HomeMy WebLinkAbout1979-07-05 Planning and Zoning Board Minutes MINUTES DANIA PLANNING & ZONING BOARD REGULAR MEETING JULY 5, 1979 7:30 P.M. i 1 MEMBERS PRESENT OTHERS PRESENT Skeet Jernigan, Chairman Luther Sparkman, Zoning Consultant Charles DeMuzzio, Vice Chairman Paul Maxwell, Building Official Ray Carvalho MEMBERS ABSENT George Hewlett Rholanda Higgs The regular meeting of the Planning & Zoning Board was called to order by Mr. Jernigan, Chairman. Motion was made by Charles DeMuzzio to approve the minutes of the last regular meeting of June 5, 1979; seconded by Ray Carvalho and passed unanimously. RECOMMENDATIONS TO CITY COMMISSION - City Commission meeting of July 10, 1979 Mr. Jernigan announced that Mr. John Bertino had a request; Mr. Bertino came forward and requested that his agenda item be moved to number one on the agenda; Mr. Bertino has a meeting to attend with the City of Miramar at 8:00 p.m; hearing no objections from the board members or from the audience, Mr. Jernigan moved Item No. 6 to Item No. 1 on the agenda: 1. PZ-26-79 - Mr. Jernigan read the agenda item: "PZ-26-79 - A variance is requested by John M. Bertino for the property located at 211 Southeast Second Terrace, legally described as the West 20 feet of Lot 17 and the East '';50 feet of Lot 18, Block 1, Dania Golf View subdivision. Request is made to allow the construction of a single family residence with insufficient setbacks. Subject property is zoned RS-6000 (single family residential) ." Mr. Bertino stated that he wished to construct a single family residence on the subject lot, however, in order to fit in a two-car garage, Ire would need a variance of 3 feet for the required side yard setback. Mr. Bertino's plans are designed for a 4 foot setback for the garage only; all other setbacks for the residence are met. Mr. Bertino explained that Mr. Bydo who owns the property directly next to subject property has no objections, and has signed his petition for variance. Mr. Bertino stated that in order to conform to the required setbacks, it would cause a hardship because he would have to go to a large expense in having his plans revised. No one was present in objection to this variance request. Mr. Maxwell stated that,basically,the variance is for the length of the garage; there is no way that he could accommodatethat garage in the rear of the home without a variance. Luther Sparkman .stated that since there was no objection from the adjacent property owner, he would recommend approval. Motion was made by Ray Carvalho to recommend approval of variance request PZ-26-79.-for. the.width of the garage only; seconded by Charles DeMuzzlo and passed unanimously. Mr. Jernigan advised Mr. Bertino to appear before the City Commission on July 10th. 1 2. PZ-19-79 - Mr. Jernigan read the agenda item: "PZ-19-79 - Deferred from the last regular meeting of June 5, 1979 - Request is made by Mr. Herbert Penn, Jr. for a variance to allow the construction of a school of sign painting and commercial art in an RS-6000 (single family residential)lzone. Subject property is located on the southwest corner of Phippen Road and Southwest Tenth Street, legally described as Lot 8 & 9, Block 1, College Tract." Mr. Herbert Penn came forward and presented the Board with a revised site plan; parking spaces are arranged so that they do not back up into the street; the size of the building had to be decreased slightly on the revised site plan. Mr. Maxwell stated that Mr. Penn did come into the Building Department; the setbacks, landscaping and parking seem to be adequate. Mr. Carvalho stated that he checked, and there is no school of sign painting in Broward County. There was no one present in objection to this request. Mr. Sparkman recommended approval. Motion was made by Charles DeMuzzio to recommend approval of Variance,Request PZ-19-79 with the stipulation that the hedge be heavy enough to keep vehicles from entering the property other than specific entrances and exits and that all other landscaping requirements be met; motion seconded by Ray Carvalhm and passed unanimously. Mr. Jernigan advised Mr. Penn to appear before the City Commission on July loth. 3. PZ-22-79 - Mr. Jernigan read the agenda item: "PZ-22-79 - Request is made by Frederick A. Gunther for a variance to allow the construction of a sun deck, sun roof, carport and whirlpool with insufficient setbacks. Subject property is located at 344 Northeast Second Court, legally described as Parcel A, less the South 73.37 feet thereof, "A Replat of Lots 11, 12, 13, 14 & 15, Block 2, of an Amended Plat of Blocks 4, 5 & A Portion of 6, Poinciana Park, and is zoned RS-8000 (single family residential) . Juanita Gunther came forward and stated that she and her husband wish a variance so they may construct a sun deck, sun roof, carport and whirlpool. Mr. Jack McClound of 1406 NE 15 Avenue, Fort Lauderdale, came forward as a friend of the Gunther's to clairify what they propose. Ray Carvalho stated that since the Gunther's are his neighbor that he considered it a conflict of intrest and he abstained from voting. Motion was made by Charles DeMuzzio to postpone this item until the next regular meeting due to the fact that with Mr. Carvalho abstaining there was not a quorum and also for the petitioner to present another site plan showing morelspecific Motion was seconded by Ray Carvalho and passed unanimously. 4. PZ-23-79 - Mr. Jernigan read the agenda item: "PZ-23-79 - Request is made by Eric D. Kuritzky for a variance to allow the issuance of an occupational license for telephone use only from a residential address. Subject property is located at 287 Southwest Eighth Street, legally described as Lot 2, Block 2, Dania Homesites, and zoned RD-6000 (duplex) ." Eric Kuritzky came forward and stated that he would like to have his business address from his home for telephone use only; if his business proceeds to grow, he will open an -.office in a business district; he has no intentions of having persons in his house for business purposes. No one was present in objection to this variance request. Mr. Maxwell stated that Dania's zoning ordinance does not allow business licenses to be issued from a residential address, however, some cities do; as long as there is no"in and out" traffic, he could see no problem; the Board might desire to put a time limit on it. Planning & Zoning Board - 2 - July 5, 1979 Regular Meeting Mr. Sparkman recommended approval. A motion was made by Ray Carvalho to recommend approval of Variance Request PZ-23-79 on a one-year basis, at which time he would have to reapply to request continuation of the use; seconded by Charles DeMuzzio and passed unanimously. Mr. Jernigan advised Mr. Kuritzky to appear before the City Commission on July loth. 5. PZ-24-79 - Mr. Jernigan read the agenda item: "PZ-24-79 - Request is made by Frank Marano for a variance to allow an automobile rental agency in a C-2 (general business ) zoning classification. Subject property is located at 1421 North Federal Highway and legally described as: All of that portion of the NW4 of the SE't of Section 27, Township 50 South, Range 42 East, described as follows: Beginning at a point on the west line of Federal Highway as now located and established, which is 200 feet North of the South line of said NW4 of the SE4 of Section 27, which distance would be measured at right angles to said South line; thence, west parallel to said South line of the NW4 of the SE4 of the Easterly line of the Florida East Coast Railway as now located and established; thence, northeasterly along the Easterly line of said railway. to a point which would be 300 feet North of the said South line of the NW4 of the SAr of Section 27; thence, East parallel to said South line of the NW4 of the SEA of Section 27 to the Westerly line of the Federal Highway as now located and established; thence, Southwesterly along the Westerly line of the Federal Highway to the point of beginning." Mr. Marano was present to represent his petition; he presented a proposed site plan to the Board. He stated that he wishes to operate an auto rental agency with daily and long term leasing; they will have no repairs on the premises, only a car wash. Mr. Robert Roll of 136 East Boca Raton Road, Boca Raton, Architect, was also present. No one was present in objection to this request. A motion was made by Charles DeMuzzio to recommend approval of Variance Request PZ-24-79 with the stipulation that there should be shubberies from the sidewalk to the building line on Federal Highway; seconded by Ray Carvalho and passed unanimously. Mr. Jernigan advised Mr. Marano to appear before the City Commission on July 10th. 6. PZ-25-79 - Mr. Jernigan read the agenda item: "PZ-25-79 - Request is made by James V. DeBartolo for a variance to allow a duplex on a lot of insufficient width. Subject property is located at 290 Southwest Ninth Street, legally described as Lot 20, Block 2, Dania Homesites, and is zoned RD-6000 (Duplex) ." Mr. DeBartolo of 290 SW 9th Street came forward to represent his petition. Mr. Maxwell stated that subject property is zoned RD-600, however, the lot is only 50 feet in width. Subject property has been used as two units, however, city records have it designated as only one unit. Mr. Sparkman recommended approval of this variance request. June Silvernale of 275 Southwest 9th Street came forward in favor of this variance request; Mr. DeBartolo is her neighbor. A motion was made by Ray Carvalho to recommend approval of Variance Request PZ-25-79; seconded by Charles DeMuzzio and passed unanimously. Mr. Jernigan advised Mr. DeBartolo to appear before the City Commission meeting of July 10th. Planning & Zoning Board - 3 - July 5, 1979- Regular Meeting 7. PZ-27-79 - Mr. Jernigan read the agenda item: "Request is made by Louis Marrone to rezone from RS-8000 (single family residential) to RM (multi- family, 12 units per acre) . Subject property is located at the northwest parcel of the intersection of Gulfstream Road and Northeast Third Street, legally described as the East ;� of the NE�'d of the SW4 of the NWJr, less the North 216 feet thereof, and less road right-of-way in Section 35, Township 50 South, '!Range 42 East; said lands situate, lying and being in Broward County, Florida." Louis Marrone of 505 Northeast Third Street, Dania, was present to represent his petition. Mr. Marrone stated he is requesting a zoning change from R5-8000 to RM; he presented a proposed site plan. The submitted site plan indicated approximately 30 units, however, the proposed site, if rezoned to RM, could only accommodate only between 20 to 24 units. A motion was made by Ray Carvalho to postpone request for rezoning by Louis Marrone until the next regular meeting of the Planning & Zoning Board in August; motion seconded by Charles DeMuzzio and passed unanimously. OLD BUSINESS The Planning & Zoning Board instructed Mr. Maxwell to have Mr.: Baldyga of Stutsman Associates provide the Planning & Zoning Board with an outline of the progress of the City's land use plan. Mr. Carvalho stated that he still has noticed cars for sale at the auto rental facilities on North Federal Highway. Mr. Jernigan stated that he has had complaints of tires along North Federal Highway; he believed they may have been dropped on the highway from the tire business located at 1000 North Federal Highway; he asked for the Building Department to look into this matter.
