The Chairman of the board called to order the regular meeting of the Planning and Zoning Board at 7 : 33 P .M . ROLL CALL Present : Chairman : Sam Calandra Board Members : Audrey Cassese Gloria Daly Irving Spindel City Attorney : Frank Adler Building Official : Paul Maxwell Absent : Vice Chairman : Howard Blackmon A motion was made by Gloria Daly, seconded by Audrey Cassese, to approve the minutes of the regular meeting of Planning and Zoning Board of April 1 , 1986 . The motion passed unanimously . RECOMMENDATIONS VA-31-86 A Variance to construct a 768 square feet wall sign in an IRO Zoning District (Maximum 60 square feet permitted ) . Petitioner - James Maurer ; Owner - Christine Vitolo . Property located at 2010 N .E . 7th Ave . Legally described as ; All of parcel "A" , a portion of parcels "B" and "C" , "PORT EVERGLADES COMMERCE CENTER" , according to the plat thereof as recorded in Plat Book 122, Page 33, of the public records of Broward County, Florida, together with a portion of the vacated road adjacent to said Port Everglades Commerce Center . . . . Mr . James Maurer, petitioner, 2010 NE 7th Avenue, Dania, was present to speak for the variance and to answer any and all questions . Mr . Maxwell was asked to offer his comments regarding this variance request . Mr . Maxwell explained that the original paved road from Eller Drive to their area has been ripped up by the County and State leaving them with no pave road access at the present time . Mr . Maxwell further stated that there is difficulty trying to find access into the property with the existing construction of US1 and Taylor Rood . Further discussion ensued as to the length of time the sign would be needed and would remain once the construction was completed in that area . Mr . Maurer stated that he would agree to it that this would be the only sign on the west side of the building . 1 The Chairman opened the public hearing . Hearing no one speak in favor or opposition , the Chairman closed the public hearing . A motion was made by Gloria Daly, seconded by Irving Spindel to recommend approval providing for two stipulations ; 1 . That no other signs are errected on the building and 2 . That the petitioner come back before the Zoning Board at the end of two ( 2 ) years from the date of approval for a review of this variance . The motion passed unanimously . The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting . VA-32-86 A Variance request to construct a pool screen enclosure with a 4 ' rear yard setback ( 15 ' required ) . Petitioner/Owner - John J . Vollmann , Jr . Property located at 411 S .E . 3rd Place . Legally described as Lots 15 and 16, Block 4, " OCEANVIEW GOLF ADDITION . " Mr . John J . Vollmann, petitioner/owner, was present to speak for the variance request and to answer any and all questions . Mr . Maxwell reviewed the handout of the layout of the pool with the board members . The Chairman opened the public haearing . Hearing no one speak in favor or opposition , the Chairman closed the public hearing . A motion was made by Audrey Cassese, seconded by Irving Spindel to recommend approval for the variance request . The motion unanimously . The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting . VA-36-86 A Variance request to build a duplex on a lot with ! 60 ' depth ( 90 ' minimum required ) . Petitioner/Owner - Willie '' B . Perry . Property located at 201 NW 8th Avenue and 2nd Street . Legally described as Lots 1 and 2, "A.K. WIXON SUBDIVISION" , according to the plat thereof as recorded in plat book 16, page 1, of the public records of Broward County, Florida . Mr . Luther Jackson , General Contractor, was present to speak for the variance request and to answer any and all questions . The Chairman opened the public hearing . Hearing no one speak in favor or opposition , the Chairman closed the public hearing . A motion was made by Gloria Daly, seconded by Irving Spindel to recommend approval for the variance request . The motion passed unanimously . The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting . PL-33-86 A Plat approval request for the Krilich Plat (Containing 4 . 9 acres more or less) . Petitioner - M .E . Berry ; Owner - Robert Krilich . Property located at Stirling Road . Regular P & Z Board Meeting May 6, 1986 2 Legally described as ; Lots 1 through 6 and Lots 18 through 24 inclusive, Block 1, together with Lots 1 through 12 inclusvie, Block 2 ; that portion of SW 18th Court (Formerly Fern Street ) lying adjacent to said Lots 18 through 24, Block 1 and adjacent to said Lots 1 through 7 , said Block 2 ; and all of SW 1st street ( Formerly First Avenue SW ) . All according to the Plat of "DOUGLAS HILL" , as recorded in Plat Book 12, Page 45, of the public records of Broward ', County, Florida . VC-34-86 A Road Vacation request to vacate (A) Portion of SW 18th Court between SW 1st Street and Stirling Road, ( B ) IAll of SW 1st Street, West of SW 18th Avenue . Petitioner/M .E . Berry ; Owner - Robert Krilich . Property located at Stirling Road . Legally described as ; Lots 1 through 6 and Lots 18 through 24 inclusive, Block 1, together with Lots 1 through 12 inclusvie, Block 2 ; that portion of SW 18th Court ( Formerly Fern Street ) lying adjacent to said Lots 18 through 24, Block 1 and adjacent to said Lots 1 through 7 , sai Block 2 ; and all of SW 1st street ( Formerly First Avenue SW I . All according to the Plat of " DOUGLAS HILL" , as recorded in Plat Book 12, Page 45, of the public records of Broward ' County, Florida . Mr . Maurice Berry, of Berry & Calvin, Land Surveyors, 3129 N 29th Ave . , Hollywood, was present to speak and any and all questions regarding the plat and vacation requests . Mr . Maxwell spoke in opposition of the vacation , indiciating that the unitlity lines run down 18th Court and S .W . 1st Street and connects to S .W . 18th Avenue runs to Stirling Road . Mr . Maxwell stated that there would be no problem vacating the 18th Court right-of-way if we could get a dedicated right-of-way through there or a definitive plan on the proposal for the hotel office complex, further stating that he had spoken with Gene Kolnick on this matter . Mr . Maxwell further stated that he didn ' t think that the vacation of right-of-way should be granted , providing no access back in that area without getting a rededication of other access . He also indicated that the plat request is contingent upon the vacation and that the right-of-way be included on the plat if it were going to be considered tonight . Further discussion ensued as to the submitting of a definitive site plan showing the subject right-of-ways for access in that area . Mr . Adler advised the board that these petitions could be approved contingent upon the alternate right-of-way and, provisions for the removal of the utilities, all must be done to the satisfaction of the Building Official and City Engineer . The Chairman opened the public hearing . Mr . Eugene Kolnick, of 2500 Hollywood Blvd . , comment in favor of the plat and vacation requests . Ms . Eve Wagner, 2455 E . Sunrise Blvd . , Suite 1200, Fort Lauderdale, Fl . representive of the owners of a portion of the property, lots 1 - 7, Block 2, Douglas Hill subdivision , spoke in opposition of the plat approval request . A motion was made by Gloria Daly, seconded by Irving Spindel to recommend denial for VC-34-86 . The motion passed unanimously . A motion was made by Gloria Daly, seconded by Irvi'Ing Spindel to recommend denial for PL-33-86 . The motion passed unanimously . Regular P & Z Board Meeting May 6, 1986 3 The Chairman advised the petitioner to appear before the City Commission at the next regular City Commission meeting . The Chairman called for a motion to adjourn , motion to adjourn by Gloria Daly, seconded by Irving Spindel . Any person who decides to appeal any decision made by Planning and Zoning Board or City Commission with respect to any matter considered at this meeting or hearing will need a record of the proceedings, and for such purpose may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based .
