PLANNING AND ZONING BOARD
REGULAR MEETING
JULY 5, 1988
7 : 30 P.M.

RECOMMENDATION:
Recommendations made for all items will be submitted for the City
Commission Meeting of July 26, 1988.
VA-35-88 A variance request to use a trailer for office use .
Petitioner - Richard Collord, III ; Owner - Humane Society of
Broward County, Inc . Property located at 2070 Griffin Road .
Legally described as Lots 1 thru 9, and Lots 13, 14 and 15,
Block 12, HIGHLAND PARK UNIT NO. 2, according to the plat
thereof, recorded in Plat Book 12, Page 29, of the Public
Records of Broward County, Florida . All less right-of-way .
Mr . Collord, stepped forward to represent the Humane
Society ' s variance request . He briefly stated that the need
for the trailer is due to extensive remodeling for the main
facility .
Chairman Calandra opened the public hearing, hearing no one
speak in favor or opposition , Chairman Calandra closed the
public hearing .
Mr. Leeds commented that the trailer is located in the
interior of the site . Mr . Collord stated that the trailer
would not be visible from the road because it ' s located
behind the building .
Mr . Spindel inquired about the trailer ' s sanitary
facilities . Mr . Leeds stated that the trailer would have to
conform with all building code requirements including sani -
tation .
F Mr. Spindel made a motion to grant the variance request for
a one year period, with the stipulation that at the end of
the one year, the petitioner would have to reapply for an
extension . The motion was further discussed, after which it

was amended with the following stipulation, the request
would be for a one year period from the date building permit
is issued . The motion was seconded by Gloria Daly . The
motion passed unanimously .
The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .
VA-41-88 A variance request to construct a single family home with :
(a ) 40 ' lot frontage (60 ' required ) and (b ) 4800 sq . ft lot
( 6000 sq . ft . required ) . Petitioner - Broward County
Community Development ; Owner - Mary Robinson . Property
located at 110 Phippen Rd .
Legally described as Lot 5, Block A, of GEORGE M. PHIPPEN ' S
Subdivision in the N 1/2 of the S 1/2 of the SW 1/4 of the
SW 1/4 of Section 34, Township 50 South of Range 42 East,
except the North 10 feet and also except the East 15 feet,
said 15 feet having been added to the street, as per said
GEORGE M PHIPPEN ' S subdivision as recorded in Plat Book 2 at
page 90, Dade County Records . Said lands lying and situate
in Broward County, Florida .
Fred Bona, Housing Inspector for Broward County, stepped
forward to speak on behalf of the owner . Mr . Bona gave a
summation of the County ' s Community Development program,
followed by the owner ' s need for the variance .
Mr . Leeds commented that the petitioner indiciated he would
be comply with all the requirements and setbacks . Mr . Leeds
added for the record the discussion concerning the possible
widing of Phippen Road in the future . He suggested that the
petitioner consider moving the house back, adding that this
is not a condition of approval .
Chairman Calandra opened the public hearing, hearing no one
speak in favor or opposition, the Chairman closed the public
hearing .
A motion was made by Gloria Daly, seconded by Irving Spindel
to recommend approval for the variance . The motion passed
unanimously .
The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .
VA-42-88 A variance request to add a fourth floor addition to an
existing three floor building to a total height of 48 feet
(Maximum permitted height : 40 feet ) .
SP-43-88 A site plan request to add a fourth floor to an existing
three floor building . Petitioner - John Castilania ; Owner-
District 2 M .E .B .A. Property located at 2 West Dixie
Highway .
Legally described as Lots 1-19, "MAGNOLIA PARK" , Plat Book
2, Page 24 of the Public Records of Broward County, Florida .
Mr . R . Spencer, stepped forward to speak for the variance
request on behalf of M.E .B .A.
Mr . Leeds commented that the zoning in the area only allows
a three story building making it necessary for the
petitioner to ask for a variance . He further stated that
should the board recommend approval the site plan would
still have to meet the South Florida Building Code
requirements .
The Chairman opened the public hearing, hearing no one speak
in favor or opposition, the Chairman closed the public
hearing .

A motion was made by Gloria Daly, seconded by Irving Spindel
to recommend approval for VA-42-88. The motion passed
unanimoulsy . Gloria Daly then made a motion, seconde by
Irving Spindel to recommend approval for SP-43-88. The
motion also passed unanimously .
The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .
VA-44-88 A variance request to construct a 96 sq . ft . sign in an IG
zoning district (maximum permitted : 50 sq . ft . ) . Petitioner
- Triple A Sign ; Owner - Universal Alco . Property located
at 760 NE 7th Avenue .
Legally described as Lot 1, POWELL BROTHERS BARGE TERMINAL,
according to the plat thereof, as recorded in Plat Book 96,
Page 27 , of the Public Records of Broward County, Florida .
Diane Tumez was the representative for the Univeral Alco
variance request . Ms . Tumez explained that the request
would allow the owner the remove a number of existing small
signs, which would be replaced by a larger one, with
changable copy for the other tenants in the area .
The Chairman opened the public, hearing comments from
Vincent Carrol , against the variance request, the Chairman
closed the public hearing .
The Chairman mentioned for the record that this site is
presently in violation of City Code .
Gloria Daly recommended that this item be tabled until such
time that they come into compliance with City Code . Mr .
Spindel concurred with her recommendation .
Gloria Daly then made a motion, seconded by Irving Spindel
to table this item until the next P & Z meeting, to allow
the owners to comply with City Code by removing the signs
from the fence . The petitioner is to submit photographs
showing that the signs have been removed . The motion passed
unanimously . Item continued to the August 2nd meeting of
the Planning and Zoning Board .
VC-45-88 A request to vacate SW 3rd Avenue South of SW 8th Street and
adjacent to Lot 25, Block 3 and Lot 10, Block 2 of the
Woodhaven Amended . Petitioner - Wynn & Sheri Kenyon and
Ruth Stallwood .
Legally described as the E 1/2 of that portion of Eaton St .
(now SW 3rd Avenue ) being adjacent to Lot 25, Block 3, of
"WOODHAVEN AMENDED" and the W 1/2 of that portion of Eaton
St . (now SW 3rd Avenue ) being adjacent to Lot 25, Block 3,
of "WOODHAVEN AMENDED, as recorded in Plat Book 10, Page 56,
of the Public Records of Broward County, Florida, lying
between the westerly extension of the north and south line
of said lot 25. Said lands situate, lying and being in the
City of Dania, Broward County, Florida .
Wynn Kenyon stepped forward to speak for the vacation
request . Mr . Adler mentioned for the record that should the
board recommend approval it should be for all the alley and
not a portion as indicated by the legal description .
The Chairman opened the public hearing, hearing comments
from Charles McKenna in favor of and no one speak in
opposition, the Chairman closed the public hearing .
A motion was made by Irving Spindel , seconded by Gloria Daly
to recommend approval for the vacation with the change that
it is the entire alley of SW 3rd Avenue . The motion passed
unanimously .

The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .
VA-46-88 A variance request to construct a single family home in an
RS-8000 district with : (a ) 67 foot lot width (75 feet
required ) and (b ) 7 . 5 foot side yard setback ( 10 feet
required ) . Petitioner/Owner - Aly Dhanani . Property
located at 600 NE 3rd Street .
Legally described as Lot 1, Block 2, ROYAL PALM VISTA,
according to the Plat thereof, as recorded in Plat Book 41 ,
Page 12 of the Public Records of Broward County, Florida .
The owner Aly Dhanani stepped forward to speak on behalf of ,
his request .
Mr . Leeds asked the owner if the he owned the property east
of his property, Mr . Dhanani replied that someone else owned
the property . Mr. Adler asked about the need for the waiver
of the side setback . Mr . Dhanani replied that he learned of
the insufficient setback after he had submitted his plans to
obtain a building permit .
Mr. Leeds explained to the board how the process works for
obtaining a building permit ; commenting that unless someone
came in prior to submitting plans for permitting they
usually are not aware of the setback requirements, etc .

A motion was made by Irving Spindel , seconded by Gloria Daly
to recommend approval for VA-46-88. The motion passed
unanimously .
The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .
SP-47-88 A site plan request to construct a warehouse in an M-1 zone .
Petitioner/Owner - Frank Kunzig . Property located at corner
of Ravenswood Rd . & SE 31st Street .
Legally described as a parcel of land lying in the SE 1/4 of
Section 20, Township 50 South, Range 42 East, Broward
County, Florida . . . . . . .
Frank Kunzig, 3221 NE 58th Street, Fort Lauderdale, FL . was
present to represent the site plan request .
Mr . Leeds commented that approval should be subject to
petitioner submitting zoning information for the abutting
properties ; and additionally, the approval should be subject
to the approval of annexation into the City .
Mr . Adler stated that the condition should not be subject
to, but should be effective when the annexation is
completed .
A motion was made by Irving Spindel , seconded by Gloria Daly
to continue this item until the August 2nd meeting of the
Planning and Zoning Board to allow the completion of the
annexation process . Mr . Leeds also stated that the
petitioner submit more plan for review with the fire
department The motion passed unanimoulsy .
The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .
VC-51-88 A request to vacate existing 12 foot utility easement .
Petitioner - McLaughlin Engineers ; Owner -John L .A . Bond .
Property located in the 600 Block of Taylor Road .

as recorded in Plat Book 100, Page 37, of the Public Records
of Broward County, Florida . . . . . . . . .
Bob McLaughlin, the petitioner, stepped forward to present
the vacation request .
Discussion ensued regarding dedication of the easement .
The Chairman opened the public hearing, hearing no one speak
in favor or opposition, the Chairman closed the public
hearing .
A motion was made by Gloria Daly, seconded by Irving Spindel
to recommend approval , subject to the easement deed being
received by City . The motion passed unanimously .
The Chairman advised the petitioner to appear before the
City Commission at the next regular City Commission meeting .

ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A
