South Federal Highway.
Legally described as the North 16.00 feet of the South
30.94 feet of the East 16.00 feet of the West 59.95 of Lot
27, Block 'A' of "Park Hill Amended" according to the Plat
thereof , as recorded in Plat Book 3, Page 16 of the Public
Records of Broward County, Florida.

VA-77-89 A variance request to construct a marine service facility
with 79 parking spaces (93 required) . Petitioner (-
Attorney A. J. Ryan, Jr. ; Owner - J. P. Downs; property
located at 800 Old Griffin Road.
Legally described as All of Block 3, and the West 46 feet
of Block 4, "Dania Manor" , according to the Plat thereof as
recorded in Plat Book 10 , Page 53 of the Public Records of
Broward County, Florida. . . . .
Attorney A.J. Ryan, petitioner for J.P. Downs explained the
background of this variance request which is also a part of
SE-78-89 a special exception request , and SP-79-80 a
revised site plan request .
After some discussion, the Chairman opened the meeting to
the public. Leda Scanlan stated that she was neither for
nor against, but wanted to be assured that some type of
landscaping would be done to hinder car lights from shining
into the homes directly across from the property. Vice
Mayor Bob Mikes supported Ms. Scanlan' s request .
A motion to grant the variance request subject to the area
being secured on weekends and when not in use, was made by
Irving Spindel , seconded by Joseph Lamarr, and unanimously
passed.
SE-78-89 A special exception request for supplemental parking for ''a
marine service facility. Petitioner - Attorney A. J. Ryan',
Jr. ; Owner - J. P. Downs; property located at 800 Old
Griffin Road.
Legally described as All of Block 3, and the West 46 feet
of Block 4, "Dania Manor" , according to the Plat thereof as
recorded in Plat Book 10 , Page 53 of the Public Records of
Broward County, Florida. . . . .
Similarly, a motion to grant this special exception request
was made by Irving Spindel , seconded by Joseph Lamarr, and
unanimously passed.
SP-79-89 A revised site plan request for a marine service facility.
Petitioner - Attorney A. J. Ryan, Jr. ; Owner - J. P.
Downs; property located at 800 Old Griffin Road.

A motion to accept the revised site plan request was made
by Irving Spindel , seconded by Joseph Lamarr, and
unanimously passed.
VC-81-89 An alley vacation request to vacate alley between SE 6th
Street and SE 7th Street from SE 3rd Avenue to SE 4th
Avenue in accordance with the following legal description.
Petitioner/Owner - Marc Sessa; property located at SE 6th
Street and SE 7th Street .
Legally described as being a 15. 00 strip of land lying
north of and adjacent to lots 6, 7, 8,9 and 10 of "MARC SESSA
PLAT" according to the plat thereof , as recorded in Plat
Book 131 , Page 39 of the Public Records of Broward County,
Florida; together with a 15.00 foot strip of land lying
within Block-2 of "TOWN AND COUNTRY ESTATES SECTION ONE"
according to the plat thereof , as recorded in Plat Book 95,
Page 12 of the Public Records of Broward County, Florida.
Said lands lying and being in the City of Dania, Broward
County, Florida, containing 9,409 square feet (0. 2160
Acres) more or less .
Mr. Marc Sessa explained the request .
The Chairman opened the meeting to the public. Craig
and Russell Craddock spoke in support of this request .
A motion to grant the alley vacation request was made by
Irving Spindel , seconded by Joseph Lamarr and passed
unanimously.
SP-84-89 A revised site plan for 49 apartment units located in the
Watermark Development . Petitioner/Owner - VMS Dania
Associates, Ltd. ; property located North of Sheridan Street
and EAst of SE 5th Avenue.
Legally described as a revised site plan for Parcels 1 and
2 as shown on the drawings ; being a portion of "U.S. LEND
LEASE NO. ONE" according to the plat thereof as recorded in
Plat Book 111 , Page 44 , of the the Public Records of
Broward County, Florida, as shown on the drawings prepared
by Berry and Calvin, Inc. , for VMS RRC covering TideMark
Condominiums Phase V and further described as Berry and
Calvin Inc. project #89-277 and file #9L-140.
Mr. Kevin Gethardt explained the request .
The Chairman opened the meeting to the public. When no one
spoke either for or against, the Chairman closed the public
hearing.
A motion to accept the revised site plan for which the
building elevation plan #88039, file #9L-140 with VCA Randy
Washington Group had already been recorded, was made by
Joseph Lamarr, seconded by Irving Spindel and unanimously
passed.
Petitioner was advised to appear before the City Commission
at its next meeting.
There being no other business the Chairman adjourned the meeting.
