MEMBERS PRESENT OTHERS PRESENT Skeet Jernigan, Chairman Luther Sparkman, Zoning Consultant Loretha Waiters, Vice Chairman Paul Maxwell, Building Official Howard Blackmon Sam Calandra Helen Udell The regular meeting of the Planning and Zoning Board was called to order by Skeet Jernigan, Chairman. Motion was made by Loretha Waiters to approve the minutes of the last regular meeting of October 6, 1981, as presented; seconded by Sam Calandra and passed unanimousl*,. . RECOMMENDATIONS TO CITY COMMISSION - Recommendations made at this regular meeting of the Planning and Zoning Board will be submitted to the City Commission for the regular City Commission meeting of November 10, 1981. 1. PZ-44-81 - Mr. Jernigan announced the agenda item: "PZ-44-81 - Request is made by Second Time Around for a special exception to allow entertainment on Friday, Saturday and Sunday starting at 8 :00 p.m. in a C-2 (commercial) zoning classification; specifically, live music with a singer, for the property located at 625 East Dania "-� • Be'abh doulevard, legally described as that portion of the SE4 of the N474 of the SW4 of Section 35, Township 50 South, Range 42 East, Broward County, Florida, described as follows: From the SE corner of said SE4 of the NW4 of the SW4 run westerly along the south line of said SE4 of the NW4 of the SW4 a distance of 25 feet thence, northerly parallel with and 25 feet west of the east line of said SE4 of the NW4 of the SA, a distance of 326 .39 feet to the point of beginning; thence, continue northerly parallel with and 25 feet west of said east line a distance of 315. 5 feet, more or less, to the north line of said SE4 of the NW4 of the SW4, thence, westerly along said north line 639. 9 feet, more or less to the west line of said SE4 of the NA of the SA thence southerly along said west line 23. 62 feet; thence easterly on a line parallel with the north line of said SE4 of the NW4 of the SW4 a distance of 30 feet; thence, southerly on a line 30 feet east of and parallel with said west line a distance of 185 feet, thence westerly on a line parallel with the north line of the SE4 of the NW4 of the SA a distance of 30 feet to said west line a distance of 102 . 9 feet; thence easterly on a line 250 feet north of and parallel with the north right-of-sway line of Dania Beach Boule- vard 640. 2 feet, more or less, to the point of beginning. "' Valerie Peters was present to represent this petition; she explained that they would like live entertainment; /at the most four musicians. Steve Vanic of the Blue Water Dive Center, next door to Second Time Around, came forward in objection. He explained that when music is played next door that they are unable to do business. He explained that you are able to hear normal voice tones from next door. Mr. Vanic stated that he holds scuba classes in the evenings. Ms. Peters explained that they only wish entertainment on the weekends so that it would not interfere with the dive shop. Mr. Vanic stated that if entertainment was restricted for Friday, Saturday and Sunday after 8 : 00 p.m. that it would not interfere with his business (with no rehersals during his working hours) . Mr. Sparkman recommended approval; he felt that if approved for only the weekends, both businesses could operate without conflict. Mr. Maxwell recommended that the type of entertainment be specified if recommended for approval by the Planning and Zoning Board. Motion was made by Sam Calandra to recommend approval of PZ-44-81, request for special exception for entertainment on Friday, Saturday and Sunday after 8 :00 p.m. only,with the stipulation that the variance will be allowed for one year; seconded by Howard Blackmon and passed on the following roll call vote: Helen Udell - No Loretha Waiters - Yes Sam Calandra - Yes Skeet Jernigan .- Yes Howard Blackmon - Yes Mr. Jernigan advised Ms. Peters to appear before the City Commission on November 10, 1981. 2. PZ-45-81 - Mr. Jernigan announced the agenda item: "PZ-45-81 - Request is made by The Southland Corporation for a variance to allow gasoline sales in a C-2 (commercial) zoning classification on the property located at 205 East Dania Beach Boulevard, legally described as all of Block 3, Beachway Amended according to the plat thereof recorded in Plat Book 27 , Page 7 , of the public records of Broward County, y Florida. Mr. Richard Imperial, Construction Manager for The Southland Corporation, stated that they will try to upgrade their image through landscaping. Mr. Maxwell pointed out that the lot next to the 7-11 is owned by the Southland Corporation and it is on this lot which they propose to put the gasoline pumps and supply 3 additional parking spaces. Mr. Sparkman recommended denial of this variance. Motion was made by Howard Blackmon to recommend denial of variance request PZ-45-81; seconded by Helen Udell and passed on the following roll call vote: Helen Udell - Yes Loretha Waiters - Yes Sam Calandra - Yes Skeet Jernigan - Yes Howard Blackmon - No Mr. Jernigan advised Mr. Kopelman to appear before the City Commission on November 10, 1981. 3. PZ-46-81 - Mr. Jernigan announced the agenda item: "PZ-46-81 - Request is made by Ceasar Favarato for a variance to allow the construction of a structure with insufficient setbacks and lot size requirements in an I-G (industrial, general) zoning classification for the property located at 901 Phippen Road, legally described as Lot 1, Block 4 , College Tract First Addition according to the plat thereof as recorded in Plat Book 22 , Page 10 of the public records of Broward County, Florida. " Planning & Zoning Board - 2 - November 3, 1981 Regular Meeting Kenneth J. Spry, Architect, came forward to present this variance request by Ceasar Favarato. No one was present in objection to this request. Mr. Maxwell pointed out on the traffic ways map that this property would fall into the 80 foot right-of-way proposed for SW 4th Court. Mr. Maxwell explained that the request last month for plat approval of Hawthorne Industrial Plat was affected by the same right-of-way requirement, and that the request to eliminate this street as a collector on the traffic ways plan was denied by the City Commission. Mr. Maxwell stated that to require an 80 foot right-of-way would make this lot unusable. Mr. Sparkman recommend approval of the requested variance subject to the traffic ways plan being revised to eliminate SW 4th Court as 80 foot right-of-way. Motion was made by Howard Blackmon that variance request PZ-46-81 be approved provided that the City Commission request a change on the traffice ways plan to eliminate the 80 foot right-of-way for SW 4th Court and not until the Broward County Traffic Ways plan has been amended; seconded by Loretha Waiters and passed unanimsouly.. Mr. Jernigan advised Mr. Spry to appear before the City Commission on November loth. 4. PZ-47-81 - Mr. Jernigan announced the agenda item: "PZ-47-81 - Request is made by Karsten G. Olsen, Diversified Oil Company, Inc. , for a specail exception to allow oil reclamation and tank farm in an I-G (industrial, general) zoning classification for the property located on Taylor Road, approximately 900 feet west of Northeast 7th Avenue, legally described as Sea Aire No. 2 according to the plat fereof recorded in Plat Book 98, Page 1 of the public records of Broward County, Florida, said lands situate, lying and being in Dania, Broward County, Florida. " ,.. Mr. H. J. Bauch, Professional Engineer for Southeast Environmental Consultants, Inc. , came forward to represent this request. He explained that the proposed operation would consist of cleaning ships tanks and trucking this in to put in tanks for separation to produce reclamated fuel. Mr. Bauch stated that no heat is used in the reclamation process. No one was present to speak in favor or against this special exception request. Mr. Sparkman recommended that this request be approved contingent upon the City Engineer' s approval. Motion was made by Howard Blackmon to recommend approval of special exception request PZ-47-81 subject to the City Engineers approval; seconded by Helen Udell and passed unanimously. Mr. Jernigan advised Mr. Bauch to appear before the City Commission on November loth. 5. PZ-48-81 - Mr. Jernigan announced the agenda item: "PZ-48-81 - Request is made by Janice S. Sorrentino for a variance to allow the construction of a carport to an existing single family residence within 18 feet of the front property line; subject property is zoned RS-6000 which requires a 25 foot front yard setback; existing structure is 20 feet from the front property line; for the property located at 818 Argonaut Isle, legally described as Lot 15, Block 1, Shelter Islands First Addition according to the plat thereof recorded in Plat Book 49, Page 44 of the public records of Broward County, Florida; said lands situate, lying and being in Dania, Broward County, Florida. " Mrs. Sorrentino came forward to represent this petition; she explained that they wish to construct a carport within 18 feet of their front property line; the existing structure is 20 feet from the property line. Mr. Sparkman recommended approval of this variance request with the stipulation that the structure is left open. Mr. Maxwell stated that the front setback on the existing structure is 20 feet and that most of the homes' in the area are built with a 20 foot setback; he recommended approval of this request as long as the structure is open and never enclosed. Motion was made by Sam Calandra to recommend approval of PZ-48-81 to allow the construction of a carport within 18 feet of the front property line with the stipulation that this structure may not be enclosed; seconded by Loretha Waiters and passed on the following roll call vote: Helen Udell - Yes Loretha Waiters - Yes Sam Calandra - Yes Skeet Jernigan - No Howard Blackmon - yes Mr. Jernigan advised Mrs. Sorrentino to appear before the City Commission on November 10th. 6. PZ-49-81 - Mr. Jernigan announced the agenda item: "PZ-49-81 - Request is made by Tugboat Annie' s, Inc. for a special exception to allow entertainment (a four-piece band) in a C-3 (commercial) zoning classification for the property located at 801 NE 3rd Street, legally described as a parcel of land in the NW4 of Section 35, Township 50 South, Range 42 East, said parcel being more particularly described as follows: Commencing at the Southwest corner of said NWk of Section 35; thence run North 890 10 ' 30" East (on an assumed bearing) 1661. 71 feet along the South line of said NW4; thence run North 00 07 ' 24" East 613.49 feet; thence run North 890 14 ' 20" East 425 feet; thence run North 00 07 ' 24" East 575. 93 feet, to the point of beginning; thence continue North 00 07 ' 24" East 97 feet, to an intersection with the Southerly line of the Dania Cut-Off Canal; thence run South 810 07 ' 09" West 208. 16 'feet along said Southerly line; thence run South 10 52 ' 17" West 68 feet; thence run North 890 08 ' 41" East 207. 70 feet, to the point of beginning. Said lands situate in the City of Dania, Broward County, Florida and containing 0. 391 acres, more or less. " Jerry Zweighaft of Tugboat Annie' s came forward to represent this petition. Mr. Zweighaft explained that they would like a four- piece band for entertainment inside and outside of the building. No one was present in objection to this special exception request. Mr. Sparkman recommended approval of this request provided that it was specifically for a 4-piece band. Motion was made by Loretha Waiters to recommend approval of special exception request PZ-49-81 for a four-piece band for a period of one year only; seconded by Helen Udell and passed unanimously. Mr. Jernigan advised Mr. Zweighaft to appear before the City Commission on November loth. 7 . PZ-50-81 - Request is made by Starling Howard for the People' s Music Workshop for a special exception to allow a theater in a C-2 (commercial) zoning classification for the property located at 6 Southwest Fifth Avenue, legally described as Lot 4, Block 19, Town of Modello (now Dania) according to the plat thereof recorded in Plat Book B, Page 49, of the public records of Dade County, Florida; said lands situate, lying and being in Dania, Broward County, Florida. " Mr. Starling Howard of 1302 NW 2nd ,Street, Dania, came forward to represent this petition. Mr. Howard advised that they wish to conduct a performing arts theater and that the building would also be available for banquets, etc. Mr. Maxwell advised the Board that a site plan and floor plan have not been submitted as of this date. Planning and Zoning Board - 4 - November 3, 1981 Regular Meeting Luther Sparkman recommended that this item be tabled until a site plan and floor plan have been submitted. No one was present in objection to this special exception request. Motion was made by Helen Udell that PZ-50-81 be postponed until the next regular meeting of the Planning and Zoning Board when they would have a proper site plan; seconded by Sam Calandra and passed unanimously. Mr. Jernigan advised Mr. Howard to appear before the City Commission on November loth. SITE PLAN APPROVAL 8. SP-03-81 - Mr. Jernigan announced the agenda item: "SP-03-81 - Rectory building for Church of the Resurrection located at 617 Northeast Second Street. Richard A. Baker, Architect. " Richard Baker, Architect at 316 Sunset Drive, Fort Lauderdale, came forward to present this site plan. Mr. Baker advised that the actual address of the rectory is 441 NE 2nd Street. Father O'Connel, of the Church of the Resurrection was present. No one was present in objection to this reuqest. Mr. Maxwell advised that the submitted site plan is in compliance with zoning and landscaping ordinances. Motion was made by Sam Calandra to approve the site plan as presented; seconded by Loretha Waiters and passed unanimously. I OLD BUSINESS Discussion of revisions to industrial zoning 9. D g classifications. Mr. Sparkman presented a proposed list of uses proposed for a new industrial district to be known as I-G(2) Qi.ndustrial,general 2) to accommodate the area of the Tigertail warehouses, Florida Steel, Davidson Lumber and Lindsley Lumber. Motion was made by Howard Blackmon to include the following uses to the I-G2 zoning classification: "Storage in bulk of asphalt, brick, building materials, cement, clay products, coal, contractors' equipment, cotton, grain, gravel, grease, hay, ice, lead, lime, liquor, plaster, pipe, lumber, machinery, roofing, rope, sand, stone, tar, tarred or creosoted products, terra Gotta, timer, wood or wool, provided the area so used is located inside a full enclosed building or masonry wall at least (6) feet in height.
