HomeMy WebLinkAboutR-2009-078 Luckys Site Plan Modification RESOLUTION NO. 2009-078 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST FOR MODIFICATIONS TO SITE PLAN SP-08-08,APPROVED BY RESOLUTION 2008-142 ON AUGUST 26, 2008, SUBMITTED BY COURTNEY CRUSH, ATTORNEY WITH THE FIRM CRUSH LAW, P.A., REPRESENTING THE OWNER JAY PATEL, FOR PROPERTY LOCATED AT 205 NORTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 8.4 of Article I of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Courtney Crush, attorney with the firm Crush Law, P.A. representing the owner, Jay Patel, has applied for modifications to the site plan approved by Resolution 2008-142, relating to the proposed construction of a 6 story(72 foot tall)75-room hotel,for property located at 205 North Federal Highway, Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modifications to the site plan (SP-08-08), for property located at 205 North Federal Highway, Dania Beach are approved, subject to the conditions previously approved by the City Commission as follows: 1. Must provide copy of recorded plat prior to issuance of a building permit or apply for plat at this time,per Chapter 8, Section 8-5 (Planning Division). 2. On the Landscape Code notes in the lower left corner, item 3),you only specify 7 of the 15 trees used for the perimeter buffer. This was listed correctly on the previous submittal and is likely a typo.Please update the note.If there is no room,you can just use a symbol in the plant list above instead(Landscape Consultant). 3. There still remains a discrepancy between the water supply(1,180 gpm) and the water demand for the building (1,575 gpm). Clarify intended resolution (Fire Marshal). 4. Identify the locations and distance of the closest hydrants to the project in both directions on US 1 and on NW I" Avenue (Fire Marshal). 5. Additional impact protection (bollards) may be required — inspector will field verify at installation (Fire Marshal). 6. Standpipes are not identified on the 4`h and 5`h floors. Please provide (Fire Marshal). 7. Provide a copy of the complete site plan (to include architectural drawings and civil drawings) with all corrections made on CD-ROM or sent via e-mail in PDF format (Fire Marshal). Section 2. That based upon the criteria set forth in Section 84(p)of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
