DANIA PLANNING & ZONING BOARD
REGULAR MEETING
AUGUST 5, 1980
7 : 30 P.M.

The regular meeting of the Planning & Zoning Board was called to
order by Mr. Jernigan.
The roll call was taken with Ray Carvalho and Loretha Waiters
being absent.
Motion was made by Charles DeMuzzio to approve the minutes of the
last regular meeting of July 1, 1980, as presented; seconded by
George Hewlett and passed unanimously.
RECOMMENDATIONS TO CITY COMMISSION - Recommendations made at this
regular meeting of the Planning & Zoning Board will be submitted
to the City Commission for the regular City Commission meeting of
August 12, 1980.
1. PZ-27-80 - Mr. Jernigan announced the agenda item: "PZ�-27-80
This item was deferred at the last regular meeting of the Planning &
Zoning Board - Request is made by Jasper C. Thomas for the property
located at 224 Northwest 13 Court, legally described as Lot, 3, the
North one-half, Block 1, Sun Gardens, for a variance from O'rdinance
No. 230 & 236 to allow the storage of a tractor in the rear yard
on subject premises; said property is zoned R-2 (duplex) .
No one was present at this time to represent this petition.'
2. PZ-29-80 - Mr. Jernigan announced the agenda item: 11PZ�-29-80 -
Request is made by Domal, Inc. d/b/a Drydock for the property located
at 1104 South Federal Highway, legally described as Lots 1111, 12 &
13 , Block 47, North Hollywood Subdivision, according to the', plat
thereof recorded in Plat Book 4 , Page 1, Public Records of froward
County, Florida; for a variance from Ordinance No. 82 of the City of
Dania to allow the consumption of liquor on the premises at� 12 : 00 M.
(noon) on Sundays; subject property is zoned C-3 (commercial) . "
Mr. Domenick G. Lacertosa, owner of the Drydock, was present to
represent this petition. Mr. Lacertosa explained that due to the
construction of U.S. Highway No. 1, he has had approximately a
40% decrease in business. He explained that in order to promote
new business, he would like to serve alcohol at 12 : 00 noon on
Sundays.
John R. Brabham, Pastor of Dania United Methodist Church., came
forward in objection and presented a letter of this objection to
the Board; he quoted the second paragraph of this letter:
"I want to express my strong opposition to the granting
of this variance that has been requested by the Drydock
Private Pub. Dania United Methodist Church has also
gone on record in opposing this request for a variance.
I am enclosing the signatures of some the the Administrative
Board members and other members and constituents
who want to vioce their opposition. The Adminis-
trative Board at its regular meeting on July 14 , 1980
voiced its opposition and requested that this be made
known to the entire congregation and to the Dania
City Commission. I am using this method to let our
voice be heard. "
Mr. Hewlett stated that he did not believe that this was a matter
for the Planning & Zoning Board. Mr. DeMuzzio stated that he
felt 1 :00 p.m. on Sundays was a good hour to start the sale of
alcohol. Mr. Lacertosa stated that 1:00 p.m. on Sundays is not
a state law.
Mr. Sparkman stated that the Planning & Zoning Board is acting as
a board of appeals; he recommended that this request be denied
and that the hardship declared is only temporary.
Motion was made by George Hewlett to recommend denial of variance
request PZ-29-80; seconded by Charles DeMuzzio and passed on the
following roll call vote:

3. PZ-32-80 - Mr. Jernigan announced the agenda item: "PZ-32-80 -
Request is made by G. Robert Harris, as petitioner for Raymond E.
Lopes, for the property located at 706 .Northwest Seventh Street,
legally described as Lot 5, Block 4 , Melaleuca Gardens, for a variance
to allow the parking of a 1975 Kenworth tractor on the above subject
property, which is in conflict with Ordinance No. 230 & 236 of the
City of Dania. Subject property is zoned RS-6000 (single family
residential) . "
Mr. Robert Harris came forward to represent this petition; he
explained that the city has recently passed an ordinance regulating
the parking of commercial and recreational vehicles in residential
areas and that the city also made a stipulation in this ordinance
for a variance procedure for persons who were not in compliance.
Mr. Jernigan asked for persons in favor of this request to ',,come
forward; no one stepped forward.
Mr. Jernigan asked for persons in objection to this request to
come forward:
Anita Scanlon (also representing her husband, John Scanlon)
stated that she lives directly across the street from '
subject property; she presented pictures of 706 NW 7th
Street to the Board; she stated that the property is
kept very well, however, the truck stored on the propejrty
devaluates the surrounding properties and that she and
her husband are woke up in the middle of the night by
Mr. Lopes' truck when he leaves for work.
Irma Johnson of 718 NW 12 Avenue came forward in objection;
she was in objection to trucks, etc. being kept in residential
districts.
Rachael Cornel, who lives directly across from subject
property, came forward in objection
Mary Westhoff, 610 NW 10 Street, came forward in objection.
Mr. Jernigan announced that there were letters of objection in the
file from: Dr. Alfred Rittersbacher of 605 NW 7th Street;
Christopher S. Look, Jr. ; Saeed Morad of 713 NW 7th Street;
Flora & Harry Litke of 614 NW 7th Street.

Robert Harris stated that this residential area is bordered by
the Airport and the Dania Cut-Off Canal, etc. ; he felt these
surroundings caused more noise than trucks.
Mr. Jernigan read Section 78-97.1 of Ordinance No.236 which states
that a variance from this ordinance must be a hardship.
Mr. Sparkman recommended that this variance request be denied.
Motion was made by George Hewlett that PZ-32-80 be recommended for
denial; seconded by Charles DeMuzzio and passed unanimously.
Mr. Jernigan advised Mr. Harris to appear before the City Commission
on August 12th.
4. PZ-33-80 - Mr. Jernigan announced the agenda item: "PZ-33-80 -
Request is made by Robert Harris, as petitioner for James C. Becker,
for the property located at 809 Northwest Seventh Avenue, legally
described as Lot 8, Block 3, Melaleuca Gardens Resubdivisionr for
a variance to allow the rebuilding of a 1968 International truck
and the parking of said vehicle on subject property, which is in
conflict with Ordinance No. 230 & 236 of the City of Dania. "
Mr. Robert Harris appeared to represent this request.
Mrs. Scanlon came forward in objection to this request. Mr. Barney
Varnen of 810 NW 8th Avenue came forward in objection to this request.
Luther Sparkman recommended that this request be denied.
Motion was made by Charles DeMuzzio to recommend denial of PZ-33-80;
seconded by George Hewlett and passed unanimously.
Mr. Harris was advised to appear before the City Commission on
August 12th.
1. (Continued) Mr. Jernigan asked if anyone was present at this
time to represent PZ-27-80 for Mr. Jasper Thomas.
Pamela Thomas, Jasper Thomas' daughter, was present and advised the
Board that the tractor has been moved.
5. PZ-34-80 - Mr. Jernigan announced the agenda item: "PZ-34-80 -
Request is made by G. Robert Harris, as petitioner for Ray Harvey,
for the property located at 709 Northwest Sixth Avenue, legally
described as Lot 13, Block 5, Melaleuca Gardens, for a variance to
allow a 1968 four-door Oldsmobile to be parked in the back yard of
subject property until December 1981, which is in conflict with
Ordinance No. 230 & 236 of the City of Dania. Subject property is
zoned RS-6000 (single family residential) . "
Mr. Robert Harris was present to represent this request.
John Westhoff and Mary Westhoff of 610 NW 7th Street spoke in objection
of this request. They stated that the car is stored in the owners
rear yard, which overlooks their rear yard and that subject car ' is
an eyesore.
Mr. Sparkman suggested that Mr. Harvey have an up-to-date license
plate put on the car so that it would not be in violation.
Motion was made by Charles DeMuzzio to recommend denial of PZ-34-80;
seconded by George Hewlett and passed unanimously.
Mr. Jernigan advised Mr. Harris that the Planning & Zoning Board is
a recommending board only and that he should appear before the City
Commission on August 12th.

NEW BUSINESS
6. Request Planning & Zoning Board' s comments on preliminary site
plan.
Mr. John Farina of Broome & Farina, City' s consulting engineers,
presented this request. Mr. Farina stated that Mr. Eugene Ward
of Public Storage, Inc. has requested that the Planning & Zoning
Board review their plan for self service storage facility proposed
on North Federal Highway (Richland Little Farms subdivision) L
Mr. Farina also read a letter from Mr. Ward; a copy of this letter
is attached and made a part of these minutes.
Mr. Ward is requesting that the rights-of-way shown on this plan
be designated as easements. Mr. Farina stated that the developer
is aware of plans for the air port expansion and is willing to take
the chance.
Mr. Sparkman recommended approval of this site plan as submitted
with the dedications as easements rather than right-of-way.
Motion was made by George Hewlett to recommend approval of the
submitted site plan for Public Storage, Inc. for proposed warehouse
storage facility on Lot 1, Block 2 , and Lots 17-24 , Block B, Richland
Little Farms with easements; motion was seconded by Charles DeMuzzio
and passed unanimously.
OLD BUSINESS
Mr. Sparkman presented a report from the Building Official on the
outcome of the public hearing before the Broward County Commission
on Dania' s land use plan which was held July 16, 1980.

U.S. Highway # 1 , at Ft. Lauderdale Airport
Dear Mr. Maxwell :
The five sets of site plans presented to you dated 5/21/80 with revision
dated 7/24/80 are to be discussed at a Planning & Zoning Hearing on
August 5, 1980
In view of the future plans of building and run way expansion as planned
by the Ft. Lauderdale Airport, we ask that the plans be approved with
items- deleted as stated below:
1. Delete 15'-0 Right-of-Way easement at. East Property Line.
2. Delete 22'-6" Street Dedication at South Property Line.
3. Delete 30'-0" Street Dedication at North Property Line.
We have examined a copy of the "Options for Development" 1979, Fort
Lauderdale - Hollywood International Airport, dated October 4, 1979,
that indicate the taking. of this property for use by the program, in the
next several years. Based on this. report, which has been approved and is
now being initiated, there is no need for street dedications, easements, etc.
Thank you for your consideration in this matter. Our schedule still calls
for immediate construction, as the time-table indicated for the Airport
Program will allow us to complete our project to our satisfaction.
