ROLL CALL Present - Chairman Sam Calandra Vice Chairman Gloria Daly Board Members Anita Serpe Irving Spindel City Attorney Frank Adler Dir. of Growth Management Laurence Leeds Absent - David Nuby MINUTES ABSENT RECOMMENDATIONS: VA-88-88 A variance request to construct a 24 sq. ft. price sign (maximum 15 sq. ft. allowed) . Petitioner - Crown Neon Sign, Inc. ; Owner - Texaco Oil Co. ; property located at 1904 Stirling Road. Legally described as Fort Lauderdale South, Florida (USGS ) guadrange, in the SE 1/4 of the SW 1/4, Section 33, Township 50 South, Range 42 East. Staff indicated that petitioner has been informed this item is to be continued until such time the petitioner brings in a correct legal survey. RZ-01-89 A rezoning request from Broward County B-2 (Community Business) to Broward County C-1 (Business, Repair, Warehouse, Storage) . Petitioner/Owner - Jeanne Towne ; property located at 1850 Stirling Road. Legally described as all that part of the West 1/2 of the West 1/2 of the Southeast 1/4 of the Southeast 1/4 of the Southwest 1/4 of Section 33, Township 50 South, Range 42 East, lying East of the East right-of-way line of State Road No. 9, East of the East limited access right-of-way line of said State Road No. 9, and North of the North right-of-way line of Stirling Road. Less the East 351 ' thereof. Said lands situate in Broward County, Florida, and containing 0. 51230 Acres. Jeanne Towne, the owner stepped forward to explain she has requested Broward County C-1 zoning to permit used car sales. Mr. Adler commented that since this previously annexed property is within the City of Dania, the petitioner can only request a Dania zoning designation. Mr. Adler F indicated that Dania C-3 zoning is consistent with existing Broward County C-2 zoning. The Chairman opened the public hearing, hearing no one speak in favor or opposition, the Chairman closed the public =' hearing. ` Regular Planning & Zoning Board Meeting January 3 , 1989 Lk �Y A motion was made by Gloria Daly, seconded by Anita Serpe to recommend Dania C-3 zoning approval . The motion passed unanimoulsy. The Chairman advised the petitioner to appear before the City Commisson at the next regular City Commission meeting. VA-02-89 A variance request to construct a single family structure with: (a) 44 ' lot width (50 ' required) , (b) 4200 sq. ft. lot (6000 sq. ft . required) , (c) 20 ' front setback (25 ' required) , (d) 5 ' street side yard setback (15 ' required) . Petitioner/owner - Steven Bradley; property located at 54 SE 13 Terrace. Legally described as Lot 41 "ST. JAMES PARK DELMAR" , according to the plat thereof recorded in Plat Book 11, Page 26 of the Public Records of Broward County, Florida. Steven Bradley, the owner stepped forward to explain the need for the variance. Mr. Leeds explained that all code requirements have been met. The Chairman opened the public hearing, hearing no one speak in favor or opposition, the Chairman closed the public hearing. A motion was made by Irving Spindel , seconded by Anita Serpe to recommend approval for the variance. The motion passed unanimously. The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting. RZ-03-89 A rezoning request from M-2 (Industrial ) to C-2 (Commercial ) . Petitioner - McLaughlin Engineering Co. ; Owner - Richard LaPointe ; property located at Griffin Road and I-95. Legally described as that part of Tracts 6, 7, 14 and 15, lying East of the State Road No. 9 (I-95) right-of-way and South of the Dania Cut-Off-Canal , Block 3, of the MARSHALL EVERGLADES LAND COMPANYS SUBDIVISION, according to the plat thereof, recorded in Plat Book 1, Page 98, of the public records of Dade County, Florida. . . . . Staff informed this item has been continued at the request of the petitioner. LUF-04-89 A Land Use Flex change to assign 10. 25 acres of land use flex in accordance with the 20% rule. Petitioner - Mclaughlin Engineering Co. ; Owner - Richard Lapointe; property located at Griffin Road and I-95. Legally described as that part of Tracts 6, 7, 14 and 15, lying East of the State Road No. 9 (I-95 ) right-of-way and South of the Dania Cut-Off-Canal, Block 3, of the MARSHALL EVERGLADES LAND COMPANYS SUBDIVISION, according to the plat thereof, recorded in Plat Book 1, Page 98, of the public records of Dade County, Florida. . . . . Staff informed this item has been continued at the request of the petitioner. PL-05-89 A preliminary plat request for the LaQuinta Plat I . Petitioner - Keith and Schnars; Owner - Rinker Materials Corp. ; property located at 2019 Griffin Road. Legally described as that part of the South 669 feet of Tract 13, Block 3 of the Subdivision of Section 28, Township 50 South, Range 42 East, lying West of the Seaboard Airline Railroad, according to the plat thereof, recorded in Plat # Book 2, Page 32, public records of Dade County, Florida, Regular Planning & Zoning Board Meeting January 3 , 1989 less the West 30 feet thereof and the South 35 feet thereof. . . . . Sheila Rose, of Keith and Schnars, stepped forward to explain the plat request. Mr. Leeds commented that all requirements have been met. The Chairman opened the public hearing, hearing no one speak in favor or opposition, the Chairman closed the public hearing. A motion was made by Gloria Daly, seconded by Anita Serpe to recommend approval for the plat . The motion passed unanimously. The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting. VA-06-89 A variance request to construct a duplex with: (a) 4050 sq. ft. lot (6000 sq. ft. required) , (b) 45 ' frontage ( 50 ' required) , (c) 6 ' front yard setback ( 25 ' required) , (d) 6 ' rear yard setback ( 15 ' required) and (e) Back out parking onto Dania Beach Boulevard (Back our parking prohibited) . Petitioner - Rodney Sloan; Owner - Clarance Kenon; property located at 1310, 1314 West Dania Beach Boulevard. Legally described as the N 60 ft of S 85 ft of E 1/2 of W 225 ft of E 450 ft of the SE 1/4 of NE 1/4 of SE 1/4 of Section 33, Township 50 South, Range 42 East. Subject to road easement over the west 12. 5 ft thereof Broward County, Florida. A motion was made by Gloria Daly, seconded by Irving Spindel to continue this item until next regular meeting of the Planning and Zoning Board. The motion passed unanimously. SP-07-89 An amended site plan request for Villages At Ocean Walk. Petitioner - C.C.L. Consultants; Owner - VMS/RRC Limited Corp. ; property located 701 East Sheridan Street . Legally described as U.S. Lend Lease Plat No. One, Plat Book 111, Page 44 Broward County Records. A subdivision of a portion of Section of 2, Township 51 South, Range 42 East, City of Dania, Broward County, Florida. Mr. Kevin Guthard, of C.C.L. Consultants, stepped to explain the site plan request. Mr. Leeds commented that all code requirements have been met. The Chairman opened the public hearing, hearing no one speak in favor or opposition, the Chairman closed the public hearing. A motion was made by Gloria Daly, seconded by Anita Serpe to recommend approval for the site plan. The motion passed unanimously. The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting. **** At this time the Downtown Development District project was presented to the Planning and Zoning Board for their consideration. A motion was made by Gloria Daly, seconded by Irving Spindel to recommend denial . The motion to deny passed on the following roll call vote : Regular Planning & Zoning Board Meeting January 3 , 1989
