PLANNING AND ZONING BOARD
REGULAR MEETING
AUGUST 1, 1989
7:30 P.M.

APPROVAL OF MINUTES:
The minutes of the last meeting were not available for approval ,
and the Chairman asked the Board to excuse this and to go on to
the Agenda.
Mr. Leeds introduced the items for discussion as follows :
RZ-33-89 A rezoning request from OpC-3 (Commercial ) to C-4
(Commercial ) . Petitioner/Owner - David Nuby; property
located at 25 & 27 N.W. 4th Avenue.
Legally described as Lots 12 & 13 of Block 15 of 'TOWN
OF MODELO' according to the plat thereof recorded in
Plat Book 'B ' , Page 49 of the Public Records of Dade
County, Florida. Said lands situate, lying and being in
Broward County, Florida.
Petitioner David Nuby explained that his request for
rezoning would allow him to park his trucks, two
back-hoes and storage of construction equipment.
The Chairman opened up the meeting to the public, and
David Nuby Jr. spoke in support of his father's request.
There was no other speaker and the Chairman closed the
public hearing.
Mr. Leeds explained that the rezoning from C-3 to C-4
would allow storage inside a building, but that Mr. Nuby
would also need the variance request which is also
submitted, to allow him to store his trucks, two back-
hoes and other materials outside.
A motion to approve the rezoning was made by Irving
Spindel, seconded by Kathy Kelly and passed unanimously
on a roll call vote.
VA-34-89 A variance request to permit outdoor storage of
construction equipment and construction materials in a
C-4 zoning district. Petitioner/Owner - David Nuby;
property located at 25 & 27 N.W. 4th Avenue.

Legally described as Lots 12 & 13 of Block 15 of 'TOWN
OF MODELO' according to the plat thereof recorded in
Plat Book 'B ' , Page 49 of the Public Records of Dade
County, Florida. Said lands situate, lying and being in
Broward County, Florida.
Mr. Nuby explained that the variance would allow him to
park his truck, backhoes and 3/4 rocks outside.
The Chairman opened the meeting to the public. No one
spoke for or against the variance and the Chairman
closed the public hearing.
A motion to approve the variance subject to Petitioner
constructing a 6g
high fence with slats on all four
sides of the property, landscape the front and put in
four black olive trees, was made by Kathy Kelly,
seconded by Irving Spindel , and passed unanimously on a
roll call vote.
VA-36-89 A variance request to use a trailer as a temporary
office for a time period to be determined by the City
Commission after recommendation by the Planning and
Zoning Board. Petitioner/Owner - Marine Conversions,
Inc. ; property located at 801 N.E. 3rd Street.
Legally described as Parcel A "HARBOUR TOWNE MARINA" as
recorded in Plat Book 118, Page 34.
The Petitioner was not present and the Board voted to
table the matte until the next meeting. A motion in
this regard was made by Kath Kelly, seconded by Irving
Spindel and passed unanimously on a roll call vote.
RZ-47-89 A rezoning request from RD-6000 (Duplex) to C-4
(Commercial ) . Petitioner - A.J. Ryan; Owner - J.P.
Downs ; property located at 800 N.W. 3rd Place.
All of Block 3, and the West 46 feet of Block 4, 'DANIA
MANOR' , according to the plat thereof recorded in Plat
Book 10, Page 53 of the Public Records of Broward
County, Florida. . . . .
Petitioner Ryan stated that the next three items on the
agenda relates to this property. He explained that
Marine Research had approached the developer, Mr. Downs,
about including his facility in their operation. To
accommodate this additional tenant a second storey will
be constructed and additional parking required. This
rezoning would allow them to use a trailer as a
temporary office.
The Chairman opened the meeting to the public. No one
spoke for or against the rezoning and the Chairman
closed the public hearing.
A motion to approve the rezoning was made by Irving
Spindel, seconded by Kathy Kelly and unanimously passed
on a roll call vote.
VA-48-89 A variance request to permit: (a) Automobile parking on
leased property, and (b ) Outdoor storage of construction
equipment and materials on unpaved grassed area.
All of Block 3, and the West 46 feet of Block 4, 'DANIA
MANOR' , according to the plat thereof recorded in Plat
Book 10, Page 53 of the Public Records of Broward
County, Florida. . . . .

Mr. Ryan gave a detailed account of plans for land-
scaping and parking.
The Chairman opened the meeting to the public. No one
spoke for or against the variance and the Chairman
closed the public hearing.
A motion to approve the variance was made by rving
Spindel , seconded by Clifford Iacino and passed
unanimously on a roll call vote.
SP-49-89 A revised site plan request for a Marina Technical
Center (Office/Warehouse/Light Fabrication) and
associated parking and outdoor storage. Petitioner -
A.J. Ryan; Owner - J.P. Downs; property located at 800
N.W. 3rd Place.
All of Block 3, and the West 46 feet of Block 4, ' DANIA
MANOR ' , according to the plat thereof recorded in Plat
Book 10, Page 53 of the Public Records of Broward
County, Florida. . . . .
The Chairman opened the meeting to the public. No one
spoke for or against the variance and the Chairman
closed the public hearing.
After a brief discussion, a motion to approve the
revised site plan was made by Irving Spindel , seconded
by Clifford Iacino, and passed unanimously by a roll
call vote.
PL-53-89 A preliminary plat request for the 'RICHART PLAT'
approximately 2.6 acres. Petitioner - Research Florida,
Inc. ; Owner - Ralph M. Richart; property located North
of Sheridan Street, East of S.E. 5th Avenue.
The West one-half of the West one-half of the Southeast
one-quarter of the Southwest one-quarter of the
Southwest one-quarter, less the South 50 feet for the
road right-of-way purposes, of Section 2, Township 51
South, Range 42 East, Broward County, Florida,
containing 113, 653 sq-ft or 2. 61 acres more or less.
Lou Orrez of Research Florida representing Owner Ralph
Richart, stated that essentially all they were doing was
platting the property. Mr. Leeds explained that platt-
ing is required in order to retain the rights on the
property.
The Chairman opened the meeting to the public. No one
spoke for or against the platting request and the
Chairman closed the public hearing.
A motion to approve the preliminary platting was made by
Kathy Kelly, seconded by Clifford Iacino, and passed
unanimously on a roll call vote.
There being no other business the meeting adjourned on a motion by
Irving Spindel , seconded by Kathy Kelly and unanimously agreed to.
