ROLL CALL Present: Chairman: Sam Calandra Board Members : Irving Spindel David Nuby Anita Serpe City Planner: Laurence Leeds Absent: Vice Chairman: Gloria Daly ( ill ) Building Official: Paul Maxwell (Out of Town) City Attorney: Frank Adler A motion was made by Irving Spindel , seconded by Anita Serpe to approve the minutes for the Regular Meeting of the Planning and Zoning Board of January 5, 1987. The motion passed unanimously. RECOMMENDATION: VA-01-88 A variance request to construct an addition with a 6 ' rear yard setback (15 ' required) . Petitioner/Owner - Leonard & Inez Stewart. Property located at 40 NW 13th Avenue . Legally described as The South 80. 0 feet of the North 400.0 feet of the of the West 75. 0 feet of the East 225. 0 feet o the SE 1/4 of the NE 1/4 of the SE 1/4 of Section 33 , Township 50 South, Range 42 East. Said lands situate , lying and being in Broward County, Florida. The Chairman noted that this item is a continued from the January 5 meeting. Mrs . Stewart stepped forward to renew her request for the 6 ' rear yard setback. Mr. Leeds commented that the site plan has been modified so that in lure of a 6 ' setback the applicant would provide an 8. 07 ' rear setback. The Chairman opened the public hearing, hearing no one speak in favor or opposition the Chairman closed the public hearing. A motion was made by Anita Serpe, seconded by David Nuby to recommend approval for VA-01-88. The motion passed on the following roll call vote: Irving Spindel - No David Nuby - Yes Anita Serpe - Yes Sam Calandra - Yes The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting. VA-05-88 A variance request to construct nine single family homes with a 20 ' setback for the front setback and 15 ' setback for the rear setback (minimum 25 ' required for both yards ) . Regular P & Z Board Meeting February 2, 1988 J! • Petitioner/Owner Seaside Group, Inc. . Property located at 900 block SE 2nd Avenue. Legally described as Lots 1 thru 9 Block 1, DANIA CENTRAL HEIGHTS" . Mr. Ron Tomecek spoke on behalf of the Seaside Groupfor the variance. Mr. Tomecek briefly commented on the need$ for the variance stating that having a street on the north and south side of the lots left a shortage of 5 ' in size. Mr. Leeds commented that the staff is recommending the same setbacks as that of a conventional lot, 25 ' front and 15 ' rear. Mr. Leeds further commented that in additional to the setbacks they are further recommending that the petitioner orient all front yards along the same street and all rear yards along the opposing street, making the block uniform. The Chairman opened the public hearing, hearing no one speak in favor or opposition, the Chairman closed the public hearing. A motion was made by Irving Spindel , seconded by David Nuby to recommend approval for VA-05-88 with a 25 ' front yard setback and 15 ' rear yard setback, and with the condition that the front and rear yards be uniform. The motion passed unanimously. The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting. VA-11-88 A variance request to place three separate electrical meters to an existing residential structure. Petitioner/Owner - Nolan Valene . Property located at 604 SW 2nd Avenue : Legally described as the E1/2 of Lot 24, lots 25 and 26, Block 5, "DANIA HEIGHTS EXTENSION" , according to plat thereof recorded in Plat Book 5, page 19, to the public records of Broward County, Florida. Mr. Valene, of 604 SW 2 Avenue, spoke on behalf of the variance request. Mr. Valene stated that though the '� zoning is duplex, his billing for water and electric has been done for a triplex. Mr. Leeds stated that research of the property shows that are three existing units . Mr. Leeds also that the building records show that the unit was built in 1959, however, there is no permit information that shows if it was built as a triplex, therefore, no permit can be issued for the three meters unless a variance has been granted. He also stated that the board may want to recommend approval subject to verification of existing non-conforming use by the building official . The Chairman opened the public hearing, hearing no one speak in favor or opposition, the Chairman closed the public hearing. A motion was made by Irving Spindel, seconded by Anita Serpe to recommend approval VA-11-88. The motion passed unanimously. The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting. RZ-13-88 A request to rezone 0. 10 Acre R-2 (Duplex) to C-2 (Commercial ) . Petitioner/Owner - Denise Sasso. Property located at 151 SW 18 Avenue. Legally described as Lot 6, in Block 1, of "DOUGLAS HILL" , according to the Plat Book 12, Page 45, of the Public Regular P & Z Board Meeting February 2 , 1988 Records of Broward County, Florida. The Chairman asked for a motion to table this item until the next meeting of the board due to the fact that the petitioner was not present. A motion was made by Irving Spindel, seconded by Anita Serpe to continue this item to the next meeting of the P&Z board. Irving Spindel made a motion to adjourn this session of the P&Z board, motion was duly seconded by Anita Serpe. This meeting was then adjourned. ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY PLANNING AND ZONING BOARD OR CITY COMMISSION WITH RESPECT TO ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED.
