HomeMy WebLinkAboutR-2009-056 Red Flag Rule RESOLUTION NO. 2009-056 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, WAIVING COMPETITIVE BIDDING AND ENGAGING ONLINE UTILITY EXCHANGE AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE COMPANY FOR CREDIT CHECK SERVICES IN COMPLIANCE WITH THE "RED FLAG" RULE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), provides that contracts for the purchase of supplies, services, equipment and materials for the City government in excess of Twenty Five Thousand and No/100 Dollars ($25,000.00) shall not be entered into or let except by authorization and approval of the City Commission, after advertisement for bids in a newspaper published in Broward County, Florida, with such publication to be published weekly for two (2) consecutive weeks with the first publication to be not less than fifteen (15) days prior to the reception of bids; and WHEREAS, the City utilizes a Sungard H.T.E. application for water and sewer billing, and accounts receiveable; and WHEREAS, Sungard H.T.E. has partnered with Online Utility Exchange to provide credit check services as required by the Federal "Red Flag Rule" the compliance date for which is May 1, 2009; and WHEREAS, competitive bidding is not recommended for this service; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Manager is authorized to enter into an agreement with Online Utility Exchange for credit check services. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on april 14, 2009.
