A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUEST MADE BY DAVID ZELCH, ARCHITECT, REPRESENTING
THE AMERICAN MARITIME OFFICERS BUILDING CORPORATION OF
FLORIDA, INC., (AMO), FOR AN EXTENSION TO THE APPROVED SITE
PLAN(SP-46-07)BY RESOLUTION 2007-236 AND VARIANCE(VA-47-07)BY
RESOLUTION 2007-235 ON DECEMBER 11, 2007, FOR PROPERTY
GENERALLY LOCATED AT 601 SOUTH FEDERAL HIGHWAY,IN THE CITY
OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on December 11, 2007, pursuant to Resolution No. 2007-235, the City
Commission approved a request for a variance for the following:
1. Reduction of street yard setback on Federal Highway from 20 feet to 14 feet;
2. Reduction of interior side of yard setback from 10 feet to 5 feet;
3. Reduction of terminal landscape island width from 10 feet to 5 feet;
4. Reduction of landscape buffer on southeast corner of property from 10 feet to 5 feet;
5. Reduction in off-street parking from required 75 spaces to 46 spaces; and
6. Ground level parking adjacent to Federal Highway instead of"active uses such as retail
sales, restaurants, offices, and other similar uses";
for property located at 601 South Federal Highway in Dania Beach; and
WHEREAS, on December 11, 2007, the City Commission, pursuant to Resolution No.
2007-236,granted site plan approval for the proposed construction of a three-story office building for
the property subject to conditions; and
WHEREAS,David Zelch,architect,representing the American Maritime Officers Building
Corporation of Florida, Inc., is requesting an extension of the approvals associated with the above
described project until June 11, 2009;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the request to extend the expiration date of the approvals to June 11,
2009 for the site plan and variance requests is approved,subject to the condition previously approved
by the City Commission as follows:
"The applicant shall provide and pay for an off-duty detail BSO officer who will be
assigned to work the detail on the days that the monthly union meetings are held,to
prohibit parking that is disruptive to the adjacent residential area, for a period of six
months, beginning with the first monthly union meeting. If recommended by City
staff, the City Commission will be advised whether or not it is staffs
recommendation to continue the detail,"
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
