A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, INVOKING ZONING IN PROGRESS; DECLARING
THAT THE CITY IS CONSIDERING AMENDING ITS LAND
DEVELOPMENT REGULATIONS TO REGULATE MEDICAL OFFICE USES
THAT DISPENSE ON-SITE CONTROLLED SUBSTANCES TO A PATIENT;
PROVIDING DEFINITIONS; PROVIDING SUPPLEMENTAL
REGULATIONS; PROVIDING FOR POSTING OF NOTICE; PROVIDING
FOR CONFLICTS; AND FURTHER PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Dania Beach, Florida (the "City")
desires to review its existing city land development regulations (the "Regulations") to determine
if there is a need to amend the Regulations to regulate the location of medical offices that
dispense controlled substances on-site and the adoption of any necessary supplemental zoning
regulations; and
WHEREAS, the City Commission wishes to direct staff to start developing Regulations
for Commission review and adoption as provided in Chapter 28 of the Code of Ordinances of the
City of Dania Beach, Section 9.24.1 entitled "Review of Permits and Development Orders with
Regard to Zoning in Progress"; and
WHEREAS, the City wishes to place all parties on notice that it is considering amending
its Regulations and that any proposed use of property in the City for the operation of a medical
office with the on-site dispensing of controlled substances will be reviewed for compliance with
any changes made to the Regulations as contemplated in this Resolution as of the effective date
of this Resolution; and
WHEREAS,adoption of this Resolution at this time is in the best interest of the residents
of the City of Dania Beach, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. Recitals. The above recitals are true and correct and are incorporated by
this reference.
Section 2. Zoning in Progress. The City declares that City staff immediately review
and recommend appropriate amendments to the City's Regulations regarding medical offices
with the on-site dispensing of controlled substances; which zoning districts are most appropriate
for the location and operation of medical offices with the on-site dispensing of controlled
substances; and whether the adoption of any supplemental zoning regulations are needed. The
proposed amendments to the Regulations, if adopted, will amend the City Code of Ordinances.
Therefore, requests by individuals, who seek a Certificate of Use for property located in the City
as a medical office with the on-site dispensing of controlled substances will be reviewed, as of
the effective date of this Resolution, for compliance with the provisions of the proposed
amendments to the Regulations. Zoning in progress shall be in effect for three months, unless
extended by the City Commission as permitted in Section 9.24.1 of Chapter 28 of the Code of
Ordinances of the City of Dania Beach.
Section 3. Public Notice. A copy of this Resolution shall be posted at City Hall
upon its Effective Date.
Section 4. Effective Date. This Resolution shall become effective immediately upon
its adoption.
