HomeMy WebLinkAboutR-2009-043 Water and Wastewater Station 93 RESOLUTION NO. 2009-043 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, IN LIEU OF THE PROVIDING OF A WARRANTY BOND, RELATING TO THE PROVISION OF WATER AND WASTEWATER FACILITIES FOR THE NEW FIRE STATION 93; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City of Dania Beach has been issued Broward County Utility Connection Permit No. BCUCP-07-008 ("PERMIT") by Broward County ("COUNTY") for construction of water and wastewater facilities that would become COUNTY property and be operated and maintained by COUNTY; and WHEREAS, one of the conditions of the PERMIT is that the City of Dania Beach furnish COUNTY with a satisfactory bond covering all water and wastewater facilities built or altered which are to become COUNTY property ("IMPROVEMENTS"), warranting against all defects in workmanship, materials, equipment, or construction for a period of not less than one (1) year after completion ("WARRANTY PERIOD"); and WHEREAS, COUNTY is willing to accept a Resolution from the City of Dania Beach in lieu of a bond; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City of Dania Beach unconditionally covenants and agrees to guarantee and warranty all IMPROVEMENTS against all defects in workmanship, materials, equipment, or construction during the WARRANTY PERIOD, and the City of Dania Beach shall pay all costs to complete repairs to the IMPROVEMENTS during the WARRANTY PERIOD. Section 2. That the City of Dania Beach shall indemnify COUNTY for any and all loss or losses that COUNTY may sustain by reason of any defective materials or workmanship which become apparent during the WARRANTY PERIOD. Section 3. That the WARRANTY PERIOD starts on the effective date of this Resolution and ends one year after the effective date of this Resolution. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5.
