A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUEST MADE BY PEDRO GARCIA, OWNER, FOR AN EXTENSION
(ORIGINAL EXTENSION WAS APPROVED ON JUNE 10,2008 AND EXPIRES
ON JUNE 10,2009)RELATING TO THE APPROVALS OF VARIANCE VA-55-
07 BY RESOLUTION NO. 2008-099 AND THE SITE PLAN REQUEST SP-86-06
BY RESOLUTION NO. 2008-100, FOR PROPERTY GENERALLY LOCATED
AT THE SOUTHWEST CORNER OF GRIFFIN ROAD AND RAVENSWOOD
ROAD (ANGLERS AVENUE), IN THE CITY OF DANIA BEACH, FLORIDA;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS,on June 10,2008,the City Commission approved a request for a variance for
the following:
I. To allow the rear setback to be 11'3"(Chapter 28,"Zoning", Article 4.20,"Schedule of Lot
Yard and Bulk Regulations", requires a 19'6" setback in a C-2 Zoning District);
2. To allow 10 foot clearance for proposed canopies (Chapter 28, "Zoning", Article 6.64,
"Principal arterial commercial design standards overlay", requires a 14 foot clearance for
canopies);
3. To allow 18%pervious area. (Chapter 33, "Zoning Appendix", Article 3, "Impervious land
area requirements", Section 33-45(5)requires a 25%pervious area);
for property owned by Pedro Garcia(the "Applicant"), pursuant to Resolution 2008-099; and
WHEREAS,on June 10,2008,pursuant to Resolution No.2008-100,site plan approval for
the proposed construction of a 174,000 square foot shopping center, for the property (generally
located at the southwest corner of Griffin Road and Ravenswood Road also known as Anglers
Avenue,Dania Beach), was granted subject to conditions; and
WHEREAS,the owner is requesting an extension of the approvals associated with the above
described project relating to the variance request and site plan until June 10, 2010;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the request to extend the expiration date of the approvals to June 10,
2010 for the variance and site plan requests are approved, subject to the conditions previously
approved by the City Commission as follows:
1. Must provide recorded copy of plat prior to issuance of a building permit (Planning Division).
2. Applicant must obtain a tree removal permit prior to commencing site work. Specimen removal
fee of$55,410.00 and canopy replacement fee of$11,070.00 must be paid prior to issuance of a
tree removal permit (Landscape Consultant).
3. Water flow required is 2,500gpm; existing water supply is 616gpm. Water supply must be
addressed. Per submitted calculations, the largest building requires 2,500gpm. According to
flow test submitted, the water supply is only 616gpm (Fire Marshal).
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
