ORDINANCE NO. 2009-007 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE TEXT OF THE FUTURE LAND USE ELEMENT OF THE DANIA BEACH COMPREHENSIVE PLAN TO CREATE A REGIONAL ACTIVITY CENTER ("RAC") LAND USE CLASSIFICATION; AMENDING THE FUTURE LAND USE PLAN MAP OF THE DANIA BEACH COMPREHENSIVE PLAN TO CHANGE THE LAND USE OF APPROXIMATELY 1,350 ACRES AS DESCRIBED IN EXHIBIT "A" ATTACHED TO THIS ORDINANCE, FROM COMMUNITY FACILITIES, COMMERCIAL, CONSERVATION, EMPLOYMENT CENTER, INDUSTRIAL, LOCAL ACTIVITY CENTER, LOW (5) RESIDENTIAL, LOW- MEDIUM (10) RESIDENTIAL, MEDIUM (16) RESIDENTIAL, IRREGULAR (13) RESIDENTIAL, IRREGULAR (15) RESIDENTIAL, PARKS AND RECREATION, TRANSPORTATION, AND UTILITIES, TO REGIONAL ACTIVITY CENTER ("RAC"); PROVIDING FOR TRANSMITTAL TO THE BROWARD COUNTY PLANNING COUNCIL AND STATE AGENCIES; PROVIDING FOR ADOPTION PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; REQUESTING RECERTIFICATION FROM THE BROWARD COUNTY PLANNING COUNCIL; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach ("City") desires to amend its Comprehensive Plan's Future Land Use Element to create the land use classification for "Regional Activity Center" ("RAC"); and WHEREAS, in conjunction with the creation of the land use classification, the City proposes to amend its Future Land Use Map to designate a Regional Activity Center on the Future Land Use Map, as applicable to approximately 1,350 acres in and around the City's downtown, as further described in Exhibit "A"; and WHEREAS, the City's Planning and Zoning Board, sitting as the Local Planning Agency, held a duly advertised public hearing on March 18, 2009, and determined that the proposed amendment to the Future Land Use Element and Future Land Use Map (the "Amendment") is consistent with the goals and objectives of the City's Comprehensive Plan and, therefore, recommended approval of the Amendment; and WHEREAS, the City Commission held a duly noticed public hearing on March 24, 2009, regarding the Amendment and determined that the Amendment is in the interest of the City's public health, safety and welfare and should be adopted for transmittal to the Florida Department of Community Affairs for its review pursuant to Chapter 163 Florida Statutes, and WHEREAS, on , 2009, the City Commission held its second public hearing on the adoption of the Amendment, for final adoption in accordance with the requirements of Chapter 163, Florida Statutes. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City's Future Land Use Plan Map in the City's Comprehensive Plan is amended to change the designations of land, within the area described in Exhibit "A" to this Ordinance, from Community Facilities, Commercial, Conservation, Employment Center, Industrial, Local Activity Center, Low (5) Residential, Low-Medium (10) Residential, Medium (16) Residential, Irregular (13) Residential, Irregular (15) Residential, Parks and Recreation, Transportation, and Utilities, to Regional Activity Center(RAC). Section 2. That the text of the Future Land Use Element of the City's Comprehensive Plan is hereby amended according to Exhibit "B" to this Ordinance to establish the land use classification of"Regional Activity Center" ("RAC") and supporting objectives and policies. Section 3. That the City Commission authorizes the City Manager to transmit the Amendment to the Florida Department of Community Affairs and other state agencies pursuant to the requirements of Chapter 163.3184, Florida Statutes. Section 4. That the City Commission authorizes the City Manager to transmit an application to the Broward County Planning Council to request amendment of the Broward County Land Use Plan text and map, to establish a RAC in Dania Beach, and to request recertification of the City's Future Land Use Element, including the Future Land Use Plan Map. Section 5. The provisions of this Ordinance are declared to be severable if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. 2 ORDINANCE#2009-007 TRANSMITTAL STAGE Section 6. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. Section 7. The effective date of this Amendment shall be after the second reading and adoption of the amendment by the City Commission and, subsequently, the date a final order is issued by the Florida Department of Community Affairs finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes. The RAC designation will help spur much needed redevelopmer►t, entourage reinvestment in dysfunctional older areas, and provide the flexibility needed to create a more sustainable transit-oriented development pattern within the City of Dania Beach. The amendment is being proposed to assist in Implementation of the City's Community Redevelopment Area Redevelopment Plan, which cabs for land use changes that include the conversion of an obsolete industrial corridor within a single-family neighborhood to neighborhood mixed-use, the redesignation of heavy commercial land uses to marine use, and the adjustment to the boundaries of the cityy's transit corridor zoning districts and downtown transit-oriented development zoning districts. ANALYSIS OF pU AND SERVICES A. SANITARY SEWER ANALYSIS J. IDENTIFY WHETHER THE SITE OR PORTION IS CURRENTLY AND/OR PROP OSED TO BE SERVICED BY SEPTIC TANKS. Only a small portion of the amendment site will be serviced by septic tanks. The area is located north of the Dania Beach Cut-Off Canal and west of U.S. 1. All other areas are currently sewered. 2. IDENTIFY THE SANITARY SEWER FACILITIES SERVING THE AMENDMENT SITE INCLUDING THE CURRENT PLANT CAPACITY, CURRENT PLUS COMMITTED DEMAND ON PLANT CAPACITY, AND PLANNED PLANT CAPACITY. The amendment site is served by the City of Hollywood Regal Wastewater Treatment Plant. It has a current plant capacity of 60.0 MGD, current plus committed demand of 42.3 MGD, and there is no additional plant capacity planned. 3. IDENTIFY THE NET IMPACT ON SANITARY SEWER DEMAND RESULTING FROM THE PROPOSED AMENDMENT. PROVIDE CALCULATIONS INCLUDING ANTICIPATED DEMAND PER SQUARE FOOT OR DWELLING UNIT. A letter has been sent to the City of Hollywood Utilities Department to verify the above Information. Dania Beach Boulevard will continue to provide the ability to travel to the beach from Federal Highway. 8. AFFORDABLE HOUSt DESCRIBE HOW THE LOCAL GOVERNMENT IS ADDRESSING BROWARD COUNTY LAND USE PLAN POLICY 1.07.07. The City has outlined strategies to achieve and maintain a sufficient supply of quality, affordable housing units to senro the Danko Beach RAC in the Community Redevelopment Agency's Redevelopment Plan. These strategies were formulated based on the best available data and analysis using Professionally accepted methodologies. Proposed policy 27.1 states that "the development of the Regional Activity Center shall be guided by the Community Redevelopment Agency's Redevelopment Master Plan and consistent with all elements of this plan.' In addition, proposed policy 27.6 states that °Quality, affordable housing opportunities shall be included as a functional component within the Dania Beach Regional Activity Center.' R 9. Analysis: The Regional Activity Center land use designation is being proposed in response to planned commuter rail improvements that will affect the amendment area. It will promote the efficient use of public facilities and services in the City of Dania Beach through the encouragement of mixed use development and the assignment of densities and nor-residential intensities which support transit. OBJECTIVES Objective 10.01.00: Encourage the use of innovative land development regulations and techniques, for both residential and non-residential development In order to promote Manned communities and activity centers designed for efficient use of public services and facilities. Analysis: The Regional Activity Center land use designation qualifies as an innovative land development technique bemuse of its exceptional ability to provide greater flexibility in the assignment of densities and land rues. A RAC land use designation also Promotes mired use development which can increase activity levels of a greater period of the day aid allow for more efficient use of public service and facilities such as parking, transit, roadways, eta Objective 10.02.00: Encourage attractive and functional mired living, working, shopping, education and recreational activities by establishing within the Broward County Land Use Plan a Repwnal Activity Center land use category. Analysis: The City of Dania Beach is requesting in this application that the amendment site be designated as a Regional Activity Center. i POLICIES Policy 10.01.01: Encourage the use of mixed land use development regulations In those areas where compatible mixed kind use pattems currently exist or are planned. f; b> Analysis: Once the Regional Activity Center land use designation. is adopted, the City of Dania Beach will amend its land develop ment regulations toenwura e or require re the development of mixed use communities rifles within the amendm ent site area.. Curre ntly, the amendment site contain s parcels of land tha t ar e tanned for P the development of a pme local a employment center ctroity center and an Policy 10.01.02: Local governments should apply the Employment Center land use designations of the Broward County Land Use Plan to lands utilized or planned for mbced non-residential development. Analysis: The parcels of land which are currently designated as an Employment Center within the amendment site will continue to have the ability to support residential mixed use development through the Regional Activity Center and the creation and application of innovative land development regulations consistent with that land use designation. Policy 10.01.03: In order to create aesthetically pleasing living, shopping, working and recreational environments, local governments should develop and implement land development regulations to maximize opportunities for the application of innovative site planning concepts. Analysis: The Land Development Regulations that will be created consistent with the RAC will ensure that the amendment site will become an aesthetically pleasing living, shopping, working and recreational area. Assigning a Regional Activity Center land use designation to the amendment site is the first step in making it a reality. Policy 10.01.04: For proposed new or revised Regional Activity Center or Local Activity Center areas, Broward County shall, to address new proposed dwelling units and impacts, coordinate and cooperate in assisting municipalities to identify existing and proposed policies, methods and ptvgrarrua to achieve and/or E maintain a sulfident supply of affordable housing to serve such areas. Broward County shall accept from municipalities professionally accepted methodology and best available data and analysis. Municipalities shah ensure adoption of appropriate poky and program hnpl ernentatior measures to achieve and/or ` maintain a sufficient supply of affordable housing to serve such areas. *Affordable housing'shall hays the ream as defined by the Broward County Land Use Plan, and irciudes housing for a range of incomes, including "moderate Income,* up to 120%of the median annual income adjusted for family size for households within the county. The median annual income estimate should be updated at least yearly. t r In addressing the achievement and/or maintenance of a sufficient supply of affordable housing to serve a Regional Activity Center or Local Activity Center area, the municipality and Broward County may include, but shall not be limited to, consideration of the following: a. programs and policies involving mechanisms such as, but not limited to, impact fees, in-lieu fees, and/or public funds, in which the municipality, and/or Broward County, and/or other appropriate agencies, provide for the construction or supply of affordable housing; b. programs and policies involving mechanisms such as, but not limited to, impact fees, in-lieu fees, and/or public funds in which the municipality, and/or Broward County, and/or other appropriate agencies, provide funding to facilitate the affordable purchase or renting of housing; c. programs and policies in which the municipality and/or Broward County, and/or other appropriate agencies,facilitate the maintenance of the existing supply of affordable housing stock, if any; t d. property tax abatement programs aimed at preserving or creating affordable housing, e. streamlined and reduced-cast permitting procedures for affordable housing; f. specific minimum set-aside requirements for new affordable housing construction; g. use of appropriate existing public lands, or public land-banking, to facilitate an affordable housing supply; h. programs and policies to facilitate the development and use of municipal and/or Broward County affordable housing density bonus provisions; I. land development regulations which promote the availability of affordable housing such as reduced lot size and floor area for dwelling units, construction of zero lot line and duster housing, vertical integration of residential units with non-residential uses, and the allowance of accessory dwelling units. Analysis; The City has outlined strategies to achieve and maintain a sufficient supply of quality affordable housing units to serve the Dania Beach RAC in the Community Redevelopment Agency's Redevelopment Plan. These strategies were formulated based on the best available data and analysis using professionally accepted methodologies. Proposed policy 27.1 states that `tine development of the Regional Activity Canter shall be guided by the Community Redevelopment Agency's Redevelopment Master Plan and consistent with all elements of this plan." Policy 10.02.01: Local governments may propose land areas for designation as Regional Activity Centers within the Broward County Land Use Plan, consistent with the rules and procedures contained within the Regional Activity Center Permitted Uses subsection of the Plan Implementation Requirements section of the Broward County Land Use Plan. Analysis: The proposed Regional Activity Center is consistent with the rules and procedures contained within the Regional Activity Center Permitted Uses subsection of the Plan Implementation Requirements section of the Broward County Land Use Plan. Specifically, the amendment site meets the following requirements which must be met in order to qualify as a Regional Activity Center: Requirement#t1: The Regional Activity Center shall be a specific geographic area consisting of at least 160 gross contiguous acres. No new Regional Activity Center shall be permitted on the barter island (the area east of the Intracoastal Waterway). How this requirement is met: The proposed Regional Activity Center in Dania Bead is a specific geographic area with defined boundaries. In total, the proposed RAC c consists of a total of 1349.1 gross contiguous acres. No part of the proposed Regional Activity Center is east of the Intracoastal Waterway. Requiremenlilli2a: The density and intensity of land uses permitted within each Regional Activity Center shall be specified within the Broward County Land Use Plan. How this requirement Is met: The density and intensity of land uses to be permitted within the proposed Dania Beach Regional Activity Center are dearly specified. Requhvw*rd#2b: An intenbcal agreement between the municipality and Broward County must be executed which provides that monitoring of development activity and enforoerrrent of permitted land use densities and intensities shall be : the responsibility of the affected municipality. Now It" re"llrement is met: The City agrees to have the responsibility of monitoring development activity and enforcing the permitted land use densities and Intensities permitted under the Regional Activity Center land use designation and will comply with the requirement for execution of an interlocal agreement. Requirement*i: Regional Activity Centers shall include mixed land uses of regional significance, including residential uses. How this requirement is met- The proposed Dania Bead Regional Activity Center land use designation allows for a variety of uses including residential uses. The amendment site is an area appropriate for regional activity for a number of reasons including: the site's proximity to the Fort Lauderdale — Hollywood International Airport and Port Everglades, the site's designation as a Community Redevelopment Area, the site's current mix of uses including hotels, employment center, local activity center, and tourist destinations. Requirement 04: Regional Activity Centers shall be the subject of an Areawide Development of Regional Impact, centers of regional tourist activity, employment or education, or provide direct access to existing or proposed airports, ports and rail mass transportation facilities. How this requirement is met: The proposed Dania Beach Regional Activity Center is a center of regional tourist activity and employment center. The amendment aite is commonly traversed by those heading to Port Everglades to board a cruise or flight at the Fort Lauderdale-Hollywood International Airport. it is also traversed by those heading to the beach via Dania Beach Boulevard, or on their way to visit the City of Dania Beach antique district or other tourist destinations such as Jaxson's Ice Cream Parlor and Restaurant via U.S. 1. The amendment site is an active employment center for the marine industries and the RAC is being proposed to expand on this use. f The amendment site also provides direct access to the Fort Lauderdale- Hollywood International Airport via Griffin Road, and surrounds a portion of the Florida East Coast railroad which is currently undergoing preliminary planning for a commuter rail station Requirement 06: Each Regional Activity Center shall be a defined geographical area, delineated on the Future Broward County Land Use Plan Map (Series). Boundaries for all RACs shall be determined following reasonable and logical Emits incorporating tracts and parcels planned for development and/or redevelopment. Now this requirement Is met: k k I The boundaries of the proposed Dania Beach RAC are congruous with the boundaries of the City of Dania Beach Community Redevelopment Area (CRA). in addition, the boundaries include major nodes of activity including intersections of major roads in Dania Beach, and all land parcels which have the current land use designation of Local Activity Center and Employment Center. Requirement f16: To enhance pedestrian/non motorized activities and connectivity, Regional Activity Centers shall integrate open space that is accessible to the public (i.e. greenways, public plazas, recreational areas) within the Regional Activity Center. How this requirement to met: The Dania Beach RAC is intersected by a total of fire planned greenway trails. The City will continue to work with the County in the planning and development of these trails. In addition, the strategies for the enhancement of pedestrian/non motorized activities and connectivity and the integration of open space are outlined in the Community Redevelopment Agency's Redevelopment Plan. Proposed policy 27.1 states that "the development of the Regional Activity Center shall be guided by the Community Redevelopment Agency's Redevelopment Master Plan and consistent with all elements of this plan." Rsquiromwnt 97: Each Regional Activity Center shall be governed by local land use element policies which ensure that performance and design standards are adopted within local land development regulations that provide for an Interconnected street network, a safe and attractive pedestrian environment and mu"odal transit connections. How this nequiromsM Is met: One of the policies governing the proposed Regional Activity Center land l use designation states that performance and design standards are to be adopted within the Dania Beach Land Development Regulations that provide for an interconnected street network, a safe and attractive pedestrian environment and multi-modal transit connections. In addition, the Community Redevelopment Area Redevelopment Plan includes specific design standards to ensure a safe and attractive pedestrian environment and muftianodal transit connections, Requirornent 88: Each Regional Activity Center shall be governed by local land use element policies which provide that design standards are adopted within local land i w- a: development regulations ensuring compatibility between existing and planned land uses within and adjacent to Regional Activity Centers. How this requirement Is net: One of the policies governing the proposed Regional Activity Center land use designation states that design standards are to be adopted within local land development regulations ensuring compatibility between existing and planned land uses within and adjacent to Regional Activity Centers. Requirement 09: Prior to submittal by a municipality of a Regional Activity Center amendment to the Broward County Land Use Plan, the municipality shall ensure that the proposal has been subject to a broad public participation process, including property owners within and surrounding the RAC amendment area. The public participation process should also include a description of potential effects on individual property rights. Examples of a broad public participation process may include, but not limited to, the following: mailed noboes to affeclsd property owners, advertised public workshops, and meetings targeting the affected property owners, business owners, residents and other stakeholders. How this requirement is net: The Regional Activity Center designation is being proposed to assist in the implementation of the Community Redevelopment Area Redevelopment Plan. Abroad public participation process including various workshops and visioning exercises was recently completed for the update of the Community Redevelopment Area Redevelopment Plan. The CRA boundaries are congruous to the boundaries of the amendment site and the RAC land use designation will provide the vehicle to implement the CRA plan. It is anticipated that there will be no not loss of property rights in the amendment site am and so, the property rights issue, specifically, was not discussed. Policy 10,02.02: Non-motorized transportation as well as mass transit shall be encouraged to$erve Regional Activity Centers to reduce reliance upon automobile travel. K Analysis: In addition to Strategies contained in the Community Redevelopment Agency's Redevelopment Plan which may help to Implement this policy, the following policy governing the Regional Activity Center land use designation is proposed for adoption in the Dania Beach Comprehensive Plan: r Policy 27.3 Non-motorized transportation as well as mass transit shall be encouraged to serve the Dania Beach Regional Activity Center to reduce reliance: upon automobile travel_ Policy 10.02.03: To facilitate public transit access, integrated transportation systems should be encouraged to serve Regional Activity Centers. Policy 10.02.05: Local land use plans should provide for substantial housing opportunities within Regional Activity Centers to allow people to both five and work within such areas.
