The regular meeting of the Planning and Zoning Board was called to

Motion was made by Loretha Waiters to approve the minutes of the '
last regular meeting of the Planning and Zoning Board of November 3, °
1981, as presented; seconded by Helen Udell and passed unanimously.
^rCOa2"IFNDATIONS TO CITY COMMISSION: Recommendations made at this
regular meeting of the Planning and Zoning Board will be submitted
to the City Commission for the regular City Commission meeting of
December 8 , 1981.
1. PZ-50-81 - Mr. Jernigan announced the agenda item: "PZ-50-81
This request was deferred from the last regular meetinq of November
3, 1981,. Request is made by Starling Howard for the People' s
Music Workshop for a special exception to allow a theater in a
C-2 (commercial) zoning classification for the property located at
E Southwest Fifth Avenue, legally described as Lot 4 , Block 19,
Town of Modello (now Dania) according to the plat thereof recorded
' in Plat Book B, Page 49 , of the public records of Dade County,
Florida; said lands situate, lying and being in Dania, Broward
County, Florida. "
Mr. Starling Howard came forward and presented a proposed site
plan and floor plan; he explained that they wish to have a
performing arts center; the premises will also be used as a hall
for banquets, fashion shows, etc.
Mr. Maxwell stated that all building codes will have to be met;
the structure was previously a grocery store; the seating capacity
is approximately 130; the parking' has increased triple.
Luther Sparkman recommended approval with the stipulation that no
nudity be allowed and that the variance be allowed for one year
only. r,

Mr. Jernigan advised Mr. Howard to appear before the City Commission

2. PZ-51-81 - Mr. Jernigan announced the agenda item: "n?-51-91 --
Request is made by Jane Prussianofor a variance to allow the
issuance of an occupational license for telephone use only ror sales
of jewelry in an R-3A (multi-family) zoning classification

for the property located at 111 Southeast Third Avenue #403 , legally
described as a portion of Dania Golf Course according to the plat
thereof recorded in Plat Book 32, page 17 of the public records of
Broward County, Florida; said lands situate, lying and being in
Dania, Broward County, Florida. "
Jane Prussiano of 111 SE 3rd Avenue came forward to represent this
petition; she explained that she has catalog sales only; no customers
or inventory will be in her residence; she will go to the customers .
Murray Gordan, President of the Meadowbrook Lakes Condominiumn
Association, came forward and stated that any commercial use is
in violation of their declaration.
Goldie Galber, owner of a Meadowbrook condominiumn, came forward in
objection.
Ms. Prussiano further explained that there would be no customers
in her home, only catalogs; she desires this occupational license
so that she may obtain a tax number and become legal. q.

2 Luther Sparkman recommended denial of this request. Mr. Jernigan ix
explained that the occupational licenses which have been approved
fora limited license have been from single family residences.

Motion was made by Sam Calandra to recommend denial of PZ-51-81;
seconded by Loretha Waiters and passed on the following roll call

Mr. Jernigan advised Ms. Prussiano to appear before the City
Commission on December 8th. fi
3. PZ-52-81 - Mr. Jernigan announced the agenda item: "PZ-52-81 `
Request is made by Rholanda Higgs-Rule for a variance to allow an
adult congregate living facility in an RS-6000 zoning classification
for the property located at 715 and 711 Southwest Sixth Street and
719 Southwest Fifth Street, legally described as Lots 9 and 10,
Block 6, and Lot 9, Block 7 , College Tract subdivision as recorded
in Plat Book 19, page 9 of the public records of Broward County,
V . Florida; said lands situate, lying and being in Dania, Broward
` County, Florida. "
;.� Wilson Atkinson, Attorney, came forward to represent Mrs. Rule.
Mr. Atkinson explained that Mrs. Rule desires to use the structures
for adult congregate living facilities. He also explained that even
though the area is zoned single family residential that it is built
up with multi-family units and a funeral home and nursing home
on the same street.
Mr. Atkinson introduced Mr. Davis, Mr. Robinson, Mrs. Sutton,
Mrs. Colbert, Mr. Stevens; all in favor of this variance request.
James Stevens, Director of Social Services and Human Relations with
the City of Dania, came forward and spoke in favor of this variance
request.
Gladys Schmit, who has a relative in this facility, came forward to
speak in favor of this request.
Mr. Maxwell advised that the two duplexes in this request have been
cleaned up by the petitioner.
Mr. Sparkman advised that this is mainly a multi-family developed
area and that he would recommend approval of this request.

Motion was made by Sam Calandra to recommend approval of variance
request PZ-52-81; seconded by Loretha Waiters and passed unanimously..
Mr. Jernigan advised Mr. Adkinson to appear before the City Commission
on December 8th.
4 . PZ-53-81 - Mr. Jernigan announced the agenda item: "PZ-53-81 -
Request is made by Ves Carpenter Contractors to vacate street
right-of-ways for North 15th Avenue; Hood Avenue; and Farragut
Avenue as designated on the plat of Hauer Subdivision according to
the plat thereof recorded in Plat Book 14, page 53 of the public
records of Broward County, Florida; said lands situate, lying and
being in Dania, Broward County, Florida. Subject property is generally
located on the northwest corner of Sheridan Street and Southeast
Fifth Avenue in the City of Dania and is zoned commercial. "
Paul Goldstein of Ves Construction came forward to represent this F
request. Mr. Goldstein explained that Ves Construction desires to
develop a shopping center with office buildings; the present right-
of-ways would not be functional to this development.
Mr. Maxwell read a letter from John Farina, City Engineer, explaining
his recommendations. A copy of this letter is attached and made a
part of these minutes.
Mr. Goldstein presented a sketch of the proposed development.
Carl Adler, Attorney representing his mother, who owns the property
directly to the west of this property came forward. Mr. Adler was
concerned with the proposed road easement to the north of the
proposed shopping center. He wanted to be assured that there would
be access to his property.
Motion was made by Loretha Waiters to defer this request until the
next regular meeting of the Planning and Zoning Board to allow time
for Mr. Adler to meet with Ves Construction and work out a solution
which would be acceptable to both property owners; seconded by Sam
Calandra and passed unanimously.
Mr. Goldstein was advised to appear before the City Commission on
December 8th.
Mr. Jernigan left the meeting at this time and Mrs. Waiters took
over the chairmanship.
SITE PLAN APPROVAL
5. SP-04-81 Site plan presentation by Motel 6, Inc. for a proposed
motel on East Dania Beach Boulevard, east of Gulfstream Road,
legally described as Roddy Dania Plat No. 1.
Mr. Gary Talbott of Motel 6 was present to represent this request.
Mr. Maxwell explained that this property has been cleared by the
U.S. Corps of Engineers.
Mr. Sparkman recommended approval of this site plan. Mr. Maxwell
stated that the landscaping exceeds City of Dania requirements and
that all other aspects of the site plan are in compliance with
City codes.
Motion was made by Helen Udell to approve SP-04-81; seconded by
Sam Calandra and passed unanimously.
6. SP-05-81 - Site plan presentation by U.S. Lend Lease for
multi-family development located on U.S. Lend Lease Plat No. 1,
generally located on Sheridan Street, east of Southeast Fifth Avenue.

Al Koch of U.S. Lend Lease came forward to represent this request.
He advised that on this revised site plan there would be a total
of 844 units in Dania. Mr. Koch presented a proposed site plan.
Luther Sparkman recommended approval of this request.
Motion was made by Sam Calandra to approve SP-05-81; seconded by
Helen Udell and passed unanimously.
Mrs. Waiters advised Mr. Koch to appear before the City Commission
on December 8th since a site plan was previously approved by the
City Commission, this revised site plan would also have to be
approved by the City Commission.
